My partners car was stationary in a car park on 06/01/2017. There is a fee payable of 50p for 1 hours parking. The driver of the car went to the machine, realised they didn't have change for it, and returned to the car. The car left. The Reg keeper wasn't driving. When they got back to the car, a plastic envelope with a piece of printed cardboard was inside with the name MyParkingCharge.co.uk on. It has a serial number on it and a date only, hand written. It has no offence date, time, day, location, penalty details, appeal details or registration number of the car. As far as I can see, reading the rules - PoFA 2012, this is an invalid NTD. The date on this card was 06/01/2017. On 19/01/2017 my partner as the Reg Keeper, has received a Notice to Keeper (NTK) letter from Excel Parking. This has all the day, date, time, location car registration and contravention details. The issue date of the NTK is 13/01/2017, but was only received on 19/01/2017. The NTK doesn't mention PoFA act. It states the appeal services is IAS, and Excel are a member of the International Parking Community - IPC. The NTK has no ANPR information or pictures of the car or contravention. I am composing an email to DVLA for the intentional abuse of the PoFA rules Excel and the DVLAs breach. As the NTD is flawed (in my opinion) approaching DVLA is improper and the issuing of the NTK within 28 days means the Reg Keeper is not liable, only the driver. Any thought for suggestion on how to proceed would be gratefully received. NOTE. There is no ANPR on this car Park. -
My dad bought a used Peugeot 3008 from a main dealer. It had low mileage. He paid just under £7000 for it. The car came with a 3 month warranty. My dad has done around 600 miles in the car since he bought it. The warranty had expired only 2 weeks earlier. He took a friend to hospital which was a 200 mile round trip. On the way there the car suddenly lost all power and went into limp mode. AA came and said something was wrong with the injectors and he couldn't fix it. AA had to tow my dads car home. My Dad took the car back to the dealer. They said some of the injectors had burned out and they replaced all 4 of them. My dad was without his car for a week and when he collected it they charged him £360. Is this right ?? I know the warranty had only just expired, but having spent £7000 why should he be expected to then have to fork out £360 for a major fault. I don't think I'm being unreasonable, I would understand if the warranty had expired by several months. I'm trying to find out if my Dad has any grounds to recover the £360 from the dealer. Any advice greatly appreciated. -
Hi all, I wonder if you can help me. My partner and I had to rush our son into queens hospital on 02.02.17 on doctors advice as he had quite a severe reaction to antibiotics and needed to see a Paeds speciality doctor. we arrived at the hospital and found there were no disabled spaces outside - infact there were no spaces outside available at all initally. We drove around past A&E towards the Maternity car park where someone was leaving a space - which are marked as normal bays. We have parked in these spaces before and asked site security (actual queens security) if we could park there with a Blue badge and was told we could. We come out of A&E to find a notice stuck to the windowscreen of the car for not displaying a pay and display ticket. We did not see any signs where the pay and display are, there are signs on the other side of the car park on posts that say "Blue badge holders must Pay and Display if parked in non disabled bays" these are above the usual tariff boards so are high and not very noticeable. BUT are NOT along the pay and display bays... . they are on the other side where the actual disabled bays are, so can not be seen. do you see what I mean above, they have the signs above disabled bays but the bays on the left of the picture below are pay and display (as im now aware) do not have any signage at all. -
Hi what a pain. I arrived from Yorkshire early morning to check on my friends house in London, They are on holiday. He left me 30 day passes to park in permitted Zones outside the house street. When I arrived, I stuck one in my car - an one day all zone pass. 7:30am. About an hour later I saw a tow lorry outside about to lift my car. I went outside and said I have a pass and this is the house I'm staying in. Apparently I didnt read a sign they stuck up a few days ago? who knows. It said Parking prohibited on dates 30th april (today) due to footway reconstruction on both sides of road from house number # to # including my mates door number! They said just move your car 2 houses up and you're fine cos you have an all zone permit..but dont forget to pay the fine too:mad2:. My mates car was fined and lifted to a new spot too..i couldnt move his because it wont start..suffice to say they went on a rampage and fined every other car on the street. Can i appeal and what do i write in the letter? Thank you. Jaws -
