  1. I'm livid - today we have received a £100!!!!! 'charge' for parking 'longer than the maximum period permitted' (which is 60mins) on the 9th Feb 2019. We went to see an evening performance at Theatre Deli and parked in the carpark directly outside the theatre, which is on a small retail park (it used to be a carpet shop). A theatre performance is obviously going to last more than an hour, and as there were no pay machines we presumed it was free to park (especially on an evening). The notice is dated 21.2.19, the envelope does not have a post mark. The PCN is from VCS Ltd who are members of IPC. Happy to provide more info if needed. Please help me sort this as quickly and easily as possible.
  2. Saw my car with a clamp on it this morning and found out it was due for non payment of a PCN which I appealed against. Now i never received the council's response to my appeal and the only letter i recently received was on the Wednesday ( which i was told by the enforcement office, was hand delivered! which I think was posted via royal mail) The letter from the bailiffs stated i owe £200 as the for the PCN and court an legal fee due immediately. I was actually going to response to their letter today, but then saw the car clamped and i was charged £438 which had to be paid within 2 hours otherwise it would have been towed away at an additional charge. Had no choice but to pay and now am fuming over this ridicules fee which i cannot afford at the moment. Apparently once it goes to court, I don't get the court's decision and goes straight to a bailiff. Would appreciate advise on how i can take some of the charges back.
  3. Hold my hands up I parked in a permit area after getting lost in Doncaster after sat nav problems and late for a course....long story. Just received a PCN for £100 reduced to £60 if paid within 14 days from a company called Debt Recovery Plus trading as Parking Collection Services Ltd on behalf of their client "creditor" JD Parking Consultants Limited who manage the land. The letter states that the parking charge was issued following the use of warden operated camera system. I presume the stated system is therefore operated by JD Parking Consultants Limited? As I understand, a company is required to register with the ICO if it intends to process personal data and failure to do so pursuant section 17(1) of the Data Protection Act 1998 is a strict liability criminal offence. If the matter was to proceed to court, the photographic evidence, i presume, would be inadmissible.?? Not sure of any other way to challenge this. Any Thoughts? dont they need to register with the ICO for a camera system as long as it doesn't take photos of any individuals. However, JD Parking must be included on the ICO register to process personal data.

  5. Hi, (I hope i am posting this in the correct space and apologies to admins if im not) I appreciate any help this forum/users can offer in advance. I live in a new development (I rent been here for 4/5 years), I have an allocated space as per my tenancy agreement. Recently (September) the management company introduced a new scheme by appointmenting P&P Management Ltd to regulate the parking of our development. However the problem here is, instead of regulating the cars that park outside of bays (they don't have the legal right because the road is owned by the council) they now ticket cars in the private bays that don't display a permit issued by P&P Management Ltd. We received a letter informing us that unless we send back the display permit and send an email to opt out we would be accepting any rules set by P&P. Like most, work, life etc got in the way and i forgot to send back the permit and write an email. Low and behold i eventually received a ticket. I explained that I posted the permit back (must of got lost in the post....) and explained I didnt realise had to email as well. Nevertheless i also explained that I didnt give the management company nor the P&P to regulate my space, neither did my landlady. I followed their appeals process and they have written back to say in short, I owe them £60 going up to £100 if its not paid by a certain date. Ultimately what im trying to understand is can they chase me, if they can what are the chance of the courts finding this case in their favour. I've read that a Penalty Charge Notice is different from a Parking Charge Notice (Which is what they issued me with). I'm happy to tell them with a few choice words where they can go and see them in court, but I also want to know if its worth just suffering the £60 and them now understanding and knowing I no longer participate in the scheme (not that I did anyways) and the situation being done with. Appreciate this is long winded but thanks again in advance for your help.
