Can anyone help me with filing an online response to a claim form I received via Shulmans for a Southern Water debt. I realise I will have something to pay, but they are claiming from 09/07/2007 and I only moved into the property in the November 2007. In addition, am I right in thinking that that over 6 years is subject to the statute of limitations and can therefore not be claimed for. I completed an acknowledgment form within the 14 days, but I’m now feeling anxious that my online response covers everything correctly to give me the best outcome. ​Help needed

Hi https://www.consumeractiongroup.co.uk/forum/showthread.php?491828-Southern-Water-UKsearchLTD-Shulmans-court-claim-urgent-help-needed-(past-33-days) We are in exactly the same situation having just received a Letter Before Action Letter from Shulmans/UK Search/ Southern Water for alleged bills between 2007 and 2015. This letter is addressed to my partner and his ex who split in 2015. They claim £3343 is owed but this is the first we know about it. Having read through this thread, I am a little confused as the info appears contradictory.... Are we sending the CAG pack to Southern Water, Shulmans or UK Search in the first instance please?
  3. Hi everyone, I moved into a rented house June 2018. Recently I received my first water bill, and it shows me that my average use was around 600 litres of water a day. So the amount to pay is £186 (for 2 months - June and July!!)!! That is a complete nonsense - only two people live in the house, and we don't use water more, then anyone else - we never leave the taps open when not necessary, never take shower more than literally 3-4 minutes. But here comes this bill... Thames Water acknowledges that the amount of water consumption is really unusual . They suggest me to contact some "Homeserve", and sent me a leak allowance form to fill. Well, I reported the matter to the agency i'm renting the house from. But it looks like they are a bit reluctant to sort it out. They didn't say "no", but more than a week passed since i reported the problem, and they still didn't arrange anything to establish if it is an external or internal leak.
  4. Didn't know where to post this - please move if there is a more appropriate section I was without mains water for a couple of weeks whilst building works were taking place. For drinking water, tea, coffee etc I purchased huge amounts of Buxton Bottled water. I would normally use a water filter for tap water because of the lime scale - but didn't for the bottled water - within a week the scale in the kettle was so thick, it took 3 sachets of descaler to remove it ! I thought bottle water was filtered in some way, is this not so ?
  5. have a unpaid debt with anglian water. ccj granted march 2013 for a debt of £1,341,98. agreed with them to pay debt off at £5 per month. after a financial income check incomings outgoings. we applied to pay this debt by direct debit payment. they said it could not be done. over the period of time we reduced this debt to about £300. for some reason they cancelled the agreement and enforced this with the high court enforcement group who visited me today. informing me they are collecting a debt of £2,041.15 for anglian water. rather annoyed to find that anglian water never told me of there intentions or giving me a chance to put my case to the court. where is the common sense the debt reducing. then they treble the debt to be honest struggle paying this amount. is the court system just got no sense before they decide what actions they take on people. any advice available here please . contacted anglian water waiting for call back.

Made an online application for Southern Waters NewStart Scheme (was ignored). Tried to negiate a payment plan with Southern Water's legal department but they say their is nothing they can do as the debt as been passed on to UK Search Limited.
  7. Hello again CAG, it's been too long! You'll be pleased to hear (I hope) that my own debt problems are now behind me, however I'm now looking for some help for my wife. She recently received a letter from Moorcroft regarding a Thames Water debt. Moorcroft state the amount outstanding is £692.48, and that they have asked their local representative to call on the 28th November. I would normally fire off a CCA request, however, as I understand it, Utility debts aren't covered by the CCA. What would you lovely CAGers recommend as my next step? We've talked about sorting her debts and she also has a mobile phone debt (currently with Resolvecall) and a Sky TV debt (which has allegedly been sold to Fresh Start Vanquis Bank). I would appreciate any advice you have to offer in dealing with these DCA's, as I have only ever dealt with debts that are covered by the CCA. Thank you in advance, regards, Wally.
