  1. Wow so happy to have found you CAG. Fingers crossed I can beat this. I am devastated, treated myself and a friend to a theatre show tickets were about £7 each. We are both pretty skint and I have now had a charge for £60-£100 quid!!! Theatre Delicatessen (voluntary run theatre) had just moved to the address above when I went to see the show which was on the 24th October 2017. Yesterday 6th Dec 2017 I received a letter asking me to pay £100, or £60 if I pay within 14 days of the date of the letter 29/11/17. (Why have they taken so long to respond but yet I am pressured to pay so quickly just before Christmas and I have two small boys!) The building they have moved into is a retail outlet which used to be a Mothercare outlet. Next door to staples. The show was at 7:30pm. I checked to see if there were any pay and display machines but did not see and other signs (tempted to go back to check where they are) The letter shows registration recognition (but does not show the driver) points out that I stayed 152 minutes and the maximum time of free parking is an hour. I can understand why this is in place as I guess some people could take the mick and go into town but I was visiting a building that the carpark was for and the rest of the carpark was pretty empty except a few others which expect will also have received a charge. I have rang the theatre who sypathetically said that I'm not the only one and that there is nothing they can do about. She pointed out some other places I could park in future and that they have got signs inside the theatre. These were not there when we visited as as it had just opened my friend and I had a good look around. She said they are trying to sort something with the council which is a bit strange as the letter I have had says "Private land" and is from Vehicle control services who are accredited by the IPC. I think I probably ought to call back and ask about this. Could the council have employed VCS. Please can anyone advise me what to to for the best. Should I ignore? Appeal? Contact the company direct and explain the situation? I sense they would not show goodwill. Have I got a leg to stand on??? I look forward to hearing your wisdom I only have 6 days to pay the lesser price if you think I should. Thank you, Gemma:|

Just looking for some advice, recently I asked my work coach at my Job Centre if the worst comes and I do face a sanction in the future while I am on Universal Credit, will my housing element be affected as well, and he said yes, is this true? I thought housing element won't be affected while on a sanction, or his he wrong? I just hope I don't end up on UC for too long, I am aiming to get into work ASAP.
  3. nhs contracts? Hi all, i am now working in the nhs as part of the theatre department and in doing so signed the usual contract agreeing to working on calls, late shifts and weekends etc, the problem is that some staff are not taking part in this arrangement because of various reasons ( my cats scared of the dark or little johnny wets the bed) sanctioned by the managers and therefore the remaining staff are having to work extra shifts to compensate. My question is, are we all being treated equally and do we have any basis for taking action against the management. Any help would be great. Cheers.
  4. I came to return my brother's car and parked on the suspended bus stop which had been closed due to Gasworks mains replacement. Below is my letter to Newham, I have appeal on 18th Jan 2019 and need some guidance. The PCN ….. was issued while the vehicle was parked on the Bus Stop on Plashet Road. Plashet Road was closed due to Mains Replacement work on Green Street. Stukeley Road had notices stating that it was closed from 28th July to 5th October. The works overran the above schedule and I wasn’t aware of its completion until after I was informed about PCN. My brother was replacing carpet at his home and had borrowed by Toyota Previa to dispose off old carpet at the tip in Jenkins Lane. I came on Sunday to replace the car, I parked his little Swift and drove off with my Previa. Later my brother found the above-mentioned PCN on his car and sent me a message. I accept parking his Swift on the bus stop as the bus stop was suspended since the start of the work, all buses were being diverted via Stukeley Road. Had the notices stated the correct date and if the notices were removed after the completion of the works I would have realised the bus stop suspension was removed and not parked the Swift where I did. I will appreciate if you will revoke this penalty as I didn’t park the Swift to cause any obstruction and nor was it intentional. I hope to hear from you very soon.
