  1. Hi I started a Ppi claim with Lloyds a few weeks ago there were 9 old loan account from 1992 to 2000 with Ppi. I should have my response in Aug. But this week I have received 2 letters in the same envelope to old address even though Lloyds have new my address due to claim. One is from Lloyds saying they have sold my debt to asset link the other from asset link. I know there's a Lloyds charge on my old house from 2006 (ex wife and kids live there but my sole mortgage) as its on land registry. Any one know why I've been sent letter? I assumed they would offset against any debt anyway. Any advice on what to do I will upload letter off asset link. PDF Photos 16-07-2016.pdf
  2. Hi We moved in to our rented property at Christmas 2017. We both work from home and took the property based on being able to do just that. My fiancé has a photography studio set up here with regular clients coming to the house. In May we found out that the neighbours had sold a patch of their garden to a builder who is now building a house on the land. The noise is unbearable, we are woken up every morning at 7 and we can't use the garden because of the noise and dust. The neighbours are also having their remaining garden paved by a separate company who also make noise from 7am. To top it off, our other next door neighbour have just started work on their house so we have to deal with hammering and banging all day on that side too. The landlord claims he knew nothing about any of it, which is rubbish and the builders have confirmed that they have had extensive conversations with him as part of the planning process and he in fact moved out of the house because of the construction. We have already asked for a rent reduction as we have been deceived in to moving in and the worst part is we pay nearly £2k in rent to live here! In this beautiful weather, we haven't been able to enjoy the garden at all. I have spoken to a solicitor who has told me whilst the landlord did have a moral obligation to tell us about the work, he unfortunately didn't have a legal obligation, which I just cannot believe! We have spoken to the builders who have now said they will try not to do noisy work before 8am, but even minor work causes enough noise to disturb us. We have to have the windows open because of the heat and there is no escape from it! We've requested a rent reduction but the landlord said no and we would have to pay to get out of our contract. There is another month left of the building works and we just don't feel like we can cope with it anymore. We're both being woken up in a state of stress and anxiety and its impacting on our work and our health! Is there really nothing we can do!?
  3. I have a number of accounts that I am paying back on an agreed debtmanagement plan, one being a credit card with HSBC. The dilema I am in is that all the other companies have changed the status of my account on experian to Special Instruction Indicator: Arrangement and I have been paying them upto date for over a year now. All this is showing a green symbol. In trying to rebuild my credit rating and finances etc HSBC Credit Card have not changed this, yet they accept my payment of £x.xx per month and have frozen the interest (although it it with MCS) This still shows as a red symbol Is there anyway I can get them to alter this to relfect I am on an agreement and that I have kept up with monthly payment? The arguement they came back with before was that they wanted more than triple what I offered to and am currently paying and therefore did not accept the agreement?? Yet they have settled for a reduced amount and have done so for some time Any thoughts please?
  4. I've been in a difficult marriage for 26 years. I want to sell / trade in my car for a newer model but my husband is refusing to let me saying I'm not allowed because its his car. I am the registered keeper & I have always paid for tax, insurance and any repairs & upkeep. Would it be against the law for me to trade in the car without his consent? When we bought the car, he paid for it (& he says he can prove this), I sold my old car and wanted to give him all the money I got for it to pay for the new one. He refused to accept it, telling me to put the money in my bank account. This was 2 years ago. I feel trapped. He says if I want a new car of my own then I have to go and buy one but I should just give him the one I presently have because he says its all his. I'm concerned that he's going to be awkward and sell my car even though I'm the registered keeper. Can he do this? Sorry - I know there's a few questions here but I fell very intimidated.