  8. I have YW chasing me for money. The amount which is just over £600 for 11 months. To my knowledge water has never been this expensive. Can someone please shed light on this. I have not paid as the first bill I disputed, and it has just been going on and on. Any help would be appreciated.
  9. I received a letter, which was posted through my door last Wednesday. It was for a water bill which was 1300, but the amount I am to pay is 2300. I have never received any communication from the Enforcement Agents, so I am wondering how they can add £1000 fee to my original bill. Also I have spoken to them and explained that I am a single mum with 4 children, I have just been through a marriage break up and have had 6 months off sick, due to this. The officer agreed that he would see me on Monday and we I could set up a repayment plan, after he had done an expenditure form. Now I am assuming he will be expecting to enter my home, but I have read and heard that I shouldn't allow him in, is this the case. I also need to add that my ex has left me with a lot of debt and I am unable to get any response from him
  10. Printed off my credit report last month (Experian) and had the epic 'score' of 580.... Experian emailed me today to say there had been a change on my report. Logged on to see that Southern Water had added a default to the report with a default date of June 2016, no great shakes to be fair because it improved my 'credit' score to 635!!! However, I've not, nor ever have I, received a default notice? What is the MO for these clowns? And why are Experian shockingly inept at processing personal data accurately? Leave it two years for a default to appear on a credit file?
  11. Had a new water meter fitted outside my property on the pavement 18 June 18. Water pipe to the house sprung a leak. Confirmed by Portsmouth Water board as being before the internal stop cock. Now they want me to pay for repairs even though there was no leak before fitting.

  13. please can some one help me I've checked my credit report today and there is a default notice on my report from welsh water dated 13-1-16 for £2602 the debt in question is from a previous address after a phone call to welsh water its due between 25-2-14 to 12-2-18 which is today. i MOVED out of this address august 2015 my husband set up a new water bill for the new address but as he called he did it in his name. welsh water are refusing to accept that i am not liable for this debt, they said as i didn't tell them i had moved the correct way then I'm liable for the whole amount over the last 4 yrs up to today when they "closed the account" i told them i had lots of proof that i moved house council tax bills rent agreement bank statements etc. they said it doesnt matter they kept saying I'm liable i didn't receive any post letters defaults as i wasn't living there and wasn't aware i had a account with them at the old address the old landlord has agreed to write a statement saying when i moved out and the girl who currently lives there has never paid a water bill.. im lost as what to do. the debt isn't mine but welsh water INSIST it is.

  15. Hi all, We received a judgement from the county court for the reposession of our property if we dont pay the judgement debt of £2,450 and costs of £1,450 for an outstanding Anglian Water debt. This despite us having a arrangement direct with AWS to pay £50 monthly on the current balance. The judgement applies to 2 x charges against the property made by AWS which went to court. Is it possible to defend against this judgement at such a late stage? Judgement was made on 25th Jan giving us 28 days to deliver possession of the property to AWS.

I own a pub last year got hammered with rate rises which has had a pretty rough impact on the business.... even though they aren't yet at the peak of the new ones the amount on rent and rates leaves cashflow very tight. I've had Engage services contact me for a debt of just over a grand they've refused any payment plan saying they intend to disconnect. The account is a business account, however the pub is downstairs and we live above it with 2 young children there too. I know residential addresses cannot be cutoff but business can be but we only have one source of water into the building which serves both upstairs and downstairs so not sure where I stand on the disconnect issue. Any help appreciated here. thanks.