  6. Hello all. First of all thank you very much for supporting this website. It has given me some hope in what to me appears to be a very dishonest situation. Summary PCN received after stopping for 12 mins at the entrance to a P&D car park in which ALL 4 Spaces were blocked by a wooden pallet each with a notice saying the road was too narrow for parking and emergency access. Details Broadwater Street West in Worthing, West Sussex is a short, narrow L-shaped side street running along the side of Starbucks and to the left behind it and other buildings, giving access to lock-up garages and waste bins. It has 4 parking spaces nose to tail running from the entrance of the road. My passenger had a painful case of cystitis and needed to use the loo. Thankfully we saw a Starbucks and from the main road it looked like there were parking spaces free in the side street next to it. After turning into the street and letting my passenger out, I saw that each of the parking bays had a wooden pallet in them preventing their use. In addition there was a sheet of paper on the wall to the side of each space saying that access was required at all times in case of emergency, bin collection and deliveries and that the road is too narrow for parking cars and through traffic. This is certainly the case. Having entered this narrow street the only way out was too drive to the end of the L where there is just enough space to turn around and then drive back to the entrance. Unable to park I waited just short of the main road for my passenger to return. Although I had fully intended to pay, with it not being physically possible to park let alone legal, the whole place gave the appearance that parking was at least suspended if not cancelled. Hence it never crossed my mind that I would be penalised for stopping there. There is of course no one supervising to tell you. My passenger could have just run in to Starbucks, used the toilet and run out but being polite she chose to buy some tea. We had just left the vet after having spent an hour talking to one of their very kind nurses about the loss of our dog which has been heartbreaking. It was a very emotional time and with the cystitis as well I couldn't drive off and leave them; stopped by the entrance I could at least clear the road if for example an emergency vehicle required access. They returned after approx 10 mins and we left. What Happened PCN received for "Failing to Park Within a Marked Bay". Given the situation described above where I was physically unable to park in a marked bay, let alone do so without blocking emergency access I thought it was a [problem] and a quite ludicrous one at that. And for this reason I have not contacted One Parking Solutions. I have since received a letter from ZZPS Limited saying my unpaid PCN has been passed to them to resolve. The balance owed has now increased to £170. They have quoted Parking Eye v Beavis as a recent Supreme Court Ruling. I have spoken to them and they said I was parked for 12 mins. If I do nothing the matter will be passed to their solicitors.
  7. Hi all, this morning I received a charge notice from CP Plus for staying too long at Donnington MOTO services. I have to say I have never been before and was concentrating on where to park so never even considered a time limit. Its not often I use services and assumed there would be plenty of time. I now know I was wrong. I stayed 2 and half hours according to the in and out time. It was about 3 weeks ago, so I cant honestly remember. From what ive read they have to send the letter within 14 days - which it isn't. so guessing I either choose to ignore or appeal on this fact? 1 Date of the infringement15/9/2017 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 4/10/17 3 Date received 7/10/17 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012?   8. Hi guys, I have just received attached PCN . It was not me who was driving the car, but my partner on said date. The place of PCN is Fox restaurant, she was the customer at the said restaurant at that time. Can someone please advise if we should pay for this said charge?   9. Hi, I inadvertently parked in a residents bay last Sunday at the Olympic park, unsurprisingly I returned to the car to find a £100/£60 PCN from Gemini Parking Solutions London. What's the collective advice with these people when I don't actually have legitimate grounds to appeal it for other than their notice being just that and not a fine? thanks JM
  10. Sorry if this has been covered. CHAMBERLAIN BUILDINGS. Driver received Claim Form. Claimant EURO etc... Address for documents: GLADSTONES etc... Top right hand page: COUNTY COURT NORTHANTS etc .. This will be defended but firstly who should I respond to, if anybody? Parked for less than 5 minutes outside of bay(no ticket required) Insufficient time to read signage detailing 'contract' Operative had no id or uniform and proceeded to take a couple of pics of vehicle. Unsure who he was initially. Then POC £100 for PCN; £60 Contractual costs and then statutory interest . Grateful for any advice please.