  5. The Government is to take another step towards recouping the vast sums of money injected into the banking system in 2008 by selling £3bn of Bradford & Bingley (B&B) mortgage loans. Sky News has learnt that UK Asset Resolution, the Treasury-supervised unit which manages the remnants of the former high street lender, has appointed the Wall Street investment bank Morgan Stanley to handle an auction later this year. The portfolio for which it will seek buyers is understood to comprise lower-quality buy-to-let and higher loan-to-value mortgages ‎than an £11.8bn package offloaded last month. City sources said the latest auction was unlikely to kick off until after June's General Election.   6. Hi please can someone help me. I was awarded a suspended eviction order on 9th November 2009. Whereby the judge ordered if I had to go again I had to go before him and He would basically chuck us out (due to me being there previously) That was dated until November 2010 - Will this be relevent now. Mortgage is with Santander. I have fell behind a few times since just before xmas, but ALWAYS made it up. I am up to date with my payments. And dont owe anything til end of September. My arrears currently stand at £856.71 I have been away on holiday, and come back to a Warrent for the possession of property. Eviction will take place at 28th August at 10.20am. Santander, phoned me in on 20th July - My payments where up to date. Requested I went through a income expenditure with them - right there and then on the phone. I was at work and requested they put the forms in the post. I promptly filled them in and posted them back. Santander say today that because they didnt get them & I defaulted on court agreement they either want the Full £856.71 or the House. Please help me Please help 1 small child and a pretend teenager. Reading through some of the other threads, people have been evicted for being up to date. Really starting to panic Forgot to say I do work, and can pay the mortgage. Just messed my money up a few times this year. But It was payed as soon as, And I am up to date

  8. Old Tawnyowl here with entrepreneurial adventure number 966. For various reasons,a small heart attack a while ago and i suppose slowly aging i had to change my life around. Could not do what i used to do.It hurts a little but just the way,i miss my life in the construction industry and the people and customers i met.To myself it was fun and looked forward to going to work each day for many hours. I find now after a few hours i have a little pain,probably due to the medication.Hospital and doctors says i am ok. At the time i did not go on the sick but struggled on after coming out of hospital,not one of my better ideas. Developed another small ailment that trapped nerves in my back and shoulder and had no choice but to go on the sick. Ended up at the medical centre for a assessment as many do.Being chirpy despite a little pain i received 0 point,fit to work. I wanted to work,many of us have that drive,it feels good to have a little money for lifes essentials. Such as food,warmth,heating,and perhaps if lucky a outing or two. My small business at the time was one of the top reviewed in the country,and no trickery could take place,things were checked carefully. Anyway after ending up at the job centre the week universal credit arrived in town i was accepted. Just did not seem to fit in,tried telling them about my ailments,not to avoid work but to find something that fitted to my new life.Say maybe 4 or five hours a day.I feel in all honesty i would be tricking employers applying for many jobs as i would be found out. Do you want to be a Kitchen Porter,a Taxi Driver,a Tram driver,Conductor. Nothing wrong with those jobs but knew i would not cope and maybe the medical for some would find me out. And my mind is funny ,i worry about what ifs.The idea of a weakened heart and moving the public about things like that. Hundreds were applying anyway,younger,fitter and correct for the jobs. I got along with the staff,not all of them but most.But just did not fit in it felt that way anyway. Nobody seemed to listen. Finally the greatest idea came,would you like to be a security guard perhaps,go on a course get a card. You felt obliged to apply for any job which is the way i suppose.If you do not all hell could descend on you. There is no doubt i felt intimidated and just walked out feeling absolutely useless.After enrolling. Excuse me sir would you not mind grappling with me i have a heart condition and please do not hit me with that bottle you have just nicked,my blood is a little thin,never mind chasing anyone thoughts were going round my head. I saw some sad things that people this day and age should not be going through. Phoned them up before the course and said i am off to take a chance. You cannot do that you need to see a adviser specially trained for self employment,a business plan and god knows what else.Fair enough for younger ones who have no experience and young but i am approaching 61 and have a little experience gained over 40 years. Which before i go on any longer i will have to mention my thoughts of a Basic Income for all. Many things will have to be ironed out but seems a idea fit for today,never mind the future. A idea whose time has come. Now this is what i am doing.You have to be pretty tough in business,so many ups and downs. My idea online is to probe away,looking for weaknesses in things i know about,like certain plants.And other things.Online and who is selling them and then try to get a market share.As big as possible