  1. I have been suspended from work and have a disciplinary meeting for Gross Misconduct on Monday to discuss it. The charges are trumped up, some are absolute lies. I can prove some are true but not others. Either way I'm fairly sure they want me out and they have enough evidence to do it. I don't care about losing the job but I really don't want a sacking on my record. I have adequate savings so I'm not worried about not getting job seekers. I know I'm innocent of it all and so do the people that matter so I'm not worried about proving anything really. Is it better to resign? I've been told my company just give a very basic reference i.e 'he worked here from x date to x date' Would I have to do it with immediate effect on Monday morning? Thanks in advance for any help/advice. This is a horrible time.
  2. Hi I received a PCN from a Free! carpark some time ago.. 4 hours free then pay. I received no letters from UKCPM about a fine nor do i know what it was for . . I then get a letter from Gladstones saying Pay £160 else court action. I 'forgot about it'. Next i get a court letter which turned up at my address late , saying £273 to pay with response within 14 days else action will be taken. Ok this one i genuinely did forget about, i emailed them stating the letter was late and i forgot to take action due to work commitments and stress. Next thing i know i have a CCJ on my credit file and a letter from the courts saying they made a judgement. Luckily i had 30 days to pay the £273 and they will lift the CCJ so without haste i paid and the CCJ is now gone. two days ago i receive yet Another! Gladstone solicitors letter on behalf of UKCPM. new reference number so a new claim, this one as before £160 before court action. and again , no letters from UKCPM beforehand. Now, i know this will go to CCJ if i ignore it, but what can I do? the carpark is free for 4 hours ! i used it almost every day for the Gym. the carpark is poorly marked, paint very worn on disabled bays, no phone number to call to extend your stay. you have to display a ticket but half the time the machine was out of order however i still am aware of PCN's being issued for non ticket when the machine is not operational. What shall i do? Many thanks for your help
  3. I am writing this on behalf of someone else. Where i use the words me i or us means the person involved. Not me. I was employed as a mobile with a well known security company. My main job was to respond to alarms and deal with them. When i started my job off i was told that i was on a gauranteed 24 hour contract (weekly). I was not given any paperwork apart from some paperwork to show how and what i should be doing. I was told be my manager that i would recieve my contract in the post during the next 4-6 weeks. I also emailed my manager and he confirmed that i had indeed signed upto a 24 hr gauranteed contract that gauranteed me work of at least 24 hours a week. This manager left and work was going on well until october when my vetting was complete and i was sent a 0 hours contract by Human resources. I immediately phoned up and was told to query this with my manager. 2 emails were sent and nothing happened. Again in january this year my manager changed and i raised this again with hr. The new manager said he would investigate this. He came back to me and told me that the email i had was worthless and that i was on a 0 hours contract. Worst bit my days have been cut where i was without any income for 6 weeks. Since august last year i have put in several uniform requests and have had 0 back as manager keeps on claiming he has lost paperwork. This is despite sending 2 emails to him. I now come to the part After having nearly 6 weeks without work i started back a few weeks ago. The first night back i was pulled by traffic police and asked why i was watching a video playing while driving. The mobile is on a stand. I told the officer i was not watching i was only listening to the music and mobile was facing other way. Officer gave me words of advice and then took my details and after a few minutes told me i could go. No probs so far. He then phoned my employers and told them he was concerned for my safety. I only found out when a fellow officer came looking for me. As far as i was concerned the matter was finished. I did not log it either. Fellow officer told me that a call had been recieved and that the matter had been escalated to the manager. No probs here. The manager phoned me the follwoing day and told me i was suspended pending a investigation and that suspension would be unpaid. I have been to the investigation meeting and i was shown a picture of me sitting in my van with the mibile facing me. I was told this was taken by the other officer and he was allowed to do this. I have now been told that a decision will be taken and if needed a disciplinary will be held. I have been told not to contact any of my fellow workers. What do i do ?

