  1. I overdid my stay in Lidle as I could not decide over a walllnut loaf or a graian loaf (honest). Have had a letter come in the post saying I owe £45 (£90 if not paid in 14 days). I understand a lot of these private car park firms have little legal legs to stand on, can I just tell them to shew or is there a small amount I can pay, I heard if there is an hourly rate they can legally only charge you per that hour that you stayed.   2. Hi all, I need some help. The defendant has been issued with a £100 'Parking Charge' by Parking Eye. The alleged offence occurred during the day time on a weekend, and was apparently brought to the attention of the plaintiff by ANPR cameras recording time-stamped photos with entry+exit times of the vehicle registered to the defendant. The plaintiff claims that the defendant spent just over 30 minutes in total at the car park. Answers to the FAQ thread are as follows: 1 Date of the infringement: Late January 2019. 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 5 days after the date of the alleged infringement 3 Date received 11 days after the date of the alleged infringement. 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [y/n?] YES. 5 Is there any photographic evidence of the event? YES, see above. 6 Have you appealed? {y/n?] post up your appeal] Defendant has not entered any correspondence with plaintiff or any 3rd party appeals company. Have you had a response? My query is - should defendant appeal via POPLA, or contest the charge with ParkingEye? Some guidance would be greatly appreciated, based on the answer to above as well as potential defense points to the claim, I can write a draft letter for the defendant and post up here for critique before issuing.
  3. Hi, I have received a Civil Parking Charge Notice from Athena ANPR Ltd for exceeding the parking time limit in a Lidl car park in Barnsley. I registered my VRN in the store to validate my stay - I did not realise there was a one hour limit. There are signs around the car park but I did not park near one of them and I did not read them. The signs were not big enough to be read from a distance. How do I proceed with this?
  4. Advice please - I parked in NCP Barnet on 27.12.18. No barriers and am not local, but local friend I was meeting assured me it was pay to park...….thought I'd take a photo of the location number, finally found a machine - weren't any notices, and then tried to pay at the machine. Was as number plate one and despite several attempts could only pay £1.50 ……..then received PCN to keeper last week. Anything I can do - I think I prob underpaid by £1, and I know its my fault, but £60 seems a bit steep! If you are unsure, please check HERE- BPA If you have received any other correspondence, please mention it here I have not received any other information but the letter does say that if payment is recieved within 14 days then I could pay £60 instead of th £100 they intend to charge. The letter also says that if I want to appeal I must do so within 14 days.

May i just add a very important factor on how WE all teach these unethical business a lesson that will make then sit up and take note… Business, in particular hotels such as Holiday Inn operate in a highly completive market place where even small adjustments to their statistics have significant rippled effects on their margins. So much so they employ technicians to monitor downward curves on online statics If WE collectively spent just 2 minutes posting a 1 star NEGATIVE GOOGLE review you will drive their ratings down faster then their CEO could say “get those ParkingEye systems torn down, its ruining our online reputation” Simply voice your disgust at their “unethical and immoral parking charge system”, preying on those of us who have been paying customers such as Lauren1994. Just 2 minutes, on Google and instantly reduce their ratings. EVERYONE looking at booking a hotel checks ratings right ! If you want to see this in action, see the start of a ripple effect at Holiday Inn Winchester whom since January 2020 started with 4.5 rating and then installed their new ParkingEye ARNP system. If you have more then 2 minutes then post across all their review systems to share with others your genuine experiences upon parking at their hotel, paying and then being charged days later and in your own words your thoughts on this. This excellent website has a high volume of viewers, inparticular this post, offering us the oppurtunity to voice in volume - so don’t forget to donate to this excellent website as well
  6. Hi, i need some advise please. I too received a letter from PE with regards to parking on the Town Quay in October 2019. I didn’t really understand their payment system - do I pay before or after - so I asked someone who worked there, they said I could pay either way. So, I paid when I got back, entered my vehicle number - which didn’t say how long I had been there - the payment layout was difficult to understand, I think I had underpaid by £2, I paid £6.50. What do I do? I can’t afford the £60, do I write to them, do I write to them with a cheque with the outstanding £2. I don’t want to leave this as it’s affecting my mental health and stress, already had a sleepless night thinking about it. thank you for reading this