  17. Can any Southwest Water customer legally be issued a debt demand and then be taken straight to Court for a CCJ with no defence ? Southwest Water debt letters and their CCJs again, they seem to be the bane of people's lives. Hi, to save starting a new thread I'll use this for Southwest Water "debt", which looks to be a Southwest Water Christmas [problem] . An elderly member of my family lives in a retirement complex, and received a demand for a Southwest Water debt, with a County Court claim (leading to a CCJ) just before Christmas 2017 (dirty trick really, there was no time to defend it). She's usually very good but she's somehow upset these 'people'. It seems she received a Southwest Water demand letter for over £200 which apparently was for the year. I know she's always paid her bill at the Post Office, so the SWW demand and the resultant CCJ are a mystery. Today the Court letter came and she's now got a CCJ for six years; obviously she admitted the "debt" either to save herself trouble or out of some sense of duty. The same trick was played on a neighbour last year, just before Christmas. My conclusion is to beware.

  19. HI All Many years ago I moved into a rented property, I rang Anglian Water and in formed them I was the new tenant and I was going to be paying the bills. I received bills every quarter which I paid. 3 years later I moved out and phoned Anglian Water again to make them aware of this and the lady on the phone said you moved out 3 years ago and we have been charging a standing charge and you owe us £1800> I explained that I didn't have that kind of money and I would have to pay it in instalments which they agreed to £52 a month. I have now finally managed to get a deposit together and applied for a mortgage and was declined. on checking my credit file I have 2 defaults and I am 6 payments behind then up to date and then 6 payments behind again for the last 2 years. I have worked out that they have been taking the majority of my monthly payment to clear the debt and not the current bills as promised. I am down to around £300 in arrears that get cleared every 6 months then when the new bill comes the put me 6 months in arrears again. apart from Anglian water I have a near perfect record. Is there any solution to getting these corrected or Adjusted, the mortgage advisor said I might have to wait another 2 years to re-apply. please,please help with whatever info you can thanks in Advance.
  20. To quote from Thames Water on their Assessed Household Charge Now I was assessed in late 2008 and placed in band 1 and have been billed band 1 ever since. Only recently did I discover that the single rate also exists so have applied for it and been accepted. Now luckily I have a copy of my original meter assessment form (completed and signed on the day of my assessment) which states on it 1 bed 1 person.......... I can't remember a bill or leaflet that advertised that they had brought in a lower rate I was eligible for or I would have applied for it. So the question is since they had the information that I was eligible and failed to adequately advertise the change to me........ Would this be worth pursuing? I know with benefits etc that them having the information but not applying that to future changes is an easy win at appeal but what about this scenario with Thames Water? It could mean a refund of around £700
  21. Hi, I purchased a hot water cylinder back in march and it has developed a leak. I contacted the manufacturer and I have been told that I need to return it to the retailer and they will send it to the manufacturer. I have also been told I will need to pay for a replacement while the leaking cylinder is being checked for faults, if a fault is found I will get a refund back to me. I'm not very happy about having to pay for another while I wait for them to decide if there is even a fault on the leaking one. I would have expected someone from the manufacturer to come and inspect it. Does anyone have any advice as to what rights I have regarding this situation? Thanks
  22. Hi, ive had a CCJ claim form in the post recently-ish for a roughly £1500 dept to Southern Water. On doing some research i came across the Water Direct scheme which would allow them to take the debt and future costs direct from my benefits which seems ideal for me. I suffer pretty badly with anxiety so even tho a debt like this SHOULD be a priority its very easy for me to completely ignore things like this while off fixating on anxiety issues for months on end. i just contacted Southern Water and they were pretty good and helpful but it seems they could only help me sort out future payments through the scheme as UK Search have the debt. Should that have appeared on the court forms as the forms only have Southern Waters details and there is no mention of UK Search. Thought it would be best to post up on here first for some general tips before approaching UK Search as i've never dealt with a collection agency before. Ideally id like to just pay through the Water Direct scheme again but not sure if that's something i can do with them (Southern Water said possibly). Should i be haggling with them to write off as much debt as possible too? If i ignore the CCJ are they likely to get Bailiffs involved? Thanks for all and any advice given.