This post is long over due I need some help and advise as I just don't know if I can take this stress on my shoulders any more despite having a loving caring family and the shame that this will bring on our family. April last year I received a letter from HMRC compliance asking me to contact them re Self assessment return for 14-15 as they wanted confirmation expenses claimed, at the time I had been employed as a sales manager and had to take clients out a lot and they often refused to sign off expenses so I just put them through on my tax return as I thought that I could do this and had been doing it for a number of years including road mileage etc. Around the same time I had just been made redundant but managed to get a job for an oversees company but could only pay me as a contractor as no accounts in the UK, this was always going to be a temporary arrangement or so I thought. Meanwhile I had been in contact with my compliance officer at HMRC and sent him everything that he had asked for and he was a actually a really nice man and reassured me that this wasn't a criminal investigation merely putting all the facts together. A while passed and whilst occasionally in communication he asked me to meet him at the HMRC office in London this was now October so I did and I was taken to a room where him and a colleague who was there to make notes greeted me. He told me that I shouldn't of been claiming expenses on HMRC as the company that I had worked for had an agreement with HMRC for employees claiming expenses (there is a word for this but I cant remember) which is fine but they clearly understand the characters that I had worked for and the problems we had getting these signed off. the compliance officer at the end dropped the bombshell that I owed 70k as they had gone back 10 years and they where going to add penalty charges and interest but they wouldn't know what that was yet, I was obviously gob smacked and I said that I didn't want to go bankrupt as this would effect my job and any future job prospects because of the nature of my sales role. They both categorically told me that I wouldn't be made bankrupt and I would be able to pay them off as long as it took and I would still be able to have nice holidays and they even said they couldn't get blood out of a stone. So whilst I came away from the meeting very anxious it was reassuring to think that I could pay this off maybe over 10 years or so. I soon got confirmation that in total with everything added I owed around 120k which is unbelievable considering the debt was 70k and during these years I had been paying a lot of tax and (I have never not paid tax since I was 16). I soon got letters from the HMRC debt management and was asked to contact them which I did and I was immediately taken back as to how aggressive they where and when I explained my conversations with my compliance officer they just laughed and said that they have got no authority to be giving me information like that and It is completely wrong and they said that ultimately If I couldn't pay I would be made bankrupt. I immediately contacted my officer and I have this on email and told him what had happened and he came back on email and said that he would contact them which he did and came back and said that he had spoken to them and it should be fine now. I contacted them again and they told me exactly the same thing that he shouldn't be getting involved we are the debt management team and that was that. Shortly after I had a visit from a field office and had the same conversations and she said the same things like we are not a bank and why should we let you pay over a period of years we want our money now. eventually I got a letter from the Debt final resolution team and whilst the lady has been very nice she gave me until the end of next year to pay the debt which means me finding 4k a month and a lump sum of 70k and whilst I have been trying to find someone to lend me the money its just not going to happened and I have paid the 4k for 2 months and its just left me and my family not paying for other debts and we have got behind with everything like car payments, Loans etc and I am not at my wits end as there is no light at the end of the tunnel I cant even afford to buy my boys school clothes to go back to school. The thing is I have never disputed the money I owe them I would honestly pay back every penny the thought of going bankrupt fills me with dread and how this would effect our family and stigma attached to it and will it be in papers who will find out I just have no where to turn and my employer will probably sack me once I tell them its just a really awful situation and I need help.