It says on this PCN that any appeals would be handled by the IAS There are two official bodies, the BPA and the IAS.   8. I got a NTK through the post today. Attached is the NTK and sat view of the layout. The entrance ANPR camera is before any car park signs, It does not say whether the driver was parked in the actual car park or on the forecourt.   9. Hi, I got slapped with pretty much the same PCN at the same car park. My wife was driving the car and she did pay the £2.50 after she arrived. However as we only got the PCN 22 days after the day she parked there the ticket is long gone. The date of the incident was the 6th of December and we got the PCN on the 28th of December. I have seen from the signs posted here that they say you don't need to display the ticket in the car but that you should keep it as a proof (who keeps their tickets?). The PCN claims we breached the 'contract' by parking without payment and as evidence they just show that the car entered and left the car park. That is only evidence that the car parked there, not that it wasn't paid for. As we don't have the ticket anymore we can't tell when the ticket was issued or whether the registration number was entered correctly (always a change of typing it wrong). In my opinion they would need to prove that you didn't pay. So they would need to show an audit trail of tickets issued during the period and list which tickets that were issued do not match any cars that entered the car park. If e.g. 1000 cars parked during the day and 1000 tickets were issued they can't really claim that someone did not pay. The Levenshtein distance (how many letters you need to change to go from one string to another, E.g. Hello to Hillo would be a distance of 1 as you have to change one letter) between the reg numbers entered on the ticket machine and the reg numbers of the ANPR system would show straight away if some reg number had a typo. If a type was the cause for this PCN then another question is if the system knows at any time which cars are in the car park, why does the parking ticket machine not reject numbers that are not in the car park? So what is the best way forward. I've read that you should not appeal. Why? I fully understand that they will reject the appeal as this is their business model but can't you use the appeal to put them on notice already? I am not a lawyer but I would request the following: -Proof that the parking charge was not payed -Ask them to reserve the CCTV footage (if they have) of the ticket machine for future use in the court of law as that would show my wife making the payment (making clear that you won't be bullied) -Provide a list of tickets issued during the period which do not match any of the numbers of the ANPR system and their Levenshtein to our registration number. -Audit trail of the ticket machines. Are there any gaps in the ticket issued? My wife has her father as a witness that she paid and there she helped an elderly couple at the ticket machine (but we don't know them). So what do you suggest we do? Wait until they write they are going to court? What would the worst case be, it goes to court and you have to pay. How much would that be? I know that that is what they bank on that people are scared of going to court and lose especially now that they won a few (or at least one) cases in court. PCN attached Signs (thanks to User999 for getting all those pictures) One of the signs is saying: "Please ensure you enter the full and correct vehicle registration number of the vehicle you've parked today. Failure to do so may result in the issue of a Parking Charge Notice (PCN)"

Donot know the time of entry so unsure if/how long the time period was exceeded Wasnot the driver (my wife was) They are sayingpayment is due 14 days of this notice, so 11 February which doesn't give memuch time to talk to them (no email address so only phone or letter). The previousexample with this company advice was do not respond and they will give up. Thisseems to have been the case and he had stopped getting letters 7 months lateralthough no further updates since to know whether this is still the case. The driver was in the ten pin bowling alley, which the car park is outside, with son for his birthday. There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require ALL photos taken and an explanation of the allegation and your evidence, i.e.: - If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it. - If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner. If you fail to evidence the actual grace period that applies at this site or suggest that only one period applies, this will be disregarded as an attempt to mislead. In the absence of evidence, it will be reasonably taken to be a minimum of twenty minutes (ten on arrival and ten after parking time) in accordance with the official BPA article by Kelvin Reynolds about 'observation periods' on arrival being additional and separate to a 'grace period' at the end. - in all cases, you must include a close up actual photograph of the sign you contend was at the location on the material date. Hi, I received a PCN it has a date and time in but no exit time I was there around 10 mins I did not leave the car, Kids went in to the macdonlds there to collect take away You could always park there previously The sign upon entering is above head height when I sat in my car thats when I became aware of a sign; if parked there I would be liable for a charge, I left straight away I will try to take photos but the place is some distance away.   15. Hi, I've read through a lot of posts, but can't find one that directly deals with my issue. Please find attached the notice & pics sent to me. I live in Scotland, so can't get any pics of any signage before the 14 days. I'm due to go back there and will get some photos of the signage later, but I can categorically say that the signage is woefully inadequate, as you can only see it at the entrance from one direction, this is going to be so much fun! (hopefully?)   17. Hello I'm hoping you can help me. I received a NTK from NCP using ANPR for parking longer than paid for. Now the issue is that driver (not me) brought a ticket for 24hr parking costing £2.50 and i have a photo of this. The car park in question is protected by ANPR and the driver brought the ticket at 17:07 before leaving the car park 17:16. in my simple world there is nothing to worry about as we should win the appeal ?   20. Hi, I have today received a Claim Form from BW legal. The Particulars of Claim read as follows: 1.The Claimant's Claim is for the sum of £100.00 being monies due from the Defendant to the Claimant in respect of a Parking Charge Notice (PCN) issued on 01/04/2016 (Issue Date) at 13:38:43 at Smyth Street - Wakefield Anpr Vcs Scheme Std (60-100). 2.The PCN relates to xxx under registration xxx. The terms of the PCN allowed the Defendant 28 days from the Issue Date to pay the PCN, but the defendant failed to do so. Despite demand being made the Defendant has failed to settle their outstanding liability. 3.The Claim also includes Statutory Interest pursuant to section 69 of the County Courts act 1984 at a rate of 8% per annum a daily rate of 0.02 from 01/04/2016 to 06/01/2018 being an amount of £12.92. 4The Claimant also claims £60.00 contractual costs pursuant to PCN Terms and Conditions. The total amount of the claim is for £100 PCN + £60.00 legal costs + £12.92 interest plus £25.00 court fee plus £50.00 Legal representative's cost giving a total of £247.92. For a bit of history, I first received a PCN shortly after the above issue date, looked into it, and opted to ignore it. I have received several more since and opted to ignore them all. I have now, today, received this Claim Form. I have yet to take any action. What should my first course of action be? Should I respond to the claim online (as stated on the form, at moneyclaim.gov.uk?). What should I then do upon doing this? Please advise as soon as possible. Thank you in advance, Card_Owner.