  5. Hi guys, I've requested a copy of a CCA a while back (all recorded delivery). I sent the £1 postal order, and waited the 12+2 working days for a reply. I never received a reply (after it was tracked - delivered), so I then sent the reminder - 30 days to respond (recorded). That was also ignored and I had no reply, so then I sent the 'Account in Dispute - Section 10 Notice' letter, which ended "I reserve the right to report your actions to any such regulatory authorities as I see fit. You have 30 days from receiving this letter to contact me with your intentions to resolve this matter which is now a formal complaint." I have also not received a reply from this (all letter have been recorded delivered). I'm not sure as to the next steps to proceed? Has anyone been in this situation before? Thanks
  6. Hi, I have been away for a few days when I came back yesterday, I noticed my car was gone. I obviously freaked out and called Police who advised me to call TRACE, I did it and there was no entry on their database about my car. There was no letter, or phone call, email, SMS or anything to let me know that my car was taken by Marston. Not a single notice. For all I knew, my car was stolen. I then called Police back, and they were able to find out that Marstons took my car. I called them immediately and was told that it was due to a PCN issued last year by Kensington and Chelsea council. I have no recollection of ever receiving a PCN there, but I have been to the Chelsea Hospital to support a friend who was 9 months pregnant and feeling contractions. The address and date matches, so it must have been that, there was no PCN on my windscreen, though. I then told them that I have never received any letter from Marstons regarding this, neither before they took the car, nor after. Their reply was that they didn't need to do that because the Council have done it already, and they were given the warrant to control the vehicle, so they went ahead and did that. They said that the Council has sent me 4 letters asking for payment. After speaking to Marstons, I decided to comb my old letters to see if I find any communication from the Council and I found only 1 letter. Sent in October last year, exactly 3 days after my younger brother died, so it must have gone unnoticed by me during that emotional storm. I have sent an email to the Council saying the same thing I wrote above. Got a reply saying they have forwarded it to the Parking team and they will reply in due course, whenever that is. Marston is now preparing the car to be auctioned unless I pay over £600 to recover it. Are they correct when they say they did not need to send me any notice? It doesn't look right to me. I want to pay the PCN, however, I cannot afford to pay what they are asking. I guess the council can intervene but I am not counting on it. There must be a way out of this? Best regards.
  7. Hi there first time posting so please be gentle! I’ve worked for my current company for 10 years now and have a really good non sickness record and have never been in any disciplinary trouble. However on 27th April my employer stated and investigation into me and the team I was leading, after 2 investigation hearings I was suspended on 8th May. The company suspension policy recommends 5 working days suspension however I was suspended a lot longer, finally on the 17 working day The stress got to much for me and contacted HR and asked them for an update, 2 days later I got an invite to a disciplinary. The day before my disciplinary I finally cracked and called the sick line with work related stress and got into my doctors a few days later who signed me off for 2 weeks. My employer emailed me to ask if they could contact me yesterday and that call never came despite me looking at my phone all night however they have called tonight. My emplyer asked how I was but then quickly started to put pressure on me by wanting to know when I would be fit to attend the disciplinary, I stated I have the doctors tomorrow and I would keep him updated as per the absence policy which I have followed to the T but stated I didn’t feel mentally ready at the moment to even look at the evidence against me and I felt I needed to be in a better state of mind to fight this accusation (Gross misconduct charge). I want to fight this and don’t want it dragging on any longer than need be but I have only been off sick less than 2 weeks surely they can’t be pressuring me like this without even getting a occupational health report on me? Sorry for going on but my questions are. 1) Can I be dismissed while off with GP’s note through work related stress? 2) Has my employer acted reasonable in all of this, given the amount of stress it has put on me?   8. im near the back end of my ban and have started driving to work, not ideal but found work and the only way to get there was by car, I thought for the last 5 month of my ban it would go by quick with no problems, however I have had an accident, my fault. so ive had an accident while banned from driving. whats likely to happen ?

CPM 8. Where exactly [carpark name and town] North Middlesex University Hospital, London For either option, does it say which appeals body they operate under. There are two official bodies, the BPA and the IAS. If you are unsure, please check HERE Yes, IAS If you have received any other correspondence, please mention it here NO I went to the hospital for a scan, I thought it would be quick and paid parking for an hour but I overstayed by 33 minutes. When I asked the guy at the Radiology reception, he told me that if I was to go back to my car to add some money to my parking ticket I would lose my place in the queue!! Now CPM wants me to pay £100 or £60 if paid within 14 days. Please advice if you can! Thank you!