  23. Sorry for the long post: I have been busy looking for ways to keep as much money as I can in MY pocket. By this I mean I always pay my bills on time and often in credit. I wanted to save money on my water rates and looked in to getting my supply from the water companies directly. Currently my bill is £10.35pw. Not a lot you may think! But this is paying the Council directly as they get a discount for being a huge customer. They appear not to pass this saving on to their tenants.... The interesting point on this matter is that you will be paying a share of other peoples debts and voids. This is explained within the case listed below. Let me explain. 1st of all you need to find out if your LA is overcharging you, how you may ask. This is easy to find out by using a tool most water companies use to decide what your bill could be if on a metered supply. Will you save money? Umm a very good question to ask. Depending on where you live and whom is supplying your area you will need to find this for yourselves. In my area this is Essex and Suffolk water. They have a tool you can fill in and it will give you what you could pay if you changed to a meter. I did this and found out that I could potentially save upwards of over £300pa. A huge saving by any standards. My savings is based on the fact I do not have a bath and a single occupant and that I have a wet room. So I would save by switching supplier and going directly to them and not my LA. Now the interesting part of my post: There has recently been several important cases heard including a hearing at the High Court. I made this information known to my LA and they are already beginning to filter out letters to their tenants. I am what is known as a block voice for my estate and asked if I could get my supply metered and at a reduced rate from the main suppliers directly. their response was a resounding NO! But then I linked them to these cases above and they had a change of mind. If it turns out that residents may have been overcharged, then they may be able to argue a refund against the different prices you had to pay. This I am currently looking in to and will update as and when anything comes to light. There is so much more to this issue but would make the initial read far to long so have just given basic information this far. What are your thoughts on this subject please?   24. Id really appreciate some help on this, I always pay my bills and I'm annoyed I'm getting chased for this. The Problem Me and a room mate lived in a 2 bedroom flat, arrangements were made by a student only letting agency on behalf of the landlord. Before signing we were told we had each got £8 a week allowance for gas/elec/water, but that the landlord would be handling the water bills. A few weeks ago I got a letter from a debt collection agency saying I owe the water company for the property £260. I didn't respond to any letters from the water company because I haven't lived at the address for a year now and I wasn't expecting any letters in the first place. For some reason its addressed to me only, not me and my my room mate. I rung them up instantly and explained how the bill wasn't my responsibility (I maybe shouldn't of done this, this is my first time ever dealing with this sort of thing I always pay my bills), they put the case on hold for 14 days whilst they investigate, I rung up the letting agent and they emailed me a copy of the agreement we signed for the property, although they said they no longer have a signed copy, me or my roommate also do not have a signed copy, I kept it for months and just got rid of it recently as I thought i wouldn't need it. I sent them the unsigned version, they said it wasn't enough. I went to the lettings agency and got them to provide a signed letter that states that the unsigned contract I had shown them was in place during the dates they provided and that it was the landlords responsibility (attached to this post), they replied saying that it is still not good enough and that I still needed to pay. They are constantly emailing me, I emailed back asking for an original invoice of the water bill addressed to me (Someones advice, I was sure they wouldn't have it as I never agreed to pay for water or expected one whilst living there) and I received an invoice today in the mail addressed to me. According to the invoice I owe Northumbrian water £160 however the agency is saying I need to pay them £260. More information: I also just noticed the letter the lettings has provided had the incorrect dates (16/17 instead of 15/16) on it which don't line up with those that the debt collectors have provided (when they should), I've emailed asking for a corrected version. Me and my room mate are still friends, if needed he was willing to still split the cost of the bill with me, id rather not have to do anything to jeopardise our friendship The invoice and letters are solely addressed to me for some reason I've done a credit check and this hasn't affected my credit score The dates provided by the credit agency for the water and the dates we lived there do line up I don't have any contact information for the landlord Any help will be greatly received, I will be monitoring and replying to this thread.
  25. Have had letter from them to state in future they are switching to 6 monthly billing instead of quarterly. No doubt there will be a large range of those who won't be able to pay - unless you go with their preferred method of payment, Direct Debit.
