  2. Thank you for your kind words closey. The letter is lengthy, but I think it spells out in one place what is required of any settlement of my claim. For those of you reading my thread, thinking their offer is substantial, and being inclined to accept it, it is important to note that my consequential losses amount to several thousand pounds:shock: . In light of that, I think perhaps you too would decline their conditional, part offer.

  3. Hello. Copy of badly written, excuse riddled letter, received from SHABBEY today as well as my reply below. Stick to your guns everybody. This works. Donation to CAG website on its way. Any single ladies out there that want to help me celebrate should drop me a line immediately. Adios, Nick. _____________________ Our Ref LEG/APS Date 9th Aug 2006 Dear Nick, I refer to the above proceedings and to the default judgement and warrant you have obtained. Abbey has no record whatsoever of ever having received the Claim Form from the Court. Because of this, our normal procedure would be to appl

  6. You can win by default in two instances 1-The other party hasn't acknowledged the claim: The court will now send the bank the necessary documentation. Probably tomorrow. They will also send you a copy. On there it will say when these papers will be "deemed served". From that day the bank has 14 days to acknowledge the claim. If they don't you can go to maoneyclaim and tick the box next to "The defendant has not filed an admission or defence to my claim" and get a judgment by default. 2- The bank will acknowledge the claim within 14 days but will not submit a defence. Then you can win by default too. So you are going to have to wai

  13. I think that the case against DCAs is even easier to prove. Whilst the Consumer Credit Act allows banks to transfer debts and amounts of alledged indebtedness, there is nothing in there that allows the transfer of the complete contract. You have the right to renegotiate any term or condition when a contract is assigned, if you are not sure of the new company, or are convinced that the service offering may be reduced. Again, Schedule 2 of the UTCC Regs. Regulation 5(5) INDICATIVE AND NON-EXHAUSTIVE LIST OF TERMS WHICH MAY BE REGARDED AS UNFAIR 1. Terms which have the object or effect of- [...amongst other

  14. Hi Betty as long as you clearly set out which are estimated in any schedule, you should be ok.I believe that you can amend your claim accordingly if the need arises. this is the wording I used on the claim form- Claim Description 1. The Claimant has had an account ("the Account") with the Defendant which was opened on or around (year) 2. During the period in which the Account has been operating the Defendant debited numerous charges to the Account in respect of purported breaches of contract on the part of the Claimant and also charged interest on the charges once applied. The Claimant understands that the Defendant con

  17. Thank you for your answers, most appreciated. Last two thing si promise... just working out whether to take the plunge! Firstly, I noticed that orange put some entires on your credit record AFTER you had changed it... does this mean thaty entries can still be placed on it (I would want this to happen to gain a good credit history) Secondly, THe credit accounts you have applied for, were any of them instant, online decisions? That is some awesome information you have provided us with which i expect credit reference agencies would rather us not have... Thanks again

  18. Hi all, Got my Allocation Questionnaire in this morning's post together with a copy of the Lloyd's defense from the County Court (it's been moved from Northampton to my home town, Bournemouth now). It seems to be the same type of defence that most of you have had from Sechiari Clark & Mitchell (I've posted it below). One thing I have noticed however is that my letter is not from a 'Partner' of the law firm, but from a 'Recoveries Team Leader'....sounds like this is someone from a way lower level than a Partner! I've got to return the Allocation Questionnaire by 9th August. Can I ask, In everyones experience, are

For those that have looked at their statements and may be wondering, what can i claim for?, and why are the descriptions confusing?, what about the overdraft interest is that claimable aswell? wonder no more. you can claim for anything which is deemed a penalty charge, which includes: returned direct debits, card mis-use, unpaid standing order, unpaid item, exceeding your overdraft, overdraft interest (see below), total charges (see below) notifed fees Unauthorised overdraft arrangement fees (more will be added as and when confirmation is found) you can not claim for: ATM (cash machine) usage (typica

  20. Hi Nafta. With Barclays, look for the following entries..... UNAUTH O/D FEE. PAID REFERRAL. UNPAID OUTS. Suggest that you get a hi-lite marker and work through your statements, marking the above. Next, enter them into a spreadsheet. You will find a suitable Excel template to download in the templates library. Click on the following link....... http://www.bankactiongroup.co.uk/TEMPLATE.xls N.B....Make sure that you save the completed spreadsheet on your PC. You will need it again. Print out a copy of the completed spreadsheet and enclose with your claim. DO NOT include the 8% interest until the Moneyclaim

  21. The Only charges you cannot or should not add, are those relating to an account fee such as the Barclays additions account (£10.00 a month I think) if you have agreed a contract to use something like the additions account, then this is a charge for the privilege of having this account and it's so called benefits. You can add charges that are related to overdraft fees, excess overdraft fees, interest fees and failed payment charges such as direct debits standing orders or cheque returns etc. These are all charges that may have put you into an excess overdraft or overdraft position given that had these charges not been applied, you would