If you are unsure, please check HERE BPA I went to talk with the reception at Surbiton Health Centre, and they were not helpful. I remember the console to register the Immatriculation number was not working on one of the days I had to go there, but I am not sure it was on the 08/11/2017. The people at the reception did not want to confirm anything and went as far as to say that they have nothing to do with the parking company.
  22. Hi all, I'm trying resolve this issue with PCN I have received recently from Athena ANPR Ltd for overstay at Lidl. The overstay was 14 min. 35 sec. Arrived at 09:43:43 and left 11:28:18 = duration 1:44:35 Shops opens from 10AM Sunday. Short story, it was Sunday just before 10AM and I saw ppl outside Lidl so I thought it might be open. Parked my car and there was just a queue in front of Lidl..., so went for a walk, as this was my first stay in Mablethorpe. Off course I did forget to take my swimming shorts with me, so spend bit longer in Lidl, looking for shorts. Few days later got this PCN. I think this isn't fair as if you look at the time the shop opens and the time I have left the parking is just within 90 minutes. Normally I don't spend this much time inside the shop. Do you think I have a chance to get this PCN canceled ? Where exactly [carpark name and town] LIDL Mablethorpe - High Street, Mablethorpe LN12 1EH Appeals Body says the IPC. The occupants of the vehicle did shop in LIDL on the said day.   23. Hi Received letter from DRP (Debt Recovery Plus) to pay £160 for unpaid PCN from 14.4.18. I've never received a PCN from UK Car Park Management Ltd before, so this is the 1st time I've seen anything! Just called DRP to get more info - they have photos, say I exceeded maximum stay (or may not have paid). I remember being surprised on the day that it has changed at Brighton Met College to the new system, lots of people that day had confusion, couldn't pay by phone (there's no cash option) or was told carpark full, which it clearly wasn't. I have phone record on that day, but that's all but think we may have had similar situation where it said full and we put notice in the windscreen to say this. They asked if I moved recently - I did in Oct, but did update my address with DVLA, etc. Again this is the 1st I'm hearing from them. They just said on the phone I have no right to appeal or dispute, to pay £160 or further action! Any advice would be appreciated - should I ignore, should I contact UK Car Park Management directly instead...? Many thanks,

Where exactly [carpark name and town] Havens Bank Retail Park, Exeter For either option, does it say which appeals body they operate under.   25. Hi whilst getting advice about a different ticket, my husband now received one from Smart parking. We were away for a weekend somewhere we don't know and parked outside a bowling alley. Didn't even occur to us we'd have to pay (even in London we don't pay in such locations!) It was pouring we rushed inside without looking at notices. Is this another dodgy private company or not? As we are going away this Thurs need to deal with it asap. Many thanks.