Careparking where: Whitefield Metrolink Free carpark , Bury new rd , Whitefield, Manchester. (behind the station) Hi I hope you can all help me with this query on behalf of my father who is 80 years old. Attached are two photographs of my father's car parked clearly in a disabled bay but slightly too far to the right hand side. He had to park this way because on arrival the original car in the left-hand bay was parked at an angle and was impeding into the disabled bay, forcing him to part to the right hand side. He correctly displayed his disabled badge. My mother needs to have a full door opening access as a passenger and she is also 83 years old and is not very mobile. She was the passenger so he had to have space for her to get out. On returning to the car sometime later the original car had been replaced with the one in the photograph and he had a parking ticket for failing to park within the designated bay. He appealed to the parking company on the grounds that he had not impeded any other vehicles or prevented another vehicle parking in another bay and also mentioned that the car adjacent to the left HS has caused him to have to move over and that the car had been replaced since his return. As you can quite clearly see from the photographs there is plenty of room to the right hand side and the parking bay disabled chevrons can clearly be seen. I presume this is to allow access for a door to be opened fully for example, wheelchair access. As typically expected the parking company denied the appeal, ignored his explanation totally and sent him a popla code to start the next process to appeal to Popla. I have used this site previously with great success and really appreciate the knowledge that some of you on here have. However whilst he's not denying parking over the bay line, they're are circumstances that forced him to use this bay as others were available either. I am unsure of the correct argument to use with popla as clearly he is not impeding any other drivers which is the reason I would expect for parking wholly inside a bay. Hi My son was pulled over for speeding. The police said that he was doing 55mph in a 30mph limit so would be referred to court. My son is adamant that he was not doing 55mph inside. The police statement says they were standing approximately 300m inside the 30mph zone. We have measured where they said they were standing and it is only 242 metres inside the zone. They have sent a photo of the reading on the hand held device - besides the mph it also says 248.2 m which we assume is how far the reader was from the car when zapped? which would mean my son was outside of the 30mph when zapped. Should he plead not guilty? He is within 2 years of taking his test so if he is given 6 points we think he automatically loses his licence? Thanks in advance -
Sick and elderly have to wait outside in all weather in the cold for up to an hour before a GP surgery opens - just to get an appointment. Patients are said to start queuing at around 7am every day, although the surgery doesn’t open its doors until 8.00am. What if you are elderly and living on your own? You can’t expect them to come and queue. It’s disgusting. There are lots of old people standing in the freezing cold in the middle of winter. The system needs to change. There are queues every morning. The surgery should open up its doors earlier and have a ticket system, whereby the surgery doors open early to let them inside that way Sick and elderly are not waiting in the cold. The weather is only going to get colder and colder, please help me draft up a complaint to the surgery to get them to change their ways. -
I got in a convo with a potential buyer of a product after a number of messages we decided to take the sale outside of ebay, it's for about £xxx (hundreds)... It's a little naughty I know and the safeguards are here for a reason but that is not my point. He has over 3000 pos reviews and I myself am genuine. He wants to send money via paypal frineds and family for £xxx. Then I box up goods and post. The worry is he could get the goods and dispute it and get money back.. Should I ask him for some paper work or a signed document that concretes things.. They are records you see, very rare ones. So anything could happen.