with stock you have.And at a fair price with reasonable postage costs. It is funny if that is the word watching them watching me trying to outmaneuver me,Cockneys,and people from around the country wanting their share which is right.I know i am having a little effect. One line has now reached a,do not laugh,perhaps up to around 20 pound a week with much more potential next year. So obviously i am now probing elsewhere.trying things,trying to beat my competitors,checking things out,looking for weaknesses in my competitors as in my plant business. But with larger potential. Get perhaps 15 lines selling reasonable and you can see ,well in my lifestyle i will be like a contented cat. So this is where your expertise comes in for those selling online wherever. I know we do not like giving away places where things are selling well. But have you noticed some online sites weakening and people moving to other places. Things change so fast nowadays. Any tips for businesses who are just getting going,perhaps setting up your own website to cut costs a little. Where are the up and coming areas to try.The places to open a website and how.Not everyone knows and could save days making mistakes when time is so important.   9. Hi everyone. First time poster so please bare with me. I took out a personal loan from a Bank to purchase a car 2 years ago because my GF at the time did not have the credit rating in order to do so. Each month she would send me the money via bank transfer to cover the repayments going out of my account via Direct Debit as agreed from the beginning. We have since split up and she's decided to sell the car and stop giving me the money for the Bank Loan repayments. Her name was on the V5 document as the registered keeper, however as I bought the car outright myself and have proof of doing so in the form of a Vehicle Order form and Loan Agreement from the Bank my question is is it illegal for her to have sold the car without my permission? I also have recent text messages stating that she will always pay for the car but has not done so in some months. Where do I stand?
  10. Hello I am new here and desperate for some advice. It's complicated but will try and keep it brief but below is a summary. In August 2006 myself and my now ex husband needed to refinance an existing loan with GE Money a broker referred us to Blackhorse and we were offered a secured loan of £40k. We were categorically told that we could only take the loan if we had the PPI as well even though we said the repayments were way to high to afford. We were convinced by the Blackhorse rep that this was our only option like idiots we signed. The loan agreement states Regulated by the Consumer Credit Act 1974. Total amount of loan with PPI was £52,075.05 (we did query this as we were told absolute max allowed to borrow was £39,000 the balance is cost of PPI). 10 year repayment period. Interest rate of 11.9%. A year on and we realised that the PPI should not of been sold to us as we had our own insurance through our employers (we had told the Blackhorse rep this before signing)! After a bit of a fight £10,373.35 was credited (so it shows on my statement). Another year down the line and a divorce. I got into payment difficulties and missed a few payments (I always made Blackhorse aware of when and why). PPI came to light again as when Blackhorse credited the original amount they had failed to refund the payments we had made and the interest. In 2009 Blackhorse finally credit the account again with a refund of £3,561.31 only after I had refused to pay anything until they did! I carried on paying reduced payments to Blackhorse as I was struggling on my own with the loan and main mortgage but had accrued arrears made up of missed payments and charges of £23,435.47 Blackhorse went for a SPO in November 2012. Blackhorse wrote to me the same month to say they were charging me 11.292%. I have carried on paying the court agreed sum however on occasions I have not been able to pay the whole amount on the due dates and payments have either been split, late or not the full amount. I always called Blackhorse and made them aware if paying extra when I could and for once they were helpful! In October 2014 I received my annual statement and was shocked to see that even after paying over £7K the balance of my loan had only gone down by £145! I queried this and put in a complaint to the FOS. Within in 4 days Blackhorse rang me and said "good news - no more interest, when I queried why all of a sudden they said "good will gesture"! Roll on to May 2015 when I receive letters from Blackhorse and Skye to say loan was sold on. I rang Blackhorse and asked why they said no longer "allowed" to operate those loans" however everything with my loan would remain the same. I then called Skye when my first payment was due 1st July 2015). Made the first payment via debit card however the rep entered the wrong post code so had to do again. Again was reassured smooth running of account by Skye. Checked bank account later that day to find I missing two lots of large payments! Rang Skye oops sorry a mistake we don't have the money it's in limbo, called my bank who confirmed the wrong payment was in limbo and would have to wait until it wasn't collected to recredit my account. My bank then blocked my cards as believed it was fraudulent due to high amount twice! This took almost two weeks which meant I incurred bounced direct debits bank charges and £253 liability order for non payment of council tax! Skye just said oh we didn't have the money physically so