  5. Hello, could someone please offer some advice. I received a ccj claim from the ncbc for a claim from Restons solicitors on behalf of their client capquest. I do not recall the debt what so ever. allegedly a catalogue. so i acknowledged the claim in order to give me time to file a defense. I sent restons a request for documents that they mentioned in the particualrs of the claim under cpr 31.14. first one got lost so sent another, they received this on 18/07/17 I asked that the request was carried out within 7 days. this has now passed also sent a cca request to capquest, to date still nothing received. as they haven't replied to my request where do I stand filing a defense when when i cant even see the documents they intend to rely on, its absurd in my opinion. obviously the clock is ticking as i filed the acknowledgement on 11/07/17. as im new to this any advice would be appreciated
  6. Hi there, I have just received a letter from Howard Cowen being requested by Robinson Way LTD. The letter is Notice of pending legal action. The debt i owe is £11,834a nd they are saying they want me to make a full payment within 14 days or if unable please contact our client's agent Robinson way to discuss an affordable payment plan. If i am unable to pay this account you must still contact our clients agent RW to discuss your options which may prevent legal action being taken. Failure to respond to this letter will result in legal proceedings being issued without further notice. I obviously have not got the funds to pay this debt and have managed no contact with them for around 5 years. they have however finally caught up with me and are now threatening County court and ccj against me. Can you please advise me on what to do next as i have no clue and i have just been avoiding this debt for so long. Thank you
  7. Hi and thank you for reading this Following a relationship breakdown last year I had the indignity of having my car repossesed by Moneybarn. My boss tried to intervene and talk to them saying that if they did not go ahead with the repo she would ensure that money was deducted at source and sent straight to them. They were quite rude and aggressive (the reason why I gave up trying to talk to them) and rejected this and I allowed them to collect the car from an agreed location. As I had not paid one third of the finance off I acknowledged I couldnt fight them. The car was a 1ltr Toyota Aygo which I purchased for around £6,000. They sold it at auction for £3,000 and told me I owed them £8,000 in interest for the balance of the four year loan. I told them to get on with it! Last Saturday I received a county court claim from Moneybarn claiming around £8,500 from me. As they knowingly sold the car at an undervalue can I defend this in any way? As it is I have nothing to pay them with, I work and after paying my way there is little left especially to pay for non-existent interest. I have until next Friday to respond - yes I know I should have done something sooner but I have been running the office as my boss had to spend the week attending to a dying relative. Moneybarn has to be the most ignorant organisation I have ever dealt with. I have been patronised by someone possibly younger than my own son, spoken at and talked over. This is why I ignored them. I have an anxiety disorder and cannot do confrontation without going to the extreme of caving in or losing it completely. Can I defend this? What can I do? Any suggestions please folks
  8. Hi everyone, Thank you for taking the time to view my post. I really hope someone can offer advice.. I'm going to be blunt, and please forgive me, but I've never spoken about this to anyone before. nearly 5 years ago my marriage broke down, I had to leave my family home, and close down my business. I moved away from the county I lived in as I didn't have any work any more, and my sister let me live in a flat above a pub she owned. I slipped into a deep depression that was lifted when I started to see a new lady. She left me, My sister helped me until she knew I would be OK. She then made me move into her home. I was seen by a GP and referred to mental health services. I was put on medication, and had a direct line to support workers. Around this time I applied for a credit card. I had nothing, and I guess (I honestly don't remember) I thought it would make me feel good about myself. (I had already pawned my wedding ring) I made a few payments, had to move in with mum n dad. I moved to my brothers, but I had to leave there, moved in with an old school friend - sofa surfing. Sadly I had to move out, and was living in my car - only for a few weeks, but it was bad enough. As you can guess after a while I had stopped paying the credit card. I'm not proud to say I often bury my head in the sand. it's now 4 years later, and I have a job - been working 6 months! I have a flat I rent now. Things started to look up. I am now on different medication for acute depression and anxiety, it's still there, but as i said things have been getting better. My ex wife and I are on friendly terms, and in July she is about to remortgage, which means I should get about £40,000 - which although having a bad credit score I was hoping would help me secure a mortgage to buy my own flat and save me a small fortune in rent. Until now. Today I got a letter from nottingham county court telling me I have a debt of £1550, plus costs with a company called restons solicitors - they are acting on behalf of Cabot who bought the debt from capital one. I called the solicitors, and said can I sort out some payment plan. They said the only thing I can do is pay it off in full with charges. They were not willing to enter any payment plan, and stop the action. I cannot raise the money unless I get a very high rate loan. And I can't risk that. I know lots will say it's only money - but I have just started to see sunshine, and now my only chance of ever owning my own place is fading fast. I'm rambling. Sorry - You have no idea how long this has taken to write - I have deleted pages. I am 49 years old, I know in 6 years noone would want to give me a mortgage. Oh - I'm sorry. When I told them i took the credit out during my worse mental health time the guy really seemed to sound concerned. He kept saying, but you're better now - seemed to be prompting me what to say. I was wondering if any of you can advise me? I'm not trying to get out of paying it at all. I want my life on track - with a future that looks happy. I can probably manage £50.00 per month, but it would be tight. What can i do to get this stopped, or held up so i don't get a CCJ? Is there anything? I really am so sorry to get my point across. thank you all for staying with this and reading to the end.