It says on this PCN that any appeals would be handled by the IAS There are two official bodies, the BPA and the IAS. If you are unsure, please check HERE- BPA If you have received any other correspondence, please mention it here I have not received any other information but the letter does say that if payment is recieved within 14 days then I could pay £60 instead of th £100 they intend to charge. The letter also says that if I want to appeal I must do so within 14 days. I am not sure whether or not I have any sort of recourse here, it would be great if you could please give me some advice. Hi there i have a letter before action from Gladstones Solicitors regarding a PCN, which happened 16th October 2017 outside a sandwich shop, this was the only parking spot available and i was having dizzy spells and needed to eat. When i came out of the sandwich shop and noticed someone taking pics of my vehicle, i approached them to explain the situation but they simply ignored me. The parking restrictions were not clearly displayed. They have given me 30 days to respond from the date of the letter - 15th November 2018 and the 30 days fall on Saturday 15th December 2018. I would really appreciate some advice on this as a matter of urgency. Thanks in advance, Roland
  13. Hello, I would be grateful for some support on a PCN issued by Norwich Traffic Control on 2017. The car park is also for a DR's surgery that I was attending. I parked my car in a car park that was being enforced by NTC on 12/05/17 The entrance for the car park is only wide enough for one car so if you are maneuvering to allow another car to pass, you are not able to read the signs as you enter the car park. Upon parking my car, I went over to the pay and display machine to see if there was anything reading the Dr's surgery, there wasnt, just the usual generic sign. I then went into the Dr's surgery to ask them about the pay and display. They informed me that there were allocated parking spaces and the sign detailing this was only at the entrance for the car park. They also said that I wasnt the only person not to see the signs. I went back out side to move my car however I was met by a NTC Warden who had already issued a parking ticket. I had been away from the car for 1 minute. I explained to the NTC warden and the fact they must have seen me go into the Dr's.... I was informed that it wasnt her problem. Later that day I emailed NTC and explained the situation, they informed me that ticket was still valid. I appealed via the IAS and highlighted that i believed NTC had not complied with the Code of Practice for the IPC as follows; IPC Code of Practice Part B, Clause 2 – Signage Clause 13 – Professionalism Clause 14 – Predatory Tactics Clause 15 – Grace Periods BPA Code of Practice Clause 9 – Professionalism Clause 12 – Requesting registered keeper details Clause 13 – Grace Period The IAS dismissed the apoeal by stating the following; "Whilst having some sympathy with the Appellant, once liability has been established, only the Operator has the discretion to vary or cancel the parking charge based on mitigating circumstances. For the reasons given, the appeal is dismissed." I have today received a County Court Claim from NTC's solicitors claiming £246.06 for the parking ticket. I still believe that NTX did not comply with the Code of Practice for all of the reasons detailed above however I would be grateful for anyone's assistance with this. NTC are notorious for things like this and there are numerous complaints about their methods of operation. Photos.pdf
  14. Hi, I got slapped with pretty much the same PCN at the same car park. My wife was driving the car and she did pay the £2.50 after she arrived. However as we only got the PCN 22 days after the day she parked there the ticket is long gone. The date of the incident was the 6th of December and we got the PCN on the 28th of December. I have seen from the signs posted here that they say you don't need to display the ticket in the car but that you should keep it as a proof (who keeps their tickets?). The PCN claims we breached the 'contract' by parking without payment and as evidence they just show that the car entered and left the car park. That is only evidence that the car parked there, not that it wasn't paid for. As we don't have the ticket anymore we can't tell when the ticket was issued or whether the registration number was entered correctly (always a change of typing it wrong). In my opinion they would need to prove that you didn't pay. So they would need to show an audit trail of tickets issued during the period and list which tickets that were issued do not match any cars that entered the car park. If e.g. 1000 cars parked during the day and 1000 tickets were issued they can't really claim that someone did not pay. The Levenshtein distance (how many letters you need to change to go from one string to another, E.g. Hello to Hillo would be a distance of 1 as you have to change one letter) between the reg numbers entered on the ticket machine and the reg numbers of the ANPR system would show straight away if some reg number had a typo. If a type was the cause for this PCN then another question is if the system knows at any time which cars are in the car park, why does the parking ticket machine not reject numbers that are not in the car park? So what is the best way forward. I've read that you should not appeal. Why? I fully understand that they will reject the appeal as this is their business model but can't you use the appeal to put them on notice already? I am not a lawyer but I would request the