I know a little bit about the Sale of Goods Act and have found out that it has since been replaced by the Consumer Rights Act. We purchased a Smart TV from Currys PC World in December 2013 for £550. Over the last few weeks it has started to develop a fault where towards one corner of the TV (top edge towards the right) there is a foggy dark patch. This is mostly visible when there is a white background. My questions are therefore: 1. As the TV is now 3 years 8 months old is this too long to expect to be able to get it repaired/replaced via the Consumer Rights Act ? - How long would be 'reasonable' in terms of expecting a TV to last ? 2. The TV has been looked after, hasn't had any damage to it, knocks or drops or anything similar so I assume the fault has been caused by a faulty component. It has been a few years since I have had to claim for anything like this and although I have previously been successful, I'm not sure whether I am expecting too much given the age of the TV. Any comments and/or advice would really be appreciated. Thanks in advance, -
Hello Guys, I am looking for advice on best place to start with my issue. I have 2 years 9 month old Bosch washing machine purchased from online retailer washtech.co.uk which suddenly developed sevaral cracks in the outside plastic drum. Washing machine was working ok for a first year then touch screen controls started playing up and I got it repaired under warranty in October last year. No problem with controls since then but today my garage got flooded by the water during drum clean cycle. I took back panel off hoping it was a pump or waste pipe. Unfortunately external plastic drum had at least two long cracks. I understand I can try and get it fixed by retailer as it not lasted a reasonable amount time or fix it myself and then take them to small court if they refuse to pay for repairs. I just wonder if I could try to start with Bosch to see if they agree to repair it free of charge or provide some sort of report or their view on the fault? I was told by their technician that after repair they made I do not have any warranty (original warranty was running out in two weeks after they made repair). I know some manufacturers extend warranty after repair by another year. And Bosh themselves say they will give 12 month warranty on the appliance if they fix it. But I guess it is meant when you pay them or could it apply to any repairs? Thanks for reading! -

Im vaguely aware that under EU law? items generally should be replaced/repaired if they are still reasonably new even outside of warranty period. My Sony mobile has just died a month outside of its 2 year warranty and i was wondering what the specifics of trying to pursue this are and if people usually experience any success? Many thanks.

I received the following PCN outside my house and want to appeal as my car was not blocking the dropped part of the footway. I was in a hurry when I left yesteray morning so I didn't take a picture of the side of the car from the road which would have clearly shown it was not blocking it. heres the PCN And now a couple of the enforcement pics - note there is none showing the side of the car from the drivers side as this would clearly show no blocking In the bottom pic you can see the other enforcement officer in the background smiling - not very professional! Now my pic showing with the car and then without so you can see the full kerb. If you look at the amazon box you can follow the line to see my car is not blocking it. I need help with wording the appeal. You unfortunately cannot see my house on google streetmap. I have an 8 month old and suffer with sciatica and have my own private space at the back of the house. I only use the front when i am on my own as it is less to walk to get her out of the car. Needless to say i dont think i really need to use any of this as i have not committed any offence. Yes if i was over the stones in the road or blocking the dropped kerb then I would pay up. they got me once before on this further down the road in another car so i really am cautious about parking on the road .

Hi all, My spouse regularly visits a salon near Preston (part of a row of shops off the main road). Usually the parking is pretty full and the only way to park is adjacent to the shop (i.e. a Pizza shop) if there's a free space. A sign was put up on the corner of the Pizza shop advising parking penalties (some months before), but when the staff were asked at the salon they said to ignore it as the Pizza shop is closed during the day. Just before Christmas a £50 parking ticket was noticed on the windscreen on exiting the salon and this has been followed up by a letter raising this to £100 threatening pursual and court action. My view is that there is no contract between the driver and the parking company and as the shop is closed during the day there is no material loss and the "Parking Charge" amount grossly exceeds reasonable charges in any event. The driver is not named so they have written to the registered keeper I feel it is prudent to respond robustly in writing - quoting some of the legalise in the court defence thread but I'd appreciate a steer as to how to proceed. I bought a TV 12 months and 3 weeks ago. Since buying it I had an intermittent problem