  9. Hi there Just needed some advice re: the above. This was originally an unauthorised overdraft from Abbey that I was paying off bit by bit Abbey forwarded it to 1st Credit. I sent the CCA letter to 1st credit and in response they sent me a statement but not a signed agreement. Sent them the account in dispute letter and was sent the attached response. Hi I'm self employed, I have filed my return on line and after checking they had received it on my account it is saying pending bank repayment of................................. does this mean they will pay my refund directly into my bank account, its been like this since last Friday. I didn't request a repayment it has automatically done this Thank you sunnydee x
  11. Hello all, Hopefully there's someone out there that can help me make sense of my situation. I suffer from severe anxiety and depression which prevents me, almost completely, from going out or having any social interaction (the last time I left the house was 3 months ago to attend my WCA). I had to move back in with my parents last August because I couldn't manage on my own. I applied for ESA in August 2015 and subsequently scored 6 points at the WCA in October. I applied for mandatory reconsideration which resulted in an additional 6 points (total 12) being awarded. I applied for appeal in Dec 2015 and my ESA payments were reinstated 3 days ago. However, today I received another ESA50. The timing of this seems more than a coincidence and I am unsure of the process that follows. Since I am pending an appeal hearing (I don't have a date yet), what happens if/when I fail the medical again? I can understand the DWP reassessing people who have been accepted for ESA (after a reasonable period of time), but I can't find any instance of a reassessment being carried out prior to an appeal, particularly since it has only been 3 months since my last one. I, like most, have had a pretty rotten experience of the DWP and I can't help but suspect that this reassessment is some backhand tactic. I also find them extremely distressing since being interrogated by someone I don't know in a place outside of my home is an almost guaranteed panic attack. Can anyone tell me if i am just being paranoid, or is there something more sinister at foot. Are they trying to trip me up? If I fail the reassessment, will I still receive ESA payments until my appeal? Many thanks for your time.
  12. Hello, I may need some guidance please. Last Wednesday I was travelling home from work, came off an A road onto a slip road which leads to a roundabout. There was a queue of traffic waiting to enter the roundabout. I joined the queue and was stationary when a vehicle behind me failed to stop and ran into the back of my car with quite some speed. I was propelled forward and almost hit the car in front of me., luckily there was no impact as my car came to a stop before hitting them. The guy who hit me got out of his car and stated he was sorry and accepts full responsibility. He gave me his name and an insurance company but stated he had no ID and no insurance documents on him, he said he didn't need any details from me as he accepted full responsibility. I took a photo of his car and registration plate with my mobile. He apologized and drove off, almost causing a second accident by nearly missing a van that came travelling up the slip road. My car has considerable damage to the back, the bumper is cracked, the rear passenger side wing is coming off, the number plate and number plate light are broken, the boot hatch is dented and I cannot open the boot anymore. I have neck and shoulder injuries and now have got a tinnitus in both ears, the doctor hopes it should settle again over time and is a whiplash type neck injury which can also cause the ringing in both ears. I have TPFT cover on my car and phoned my insurers to start the claim, when I gave them the details of the other car it came back as uninsured, the details he gave me were false. They said they couldn't help me any further but going by the damages described they thought for insurance purpose my car would be a total loss. (10 year old Ford KA). I since got an estimate from a local repair garage for £300.- to fix it though (the same garage I originally bought the car from and the guy said he would do me a deal as I think he felt sorry for me to be honest, so he said he'd do it for £300.-) I also reported it to the police who gave me details of the MIB, I spoke to them and downloaded a claim form which I have filed out and returned today. Ha anybody got some experience what is happening next and what I can expect to be the outcome ?
  13. help! i made a payment to Haven holidays which was my last payment to them of £389, today I logged in to check the account and noticed that they payment is no longer pending!! but been put back in the account. I'm Wondering whats going on?? this was to pay the holiday off, I'm now scared that because this has't left my bank that they will cancel my holiday. Ive logged into Haven and my account says that it is all paid.