tough, On making my next payment the lady I was speaking to said about setting up the payment plan by direct debit. I explained I was unable to do that as sometimes I have to make split payments as money was very tight. She said send in your pay slips, statements and expenditure and income and we can see if we can get you a more comfortable payment. She asked was was comfortable now I said the amount but what about SPO. She said well it's a fresh start with us and took the reduced payment. She confirmed to make the reduced payment until they had reviewed my finances. I made the reduced payment (split) this month on 29th. Thence stepdad I received a call from a rep who told me she had reviewed my finances and the history of the account from Blackhorse and as there are still £9,315 owing on the arrears and as my finances clearly show I ve no extra finances to clear these - they suggest I sell my house to clear the whole balance on my loan otherwise they will possess. I was shocked! She said they are no ,onger able to help me and I have until Monday to respond. Sorry this is so long but thought the whole history would be helpful. Sorry I forgot to mention I have paid £45,102.41 to date and the balance on this loan is ......... £42,676.88, the lady who called from Skye in Friday also said the the original term of the loan was up last month and that I had breached the SPO as when it sent to court a new agreement was put in place (news to me as I never signed any new agreement) that the loan would be extended by 4 years to allow for all arrears and payments to clear however I would need to be paying over £900 a month to do this - I currently pay £700 which is £80 more than agreed by court.
  11. I wonder if any one can help me I recently purchased a nearly new Giant road bike off ebay. It was advertised as in very good condition. They did not mention any thing about any problems with bike. I paid by paypal using money already in in my PayPal account. Bike was shipped to me already built sent by specialit courier. When recieved bike it was not as described. Brakes dont work gears don't change properly, parts of gear system are bent and back wheel is bent. I contacted seller to complain and there reply was these problems where not present when tested bike before sending. They refused point blank to take bike back or refund my money. I contacted ebay and paypal and opened a duspute but despite providing proof they saw in sellers favor. Ebay wont tell me why and are refusing to look in to it any more. Is there any way to get my money back. I have copies of payment I made to seller, I have photos of problems with bike and have taken to my local bike shop and have a report from them. Report lists all problems. Brake Cables need replacing, wheel needs fixing or replacing and gear system needs fixing. I have been quoted £150-£200 to repair. This is including labour. Could I take seller to small claims court to claim costs of getting bike repaired or to get a refund for bike. And If I did would I have enough evidence to back up my claim. Would I have a good case Any advice would be much appreciated, Thanks in advance
  12. Hi everyone A couple of years ago I looked into trying to reclaim PPI that was brokered by Norton Finance as part of a secured loan I took out in October 2004 to consolidate some debts. I borrowed £ 40000 repayable over 25 years and the broker insisted I have the PPI which was to cover loan repayments for accident, redundancy and sickness for the first 5 years of the term of the loan. they added £ 9790 for the PPI. In October 2006 I decided to remortgage and so the secured loan was repaid after just two years. Now, when I enquired to First Plus about the mis-sold PPI, they told me that I had to take up the matter with Nortom Finance. However, by that time, the broker had stopped trading so went to the FCSC and they said that no claims before 1st January 2005 could be considered. However, my argument is that the PPI payment would have been paid by Firstplus to the broker and what is more to the fact, I only have the loan for two years so only two years of premium were used - I never was refunded the PPI premium as there were three years of cover still not used ? Firstplus are using the same excuse as the FCSC but they are the ones who paid the premium and they were the ones repaid in FULL when I redeemed the loan in October 2006. I am sure they are just making excuses to not pay but fee that even if I cant make a claim fro mis-sold PPI, I can atleast expect some of the PPI premium paid to be refunded as the original term was for 5 years and I only had the loan for 2 years. thanks - any advice would be great. I dont have statements anymore - just the account number, principal borrowed and PPI paid out in en email from FP. Dean
  13. First of all thanks for reading We need to sell or remortgage our house as son is disabled and we need to either make adaptations or move to a bungalow. We bought the house 7 years ago but had debt in the past and just after we bought the house we were chased heavily and they got a ccj against us. They put an interm charging order on the property 3 years ago. I am not aware of any final order had been made and they have not communicated with us since. I have obtained a copy of land registry and it sates the following : Equitable charge created by an interm charging order of the xxxxxxx county court dated xxxxxx in favour of xxxxx. Court reference xxxxxxx What does this mean? If we sell do we loose all equity? If we remortgage will the money pass to them?