with the screen going off for about 10 seconds then on again. I eliminated various other pieces of equipment over time then reported it to the manufacturer about 4 months into their warranty. After following their trouble shooting procedure they accepted it was faulty and arranged an engineer repair. When the engineer rang to arrange repair and get details I was away (this was around Christmas). During the discussion I told him I was unsure how to reproduce the issue since it happened intermittently. He said he would leave the case open for the time being. The TV is not my main set so I use it very occasionally. I forgot about the problem until more recently when I was trying to use it again and the same fault occurred. I emailed the manufacturer back with my reference number but they now refuse to repair because it is 3 weeks out of warranty. I realise I could approach the retailer but I feel like the manufacturer is using a technicality to escape from an issue they have already accepted as theirs and promised to repair onsite. It is a lot of hassle for me to transport the TV back to the retailer for a repair and they do not have the original report logged, which the manufacturer does. Can anyone please advise or tell me where I stand legally? -
Community Work Programme issued by JSA outside of 8 week period! Some advice would be really appreciated. Does the 8 week rule still apply? How to refuse the CWP? Where to count the 8 weeks from? After a 2 year period The Work Programme with Ingeus ended (2faced staff/ incompetent /useless), I was referred back to the Job Centre and issued with an appointment to attend in April this year. I was asked by myJSA to sign the My Work Plan (WS1 form) in May. I had to sign weekly for awhile and then back to fortnightly. Yesterday I was handed a letter to attend a Community WorkProgramme (CWP) later this week. I have been back with the JSA as I said since April or counting from May – either way it is past the maximum 8 week period in which they have to either allocate Daily Signing (DSR) or CWP (Community Work Programme). Has this changed? And if this 8 week max still applies how do I go about politely but firmly refusing the CWP without being sanctioned. Also which date am I meant to count the 8 weeks from – April is when I went back to the JSA – May is when I signed the “My Work Plan” – I am making the assumption this is the date of the WPCI interview but am not sure. Worried I will be sanctioned again – and a second sanction would mean months of financial punishment rather than weeks. (the first one was applied because despite having attended every single mandatory appointment Ingeus had given me and not missing any appointments/workshops of which there were many - there was just one I never received notification of in the post andby the time a text message arrived it was too late, I left a message for the advisor which was never passed on – I appealed the sanction and the Decision Maker in all his glory upheld the sanction as “the balance of probability is that the letter was not lost in the post”!!!!!!!) -
Long story, I try to keep it brief... Around 2007, I took a mortgage with HBOS. HBOS made error on my bank account which resulted in around 6 months mortgage arrears. I did not know about the arrears until a few days before repossession. Because of bank error, the funds were there to clear the arrears. I cleared the arrears. I also paid extra to put account in credit. House was repossessed despite me being told that clearing the arrears in full would stop repossession. Since repossession, I have sent HBOS a number of complaint letters which were stamped by local branch to act as a receipt. All complaint letters were unanswered. I've taken advice from a police sergeant - the advice was both as a friend and as a policeman, explaining how I can stand outside the bank giving out leaflets to passers by showing the facts of my complaint. I have been working 18 hour shifts the last few months but now have a lot of time off to concentrate my effort in HBOS and I have no hesitation in standing outside their branch giving out my leaflets! I have informed HBOS press office of my intentions as well as giving them 2 weeks to answer any one of my complaints during the last 10 years. I know that there is a time limit of 12? years to bring a claim against a mortgage. Should I do as planned and stand outside their bank in the hope that it will shame them in answering my complaint? Or perhaps a more conventional method? Apparently I cant complaint to FOS since the mortgage was not regulated. The only choice I see I have is to either stand outside their bank after the 2 week period, or perhaps some other method to get them to answer my complaint, but, I do not know what? Local newspaper said it will attend bank with photographer, if we are forced to stand outside the bank! Apart from losing the deposit I paid for the house £16,000, my other financial losses are that the house was sold far far below its market value by around £40,000 Working 18 hour shifts a day is tiring, but I now have some holidays I don't want to waste my holidays standing outside a stupid bank, but do not see any other alternative to get them to answer my complaints unless someone can suggest something?