  14. Usual suspects Howard Cohen/Robinson Way I have received a letter sub titled as above. Is this the same as Letter before action. The 10 days, are they working days or 10 straight days? Do I send a CPR now, or do I wait until actual court action has started? This is to do with a bank overdraft some time ago. so as I understand that a CCA is not correct. Do I send a SAR letter instead. I believe this is statute barred, but at this stage I do not want to send that letter (there's a good reason for that). Please could someone just confirm the above points, anything else I should be aware of and any complications that overdrafts produce. I do need to act on this fairly quickly, as I don't want to sit on it and waste any preparation time I may need. Thanks
  15. Hello Looking for some help and advice after being suspended from work on Thursday. I work for a rail operator who I best not name just in case but this is the situation, We have had regular checks and audits done at a number of stations that I work at (I'm relief staff and cover an area working in ticket offices) and they have found that some of my non issues (cancelled ticket) are not where they should be from a 2-3 months ago along with some issues involving reprinted season tickets. Work are basically saying due to the potential high value loss of a season ticket and that the cancelled tickets aren't available for checking on the audit there is a trust issue and because I couldn't recall any reason why they would not be in the filing system at the station I was suspended pending further investigation. At the end of the initial meeting on Thursday the last question/comment made was that I could have taken the tickets and sold them on or I could have cancelled tickets and taken the cash and was then asked if I had done that, obviously I said no because I haven't done anything like that but Im left feeling like I've been tarred with a criminal brush Since I started in April 2011 I have done my job in the same way and always completed non issues/ticket exchanges in the same way and now there have been these issues brought up and I've been suspended. Im not sure how I can prove to work that I haven't done anything dishonest and as my manager said she needs to be able to trust me at work (which I fully understand) I don't know how going forward I can prove this, I've got a good track record, always work overtime/rest days and go the extra mile. My only positive thought is that my manager said she knows I am a good worker and seemed genuinely caring and equally upset over what had happened and she said she will try to get it dealt with as quickly as possible. I've been given no notification of suspension or any further communication about it yet and I'm just sitting at home waiting to hear whats happening now, I've contacted my union for advice and they cannot say much yet as they aren't sure what the actual allegations are yet so any advice/help anyone on here could give me would be very much appreciated When I go into the investigation meeting I want to be able to prove that I am a trustworthy and honest person and want them to know that I have played no part in anything going missing or being lost, I have followed the same procedures for the last 16 months and only now has there been some issues raised, does anyone else have anything else they think might help my case other than my clear record so far, this is the first time I have had had any issues come up and trying to get the person to take my word that I am a decent person
  16. Does anyone know from a legal or banking perspective the date I have made payment if I use a debit card over the phone? Is it the date I give the card details or Is it the date the payment shows on my statement? The organisation I am dealing with is not authorised to go in my credit file due to the terms of the loan agreement unless I go into arrears. They are doing their best to make that happen. Am I in arrears if the payment is still 'pending' on the day it is due even if I phoned the day before? Thanks

Hello im aftyer some help and advise I have recently been in court in regards to Halifax taking possession of my property (court date was 24th April) the suspended the repossession on the grounds that payment of my monthly mortgage £412.90 plus an additional £60 towards the arrears which is due to be paid on 28th of everymonth, this is perfectly affordable with us and we have no problems making these payments. For some unknown reason our payment did not clear from our bank account on 28th April even though funds were available, we received no correspondence from our bank advising the payment did not clear and neither did we have any correspondence from Halifax advising they had not received they monthly payment, I found this out only by receiving a letter from Ascent legal advising Halifax had advised them to proceed with enforcing the warrant for possession, I made the payment of £472.90 on 12/05/2014 which is the day I found out the April payment had not been processed, I have spoken with Halifax and advised the situation only to be told that there eviction team/ litigation team would not speak with me until and eviction date had been set. We have no issues what so ever in keeping to the monthly payments plus the extra towards the arrears it is completely affordable to us I am starting to get a little stressed that I will have to go through the whole court process again:| Has anyone got any advise of what I can do ? could I write to the Halifax ? Halifax have confirmed that they have received the payment which was sent yesterday.