  11. Hi all, Im just after some advice…. I am currently in a IVA and when it was accepted allowances were made for my car payment to black horse. To cut a long story short, things have changed rapidly and my income has stayed the same, well it’s actually due to go down and my expenditure is going to rise. This means that I can no longer afford the vehicle that the allowance was made for. Im ok with that, My dad is going to gift me an old car to be able to run, and on completing my income and expenditure form, if I get rid of the current PCP vehicle then I can still afford to live etc and afford my payment to my IVA. I have spoke to my IP and they have said that I can terminate the agreement with BH and the negative debt will be passed on to my IVA as it was taken out before the IVA was accepted. (So I get all that) However…… I have spoke to BH over the last couple of days and they have told me that I must write a letter Voluntary Surrendering the vehicle, drive it to an auction house and they will pass the liabilities to my IVA. BUT. The figure is massive! I purchased a car on a PCP plan for £31,650.98 with zero deposit The total I would have to pay would be £38,207.62 (including balloon) My monthly payments are 47 payments of £455.46 followed by a final payment of £16,801.00 I have currently been in the agreement for 12 months (again circumstances changed quickly due to no fault of my own) So that is £5465.52 I have paid. My current settlement on the Vehicle is £28,846.49 The vehicle is worth currently £24,000ish trade value. They have said I need to Voluntary Surrender the car and my liability is £14093.75 which will be passed on to the IVA. BUT how is this if my settlement is £28,846.49, shouldn’t it be closer to £4846.49? Is this the same as a Voluntary Termination? or is that more expensive/cheaper? Im just a bit stumped how my settlement can be 29k and they get 24k back and still want the remaining settlement including interest when I no longer pay monthly or have the vehicle? I need to get this sorted, as my insurance for the car is due in a week and I do not want to/can afford to insure it. Please advise and thank you in advance Also just to add, as this might change things quite a bit, I received a letter from BH when I did my IVA saying that they intend to terminate my agreement on 27th March 2018 under section 76(1) of the consumer credit act 1974 as I had made a application for a voluntary arrangement.

This company Park direct uk, issued me a PCN while i didnt have time to think to where to park, so i was feeling dizzy and i parked there, and I gave the reason to them, and I'm legally to do so if im in an emergency, and i sent them a appeal and they refused, and this is a private land, can someone help me out please? I attached all the posts that i received from them and what i appealed to them. Many thanks guys
  13. On the face of it, this case appears to be very worrying. A lot is dependent upon what correspondence you had previously received from your council. BUT... If you sent an income and expenditure breakdown to them BEFORE they engaged bailiffs then you should have been considered for an attachment order. Simply not having sufficient income is no excuse for the council to bulldoze on with bailiffs. As others have alluded to, you should now write to the council and raise the point regarding their hasty decision to use bailiffs as opposed to the more logical option of an attachment. It is very important for you to also outline your vulnerability, much of which should be already on their records. I recently endured an almost identical scenario to yours. I had to fight tooth and nail with the council over every aspect. What became clear to me is that they won't concede an inch without a fight.

On Friday 3rd November, while travelling up to Blackpool, around 8pm i was pulled over by Cheshire police, when they did a licence check, they told me that i have been disqualified from driving since June. Something i was completely unaware of. I was subsequently arrested and charged with driving while disqualified and driving without insurance. I was released that evening and had to get a train to Blackpool. Next morning i contacted the DVLA for more information, they told me i had been disqualified through Oxford magistrates court. Being the weekend i had to wait until Monday morning before i could contact Oxford magistrates where they gave me details of the case. A speeding offence took place in December on a vehicle which doesn't even belong to me but belongs to a company i used to work for. They had recieved a speeding ticket, and nominated me as driver using an old address so i did not recieve or know about it. Without my knowedge i was charged with speeding and failure to provide information, i was given a fine and 6 point, which under the totting up procedure i was given an automatic ban as that took me up to 12 points, therefore a ban. I made an application for a statutory decleration and on the 20th November i had to travel up to Stockport magistrates to face charges of driving while disqualified. Due to the circumstances i was allowed to make my stat dec at Stockport magistrates, and the case was adjourned until the 20th Feb and i had the 6 points removed from my license and the driving ban was lifted. I have since resolved the speeding ticket issue, i have recieved 3 points and a fine. Meaning i now have 9 points on my license, but no ban. My question is, should i still be facing the driving while disqualified charges? Because technically, the ban was lifted and removed from my license. I cannot afford a solicitor and i don't qualify for legal aid and i can't use the duty solicitor on the day. Please advise where i stand on this and what are my options. Thank you
  15. Just received a pcn for failiure to comply with a street sign from a London council. The date of the alledged offence was 17/10/17. and the date of the pcn is 12/12/17 is this outside of the timelimits for such service obviously they've got the details from the hire company many thanks in advance
  16. Hi all ... Hope this is the right place to post this. Having lost everything in the recession I then suffered a major breakdown and now have Complex PTSD and fibromalgia amongst other illnesses which are all getting worse. After two years of being homeless myself and my partner were given a council flat. Our neighbours are the local drug dealers and generally bad things happen daily. I now won't go out of the flat at all. I have a pension which I could cash in in 18 months and I wanted to do this and buy a small cheap house. I currently get PIP and my partner gets carers allowance and we get income support which I apparently claim for us both. I don't really understand it all as the CAB sorted it out for us. If I did cash in my pension and buy a house would our income support stop. Also would this affect my state pension when I get to retirement age. Someone told me that we wouldn't be entitled to pension credits. Thanking you in advance for any advice you can give.