this is a good one(not for me) I had my car sorn and parked on my drive, i pre booked an mot for 1030 next day , circa 8 am as the mrs went to take the kids to school she asked me to save her a parking space , i went to try and tax the car on line but could not, i went outside and swapped cars came back in and tried again to tax it could not, i thought well ill just go to mot place as i was going to the car and wait for the mrs she walks in with a smile on her face " you ve been clamped " i replied " yeah sure dont you want to park yours as i go to mot" low and behold i had indeed been clamped . it was now circa 840. i had to pay £260 and then got £160 back, the guy who clamped it was ok and said i should get all the money back as it was a mistake since i had a pre booked mot. However this was only the beginning of my troubles, I tried to contact the dvla - its like asking for an audience with the Pope! Eventually i was told that not only would i not get the other £100 back i would be fined, low and behold a summons came through , it was not clear what exactly it was for i contacted the court and explained the situation, and sent them a copy of the garage diary with my details etc etc, next i get a letter from dvla stating that as i had entered a guilty plea they were offering me the opportunity to pay £285 to settle out of court. I hadnt heard from court yet nor entered any plea. To to it all the letter from dvla had a contact number and fax number that does not exist, and they put down the address of the offence wrong. i tried to contact them no response sent them a letter asking for a copy and all relevant material to be sent to me, never heard back, got a court summons to appear this monday at watford magistrate court to answer for keeping a car on the road under sorn. any one can help with what i should say in court????

Something new seems to be happening in Kent and it seems that the Prison Service are literally allowing people to have "free allotments", only for use, not to keep, outside the prisons. I know this is true for the Swale, Kent area! Only drawback is that there aren't usually hosepipes or outside taps in the area so be prepared to cart a few 10l tubs of water around -
Hi, hope someone can clarify this for me. A DCA has made a claim against me in the County Court that was served to my last UK address (and then forwarded via Royal Mail to my USA address). At this point, no CCJ has been issued, but the claim was served at my last UK address. I opted to return to the court, via Email, the acknowledgement and defence forms, contesting jurisdiction. I supplied with this evidence of my having moved to the USA (in the form of my immigration stamp from my passport, my US home lease agreement and a recent USA utility bill at the same address). Does anyone think this was the best course of action to take, or should I have waited for a CCJ to have been issued, and then applied for it to be set aside? As I see it, by contesting the initial claim with proof that I am not UK resident, they cannot issue a judgement at all as I am not UK resident. Many thanks in advance! -
Hi, just after a bit of advice. My house is up a lane about 50m from the road and until recently there has been no land to park outside the house. My neighbour has bought some land of the house in front and converted into a parking area solely to be used by them even though they have room for two cars beside their house. They have put up a sign saying parking for no1 only, (there is only two houses) what I want to know is what could they do if I parked on the land apart from ask me to move the car? And what could they do if I refused as it doesn't seem a very nice neighbourly thing to do. I haven't move in yet so iam hoping they will allow me to park but I think they had issues with the previous owners and that's why they are being a bit obstructive. Thanks for any advice any one can give. -
Hello I resigned from my job last June as I uncovered alot of dodgy dealings that my Manager was doing. I had been singled out and had not been given voluntary redundancy when requested. I used the Companys Whistleblowing procedure to air my views and to expose what had been happening. The Manager has just been sacked and the investigation has just finished. Am I able to take my employer to Civil Court for compensation at all? I know im out of time for the employment tribunal route and wondered what my options were? -
Hi all, I've been a bit of an idiot. I was recently caught riding on an oyster card outside zone 6. I touched in in Zone 3 and then travelled a few stations outside of the oyster, where I got caught by a revenue protection officer. I panicked a bit, and initially lied about where I got on and gave a wrong address, but then under caution gave correct details, which were confirmed when my oyster was checked. I also basically admitted that I'd tried to avoid paying the fare, which is stupid I know, but I was nervous and not thinking straight. The operating company in question is south west trains. Anyway, I know that I've got to wait a few weeks until the letter comes through, but I was wondering whether anyone has much experience in these matters, specifically how likely they are to take the matter to court versus accept a settlement. It's my first offence, so I'm hoping that they'll accept an out of court settlement, as a criminal record could potentially screw me up since I sometimes have to travel to the U.S with work, however I'm aware that my idiotic behaviour has basically given them a cast iron case should they choose to pursue the matter further. Should I be seeking legal advice? Cheers -

Okies so I nipped in B&Q for 5 mins it was 7pm on a co9ld wet Tuesday evening, so I parked in one of several disabled bays mainly due to mits proximty to the stores entrance, low and behold upon my return there on my windscreen was placed a ticket.....Pay £50 quid in 14 days or goes up to £90...People your sound advice on this matter is most appreciated please, I thank you