  18. Hi I have a CCJ registered against my ltd company, and I want to appeal the 'set aside' decision which went against us, and still can if I act quickly. If I did pay the the amount disputed would the CCJ be removed as it still open to appeal or would the CCJ remain. I hope that it makes sense and I am grateful for all info and advice. JP
  19. Hi, On Saturday night we had an armed robbery at the store I work at. After the robbers had left I called the police. I went back into the office and there was change all over the floor, the loss prevention officer at my company has seen me picking up £3-4 in change and putting it in my pocket. I admitted to this. I have been suspended with full pay until my disciplinary hearing. He said he had called the police and arranged for a meeting on Thursday with them. What is likely to happen now? Should I resign? Am I going to get a criminal record? I've never done anything like this before and my criminal record is currently clean. I think I'm the only person who could have two guns pulled on me and lose my job in the same bloody night.
  20. Hi All My story, One and a half years ago I was interviewed under caution for benefit fraud. Failing to disclosure a change of circumstance that resulted in me obtaining an over payment of benefit. The charge is under the Fraud Act: not disclosing information in order to dishonestly gain. ( solicitor says its hard to prove dishonesty) claim was honest from the outset, under 3 years, I have a son whom I am the sole carer, I am a teacher, I haven't paid anything back) I was between 3 addresses when this happen. Housing officers and social workers filled forms and applications for benefit on my behalf. I disclosure my situation to them always as evident on all the application forms that show addresses whereby I have claimed housing benefit. It lasted under two years totalling £12000 paid into my account. I started university, started working and during that period a total of £50000 entered and withdraw from my account. From student loans, work, bursaries. I have bad money management and I have in total moved house 10 times in the last 5 years my bank statements go to my dad and I usually leave mail at every address I go to. I was 21 with a young baby and absent baby father and getting my affairs in order were not my stronger points. I qualified as a teacher in 2011 and supply taught for a year. July 2012 I had the IUC and the investigator said she will get back to me. One year later July 2913 I received an email stating I had missed a court hearing and a warrant for my arrest will be issued if I don't attend the next court hearing. I had moved address since the IUC. I have opted to go crown court and awaiting trail. Been messed around by warning lists etc and have a fixed date in march. Mean while I have been getting on with my life and looking to apply for teaching positions this September 2014.. 4 questions: What do you think is the likely outcome? If guilty what type of sentenced do you think I will be given? I am applying for teaching jobs and I have completed a CRB. It is clear but will my pending case show up on my Enhanced CRB? Is it relevant enough to a job as a teacher? Thanks any advice will be great. I only seem to see conviction stories online and no acquittal stories regarding benefit fraud. I feel that convicting me is not in the best interest of the people. I am a good teacher and something like this will ruin my career essentially lead back to the benefit system when I am fully reliant in myself apart from £80 child benefit.   21. Hi All I was hoping for some advice. Having purchased a new phone for £599 last September, as well as a new 24 month contract, I noticed that after 11 months a problem with the phone's battery had emerged, whereby the phone would lose all power at around the '10 percent remaining' battery mark. I contacted my mobile phone provider who I also have phone insurance with and the customer services representative performed a diagnostic test on my phone and advised that it was indeed faulty and said she would arrange for a replacement phone to be sent. I was then transferred directly through to the manufacturer without being told I was! The manufacturer offered me three options: Send the phone to them to be looked at and repaired or replaced Arrange for a courier to collect my phone and pass me a new one - a cost for the courier and a desposit would need to be placed on a credit card Visit the manufacturer's store I am registered disabled and am unable to walk properly without experiencing severe pain and discomfort, as well as unsteady on my feet, so obviously mobility is an issue. I sometimes need to be wheeled around. I need my mobile phone in case I should take a tumble indoors and need to contact someone. I am also on ESA, having had to give up my job last year (after I had paid £600 for a phone I would like to add!), so money is an issue and I do not have disposable income. Therefore none of these options were really that viable. I called the mobile phone provider again and explained these points to them and also explained that I had purchased the phone in their store, therefore the contract of sale should be between me and them, not me and the manufacturer. I also reiterated I had