following: -Proof that the parking charge was not payed -Ask them to reserve the CCTV footage (if they have) of the ticket machine for future use in the court of law as that would show my wife making the payment (making clear that you won't be bullied) -Provide a list of tickets issued during the period which do not match any of the numbers of the ANPR system and their Levenshtein to our registration number. -Audit trail of the ticket machines. Are there any gaps in the ticket issued? My wife has her father as a witness that she paid and there she helped an elderly couple at the ticket machine (but we don't know them). So what do you suggest we do? Wait until they write they are going to court? What would the worst case be, it goes to court and you have to pay. How much would that be? I know that that is what they bank on that people are scared of going to court and lose especially now that they won a few (or at least one) cases in court. PCN attached Signs (thanks to User999 for getting all those pictures) One of the signs is saying: "Please ensure you enter the full and correct vehicle registration number of the vehicle you've parked today. Failure to do so may result in the issue of a Parking Charge Notice (PCN)"
  15. Hi, I'm looking for some advice on a PCN that was issued last year 07/09/2017 for parking at Croydon Poplar Walk car park. I did park there on the 7th September, and didn't make the payment as I think my phone had issues (or I forgot) and called up the number the next day when I remembered on the PaybyPhone site/board to ask how I can pay for the previous day as when I checked the website I couldn't find any other contact number. The operator told me she couldn't help me as there was no mechanism to make a back dated payment. I've parked in the same car park multiple times and always made the payment. When the first letter came, I remember vaguely I called to say I tried to make the payment the next day, but they wouldn't have any of it, and said the notice in the car park says clearly that the payment needs to be made within 30 minutes of parking. I tried appealing on the call saying I had tried to make the payment the next day and explained I'm more than happy to pay the parking fee with an appropriate interest for it but the fine of £60.00 seems a bit steep, but they didn't budge. I tried to search up the actual legal owners of the car park, but couldn't find any details for them. Subsequently, I got a few letters from Civil Enforcement where the money owed kept going up, but after trolling through a few sites which recommended ignoring these letters, that's what I did. Then I got a few letters from ZZPS which had threatening tones (and amount kept increasing, all of which I threw away) and then got a couple of letters from QDR solicitors, the last one dated 25/5/2018 threatening stated they would obtain a CCJ, which I kept. I didn't do anything, as after looking up similar letters the general advice seemed to be to ignore them. Last week I got a Claim form from County Court Business Centre, Northampton dated 11/10/2018 which looks very legitimate as it has the county court stamp (albeit a bit faint). The amount now states £331.59!! Feel like I should've just paid the £60.00 last year. It seems a bit unjust that a £5.00 parking fee should end up having such a huge fine!! What should I do? Any help will be greatly appreciated. I've attached the first page of the claim form (it has 4 pages in total with page 2 being a 'Response Pack', page 3 is "Admission (specified amount)" - lots of sub-sections and is double sided ending with a declaration. Page 4 is "Defence and Counterclaim (specified amount)" - also double sided with lots of sections. I've also attached a scanned copy of the letter from QDR solicitors. Alcock Crescent (Vickers Green Estate), Crayford, DA1 4LX Ticket says they operate under BPA ……………………….. Hi received a windscreen ticket from UKPC for parking on the road. In a residential estate, but on a road, not a car park. No markings, yellow lines on the road and wasn't blocking anyone or any entrances. A not very obvious sign parallel to the road saying "No Unauthorised Parking" which looked like they were for the parking bays, but on closer inspection after receiving the ticket say 'no roadway' parking in very small letters. They have photos showing car with a blurry sign in the background on other side of the road, plus a close up photo, taken at an extreme upwards angle (blurry, can't really read what it says - my own photo is much better) Considering whether its worth an appeal or not, any help appreciated.   18. Hi there, I’m hoping someone may be Able to point me in the right direction. My son received 3 parking tickets last year from Brittania parking. He has ignored all correspondence from them. Today he has received a letter from bw legal which states they have been instructed by Britannia parking Ltd to commence legal action. The total they are claiming us £575.37 I believe the car park is one which takes pics on way in and out. The letter is giving me the options to : agree he owes the debt owes some of the debt but not all of it doesn’t know whether he owes the debt disutes the debt. then it’s for income and expenditure forms with it. I do do not believe he has just deliberately ignored the letters. My son had a stroke last year (his 20) which has left him on a lot of medication and problems. I am his appointee now for dwp as he isn’t able to manage. I just wanted to know if anyway could give me some advice or point me in the right direction. Many thanks for your time.