Which? gained unique access to hundreds of bank staff for the research, which was designed to test whether banks' public statements about scrapping sales targets have translated into real changes in staff behaviour and culture. We found evidence of improvement in some areas - for example, 78% of staff told us there is currently a greater emphasis on customer service than on selling products. However, it's clear the banks have more work to do.   15. Hello, I hope someone here can help me. After having fought eviction successfully 4 times we have again fallen behind with 2 payments on our suspended repossession order, this time due to urgent works (collapsed drain) that had to be carried out whether we wanted or not as it was backing up into the house.We can prove that with paid invoice. Long story cut short we want to put an end to this vicious cycle and sell the house ourselves, having had estate agents here over the weekend confirming that the house is worth more than we owe. And they think it should sell quickly because apparently there is a shortage of houses of this size in our area. We have the money to bring the arrears up to date prior to the eviction BUT that's all we have - I worry that if we pay it and the Judge does not allow us to sell ourselves we have no money left to find a place to stay, as there are 4 children aged 10-16 in the property that is a very worrying scenario. Can someone please give me advice: Do we pay in the arrears and take such a huge risk or can we eg turn up at the Court with the cash in hand? Is there any sample N244 around on here which quotes any relevant cases as I am mightily confused which ones would be the appropriate ones for our case? I really hope that someone is online who can point me in the right direction as the last Judge firmly told us not to bother coming back...
  16. Hi, Ive just come across a thread about BH selling on to Skye, so have started my own.. . I only have 4 months left on the loan after 5 years. I had an agreement with BH that I have in writing, that if I continued to pay the monthly repayments on time (2 years ago) that the added interest, due to a few missed payments and an added 6 months to the term of my loan, without my knowledge, (even they could not see who had done it or why just that the dates had changed ??) that they would remove everything.. they had already removed over £1600 of wrongful charges, plus the payments they say they have received are not the same as the payments to them from my bank, they has less paid, I had asked for a SAR but not recieved this as of yet and the account went to Skye Loans with a different account number etc on 1st June ..worried now that the above will not stand , how do I best deal with this, will Skye loans have to honour the agreement I have in writing ??

Evening all, A few years ago my mum foolishly went to PDL companies for help when things went bad - she was ill and quite vulnerable and ultimately ended up taking an overdose to escape the constant badgering from these companies when she got into the inevitable mess. (this is when I became aware) I made a complaint to one of my mums payday loan companies because 1) they were reporting different things on different CRAs and 2) I believe they had irresponsibly loaned her the amount. Their response was that they hadn't irresponsibly loaned the money, as my mum had ticked the box confirming she could afford to pay it back They did not take into account that she had other PDLs with other companies (one of which was a sister company to this one) or that she had a live CCJ and other defaults on her credit record. In their final response, they sent a summary showing the PDLs she'd had with them, and the previous one she had (before the latest one that she couldn't pay) was rolled over/deferred for TEN months and then the latest one was taken out just 6 days after the last one was paid off - And they say they wasn't irresponsibly lending? surely deferring a loan for 10 months should raise flags that somethings wrong. although they denied they did anything wrong they did say that they would extinguish the outstanding amount and because of an 'internal error' causing them to incorrectly report on my mums CRA, they'd remove the credit entry from her file. I wrote and asked them to confirm that they would not sell it to a 3rd party or that the company that have just taken over MEM Consumer Finance (Instant Cash Loans - ICL) would not pursue it. This is their response but I am not confident it wont get passed around. 'With regards to your comments concerning the debt being sold or transferred to any other company, as it stands the debt remains with us. If you wish to accept the offer to extinguish the outstanding balance of £XXX and remove the loan details from your mothers credit file, this offer will be in full and final settlement of the complaint. If you choose to accept the offer we will no longer pursue your mother for the debt. Now call me a cynic but I don't see a confirmation that they wont sell it on. Any thoughts please? Also, should I be reporting them to the FCA regarding the 10 month deferral situation and lending to my mum when it should have been clear there were affordability issues? Thanks guys

  19. I've got a friend I owe a five figure sum to. We've not really spoken about it much because he knows my situation (ie poor) I don't think he's got any doubt I'd pay him back if I could (and I would) but he's got this other friend who's saying, 'You're being taken for a ride. Sell me half the debt and I'll put the screws on him. ' Can the guy I owe money to sell part of the debt and that would become legally enforceable debt? I have no agreement with the guy who lent me the money other than I have signed an IOU that simply states I owe him the money. I'm not bothered if the other guy buys the debt just so long as he can't bankrupt me which is the kind of person he is.