valid insurance for the phone. The phone operator told me none of the above mattered and I would HAVE to go through the manufacturer as the phone was less than 12 months old. I would like to add that the insurance terms and conditions state that the mobile phone provider will replace or repair any phone that develops a mechanical of technical fault within the first 36 months under their OWN warranty. Nowhere in the terms and conditions does it indicate I should not be able to get a replacement or repaired phone in this type of scenario. I then contacted the executive office of the mobile phone provider stating the above points and following lack of response, issued them with a letter of intent to take them to court. They finally got back and advised they were not willing to help and stuck to their guns. I subsequently issued small claims proceedings and have today received the phone provider's defence document. In my claim form, I have requested termination of my account as I feel they have breached contract, as well as a refund for the cost of my phone. They state that because the phone is more than six months old they are unwilling to repair or replace the phone, without proof that I have not caused the fault. Nor are they, obviously, willing to reimburse me for the price of the phone or terminate my contract free of charge. What I would like to know is the following: 1) whether there is a different time frame, rather than that of six months for an electrical item that costs £599 to be deemed faulty? 2) If I have any hope in hell in being successful should my day in court come soon! 3) Another piece of evidence to possibly present would be a taped phone conversation with the mobile phone provider today, asking about insurance and whether it would cover me in a very similar scenario than the one above. I asked permission to tape the conversation prior to beginning and it was agreed this was fine so believe the legal ramifications are little. Would this recording or even a transcript of it be permissible in court? 4) Are there any specific clauses in the Sales of Good Act that would benefit my predicament? 5) Are there any other legal Acts I can throw at them, as claimant, excluding the Sales of Good Act? 6) Finally, does anyone know where I can get an iPhone diagnostic test done independently? If the worst comes to the worst, I can get someone to take a day off work to pop it along. I'm based in London. Many thanks in advance.   23. Any help or advice would be greatly appreciated........ a week before Christmas I was suspended pending a disciplinary hearing. I work for a financial brokerage business, and one day I was on my own at work as my colleague was off. I had to take care of some business, and up to did my job to the best of my ability however on a couple of specific parts of the business did not follow a procedure set out. It was not uncommon for this to occur as it can be rectified. The problem started when I suffered a serious computer system problem, this occurred at the point at which I was looking to rectify my procedural short comings. This problem lasted for around 30 mins at in hindsight the worst possible moment. It was at this stage I realised that I would more than likely have to take a loss on such transactions. I had only the day before been told of a payrise as a result of my good performance, so when I encountered this problem I literally froze and panicked. I and my family have experienced a period of huge financial stress over which time I have been on medication for depression, so the payrise was a huge lift, the shock of the incident coupled with my concerns over the payrise led me to sit and stew over this problem for much longer than I should have. I spoke to my colleague over a recorded line to discuss the business and implied there were no problems, but I was still in a period of distress so to speak. I finally rectified the issue before the end of the day so that there was no exposure, but the loss at the end of the day was quite hefty, at around £15k (around 50% of the revenues for the month). I then came clean, but after working one more day, and a couple of days off received a call notifying of the suspension. I have had a fact finding meeting and awaiting a date for a hearing. I know that I could have handled better, and have always admitted to such, but argue the system malfunctioning led to the initial problem, but there is a procedural shortcoming up until that point, something that i would argue and can prove would have been dealt with. The company are accusing me of not following procedure, lying in telling the client of a different transaction than executed (something that has been done by myself and my colleague previously) and misleading the company. The latter which I can offer the excuse of shock and panic. There was no real intent of wrongdoing, but i fear a gross misconduct charge. I will appeal if that is the case, but not sure how effective such will be, i fear they want rid of me so the appeal will just be a process that they have to adhere to. I have been with the company for 21 months so unfair dismissal is not an option.... please help, more than anything just want someone to say, I have some sort of case and hope!!! thx Phil