  19. I am the RK of the vehicle and received a letter with a parking charge. I have had two previous PCN's from a long time ago when the advice was always to ignore, which I did and subsequently heard nothing off a host of 'solicitors' that sent out begging letters. I think I'm right in assuming after reading many threads the situation has changed because of POPLA and the POFA?? situation in 2012 says I now as the RK have to disclose who was driving as said I am the registered keeper. My partner was the driver. She stopped in the above carpark, tells me she paid for a ticket after entering the reg number in the machine and displayed the ticket on the dashboard. I asked the better half if she'd maybe just paid for the hour, because judging by other threads you are allowed a 10 minute overstay as per BPA, but she says she paid for 2 hours
  20. Hi Guys, posting for a friend who needs more than my advice to be reassured what to do, she is on the verge of paying these people! Windscreen ticket in a marked bay for council flats, marked bay was allocated to the resident who was in the car, google nosey neighbour doesn't show the flat's car park as it's gated. The driver was giving the resident a lift home with a baby and helped them into the flat and came out to a PCN, there doesn't seem to be a 'from' and 'to' parking time and the driver says she was only there long enough to drop the baby and shopping off and come out, so possibly over 10 minutes. I have scans of the NTD and NTK in a word document with pictures of the car in the bay and the signage which is too high to see from a car, but I cannot make them into a PDF as I do not have the software or the know how and my PC is on it's last legs so I can't download any new programs. Happy to PM the word doc to anyone willing to help, but it's not redacted either so I will trust you! I suggested doing an appeal that the driver was parked in a marked bay allocated to the resident with the resident's permission which trumps any agreement they may think they have.   21. Just received a NTK from these chancers for allegedly Stopping in a Zone where stopping is prohibited. It was near Scun thorpe Football Club. I certainly didnt see any signs highlighting this. I have read numerous posts on here about ignoring however, I dont want any negative marks on my credit file. Any guidance would be appreciated.
  22. Hi I received a Parking Charge Notice on my windscreen on holiday. We had purchased a ticket and displayed it correctly, but it was displayed backwards on the dashboard. I have a pic of how it was which, along with speaking to the next car, suggests it fell forward with the wind as the door closed. Yes, I know we should have triple checked but getting two young children out of the car and raincoats, bags on a miserable wet day we didn't. we now have a £100 charge notice. I have read on forums to wait for a Notice to Keeper (the parking company is member of IPC not BPA). From my research I think the right thing to do is: *Wait for Notice to Keeper, which should arrive by day 56 *Appeal, but do not disclose the driver *Appeal with Independent Agency, as AS parking are likely to deny the appeal Have I got this right? I do feel quite anxious waiting when I have the ticket to prove I paid so am I better to appeal now? IT does clearly state on their signs that ticket has to be displayed correctly, but it isn't a sticky ticket so Im guessing this problem has occurred quite often. I have private plates which I need to put back on my car- will this effect the parking companys chance of getting details from DVLA? Many thanks inadvance for all your help Nic
  23. Hi Guys need a bit of advice please. I got a Penalty Charge Notice the other day from Wirral Council, I popped onto the website to pay but couldn't get the page to accept my details, thats when i notice that they have put the wrong VRN on the PCN. my Reg is DB12*** they have put DB18*** Looking at the VRN they have put on the ticket it doesn't exist with DVLA When i put the wrong VRN details into the Wirral Parking website i can see that they have a picture of the correct VRN but the picture is just a close up of the VRN and doesn't show the vehicle illegally parked. whats my best way round this?? I was going to log on and dispute the PCN under the grounds of the wrong VRN that is on the PCN within the first 14 days and get the inevitable ball rolling?? or is it best to do nothing for now and wait for them to make the next move?   24. Hi all, can anyone recommend who I should structure a PCN appeal given this situation? One half of the road (where I usually park) had its resident parking suspended temporarily for works, so on Friday I parked on the other end of the road. Having returned to my car for the first time today they have re-opened the usual half and suspended the half I was parked in. Because I hadn't been to my car in 4.5 days I had no idea they had moved the parking suspension. My partner and I are absolutely certain there were no suspension signs where they are now currently - we made a point of looking to check both halves weren't suspended. All they have done is taken down the suspension signs on Friday from the first half, sellotaped a new piece of paper on them and stuck them to posts on the other half of the road (I have a photo to prove it). We live in East London, so we have to park 250m away from the apartment to get a residents bay. We don't check on the car and the availability of the bays daily - that would be nuts. 1. How can I structure an appeal to say that I was parked there before the parking suspension signs were even put up? 2. How much notice does the council have to give its residents before suspending parking? Thanks in advance for any advice and support!