  20. Hi guys I'm not sure if I have posted this to the correct place but i'm wondering if anyone can offer any advice. There is a row of houses on a road plus a detatched house which have been boarded up for many many years and are quite dilapidated now. The council owns them, and I have asked if the council could sell me the detached house and I would renovate it as I cant afford to buy a house at the prices they are and will never get a £200k mortgage. I have worked since I was 15 and never been on benefits but because of this im not entitled to any help, even when I was made homeless because of family issues, I worked I was not a priority so had to rent privately as the council would not help. Anyway back to the point the council have said that they are looking to demolish the houses so that they can build new ones, which I think is completely pointless and a waste of money they only need a few thousand pounds spending on them to renovate and I want the detached one so it wont be affected, they haven't actually got planning permission to demolish the detached property yet. How can I get them to sell me this they are wasting such a great resource and I could turn this in to such a beautiful home for my family.
  21. I seem to have the opposite problem to most who post here. A few years ago I rented my home to 'friends' who seemed to think paying rent was optional. Long story, but eventually obtained CCJ for a monthly sum of £15 on account of unpaid rent to be paid into my account by 11th of each month. No attaching of earnings was made. The CCJ has now been running for a year. The first payment was made on time. Since then they have been getting later and later, missing some months. I have written to them reminding them of their legal obligations and asking that they pay as ordered by the court. Have now been accused of ' harassing' them. I can't afford to take them back to court - no longer live in my then home, v distressed at what I found. Want this over. Can I sell a CCJ onto an agency, discounted, effectively giving them ownership of it?
  22. Hi there, recently I just purchased a new PAYG mobile, my friend found the offer online and bought it for me. The brand new phone only cost 2.99 and I had to purchase £10 top up with orange. I had the phone for 2 days, I had not used it at all and my first text was from a company asking me if I wanted to claim compensation for my accident! Grrr! I was confused as to how this company got my number, as it's not an Internet phone and my numbers not on the net anywhere. I phoned orange, they told me it was because I'd been on the net, I told them no I hadn't. I asked if they had sold my number to marketing companies, to which they strongly denied. The answer to it in the end from orange was that it was a recycled number from 2009 and that's how they got my number! I said to orange that's a coincidence that after 5 years, within 2 days I'm receiving marketing texts. They absolutly assured me they don't sell customers details, I said ok if that's what your saying, but I'm not sure. They told me if I wasn't happy I could report to ombusman. Having been in a situation where my own insurance company sold my details I'm not sure if I trust any big company anymore! Also recently my partner phoned the CAB for debt advice and within an hour texts came through from companies offering to clear debts!!! He does have an iPhone but I'm unclear how that happened too! So any thoughts, do orange sell details? Anyone with similar experiences out there? Thanks!

A 16-year-old boy was told he was too young to buy a pack of teaspoons by a supermarket in Lancashire. Liam Whelan was sent by his stepmother to their local Tesco in Haslingden to buy replacements for the spoons he keeps losing.   25. Afternoon all some help needed. I took a loan out in approximately 2000 I was injured at work and could not afford to pay my amount so after a while restons became involved and when I was back in work sent an attachment of earnings and I was paying about 100 a month direct from wages, I was then made redundant and did not hear anymore this was about 4 years ago. Today I recived a letter from HSBC saying they had sold my debt to lowells. How do I go from here I don't know what to do any help would be most helpful.