  24. Hello, I'll keep this as brief as possible... I am currently on 2 weeks suspension from work following an incident that happened on the 19th. I walked out on after a customer was being verbally abusive and falsely accused me of "giving the finger" to her sister. The reason I walked out is that my duty manager seemed to find the incident funny and did not back me up, telling me to grow up. The letter I have received from works says I am suspended for: Allegations of abusive and objectionable behaviour towards customers Leaving the workplace during the duty period without permission I understand I'll receive a second letter telling me when to come in for the actual investigation. TO CUT TO THE CHASE... I wanted to know if I am entitled access to any evidence my duty manager has before the investigation? The reason being that I believe he is manipulating the events to have me unduly disciplined. I know I can appeal any decisions made after the investigation but I want to arm myself as well as possible and nip this in the bud asap. I am also considering writing a letter of events and complaining about my Duty Manager's handling of them to my General Manager or possibly HR but don't know if this is a good idea or if I should wait till after the investigation.   25. Hi everyone, Looking for a bit of advice of opinion about what I am going to put to you. Preferably if there is a fraud investigation or tribunal panel worker as this is more in their league. Obviously a limited amount of speculation can occur but any insight would be most appreciated. I will try and keep it as short as possible. May 7th 2010 I was taken ill into hosp, my hubby had lost his phone whilst working in Amsterdam. He borrowed a phone from a 'steward' on his rig, subsequently I found out he was having an affair. On my birthday 17th May 2010, he left me, saying he needed to sort his head out, in the meantime, I was seriously ill with impending redundancy (31st May 2010) Was optional as he said he would support me. By July 2010 I knew he was for real and not coming back so I went to jobcentre and got signed up for ESA rather than IS due to my health as I found out he had gone on holiday with this woman etc - too much to mention otherwise I would be writing into 2014. After some time my ESA was rejected then I went onto IS, previously to this I sorted the council tax so it was only me and my girls in the house registered. I then started college Sep 2011 and wrote to inform then, I got a letter back asking about course details and this was forwarded onto them. During all the commotion of the split, I was diagnosed with TIA, Depression and I took up drinking to 'help' me. Social Services got involved and my girls were put on the protection register for 6 months due to drink driving charge. During that whole process I tried my damned best to get my hubby back but failed on many ocassion, although we tried when we went on hol together. In that whole time we met twice socially and had that holiday, I served separation order as he introduced this woman to my girls after me asking him not to etc etc. He got his own flat for 6 months in Aug 2010-feb 1011 then gave it up as he was working away in Amsterdam for long periods on courses and working on the rigs. I fell out with family & friends over my contact with him as I required him to take me food shopping for our gilrs and did it online when he was away. A letter arrived for him in Jul 2012 as him to go to an interview and this subsequently led to a IUC for me in the OCt 2012. I since found that I should not have been receiving the IS as I was at college, although I had written to them 3 times by this point, they have no record. I hav had demands of £1982 from council tax, £13600 from CTC and £4600 from DWP. Of course I have written to apply for tribunal as I feel I have done nothing wrong here and on reading the OP they are basically saying he never left me and only taking into account the 6 months he rented, they are basically stating that all I went through was a lie. I didnt seek legal advice before the IUC as I felt I didnt need it, now I realise I should have. I have proof of this affair, relationship from emails I hacked into, I eveidence he took her on hol, bought her things, solicitor letters (which the interviewer tried to tell me was rubbish), social work reports about us splitting, the list is endless. They are saying because we never separated the joint account (was down to me as I knew I could spy if he was buying his tart anything) and I worked in a bank so I knew how much of pain it would be to sort, that we never parted company. I also have Dr letter backing up my claims, Dr letter from my mums Dr as the whole situation made her ill, endless evidence. Sorry for such a long spiel... I just wanted to know what opinion was of my chances in this tribunal. I am aware, due to my bursary of £1000 will be taken into account, Im more concerned about criminal proceedings as my hnd is for business, I got an A for it and am going to uni and feel there is no point in continuing if I am stuffed as most jobs require no fraud criminal convictions. I have also been diagnosed type 1 diabetic since then and the stress is making me ill as I cannot stablise my blood sugars. ANY HELP much appreciated MissyNA xxx