  17. Hi all, This is a weird weird situation. I recently found to my delight my previous employer had overpaid salary, basically I was only due (and given) a week's notice, of which I have proof (submitted at the start of claim), and I started my claim for JSA IB and HB at THAT point, yet I now find they paid a month's notice. I was posted a payslip which shows the excess AND with it, a P45 which also erroneously shows my leaving date as if I were given a month's notice!! So, a strange one, I think you'll agree. I have outright proof - a letter from my employer, signed by my line manager - of the 1 week's notice. While I imagine there is little or no way for the employer to clawback the overpayment, I am concerned that : 1) the DWP will now want to clawback the JSA and HB payments made in respect of the excess period; 2) Despite my making my claim in all good honesty the DWP will ask whether I knew of this 'change in my circumstances', and regardless of my answer, question why I did not inform them. I have no past lack of disclosures whatsoever, but as you can imagine, I don't want an investigation in which I have to attend meetings, I already spend too much time in the JC office! Would appreciate advice from those in the know here, thanks.
  18. Thank you for taking the time to read my problem. For the last two and a half years ive been selling virtual items on ebay whilst claiming DWP. A week ago I was asked to attend an interview at my local Job Centre, of which I did and was told by the interviewer that I had been informed on for making money and not declaring it. I told the interviewer I had indeed been doing that and he asked me to bring 3 months bank statements in next week. I went home that same day and printed off 3 months bank statements and as I did so the realisation hit me that I was in a lot of trouble. The over payment is around £8.200.00 My intensions are to be honest and cooperative from the start, so I will go back to the Job Centre in a few days and hand them the statements. I wont lie to you I am very scared and wish I had never done this, but what I need to know is what should I expect once ive given him those statements?. what will the process be?. Is there anything I need to know or do to make this go better in my favour?. The DWP im claiming is carers allowance for my partner. I have never done anything like this before and its realy playing on my mind.
  19. Hi all, First time here so please let me know if anything in this post should be changed. Backstory: I was in Bulgaria on business in June/July and had no knowledge of my PCN before leaving (turns out my mate moved my car out of his drive into the parking area for a couple hours where I received this PCN). Upon arriving home I find two letters, one being a final reminder sent mid June by VCS and then a debt collection notice sent by ZZPS in mid July. As I was out of the country and couldn't access my mail, I had no idea any of this was happening in my absence and had no chance to appeal the ticket in the allotted 28 days. The ticket was for £100, to be reduced to £60 if paid within two weeks and is now at £160 due to the debt collection agency add on. I haven't received any other letters regarding this claim. What I've tried: I have tried to go through the various appeals process, but when searching my ticket ref on the provided websites (namely myparkingcharge.co.uk as noted at the bottom of the VCS letter and the IPC website itself) it comes back with nothing, meaning that I couldn't have appealed it regardless. I even tried POPLA, and they can't find the ticket either. After contacting an ombudsman, they suggested to complain through the companies. VCS said that it was to go through ZZPS as they now were in charge of the debt , ZZPS replied as follows: "We must inform you that you have now passed the time frame in which an appeal can be made as appeals can only be made within 28 days of the Parking Charge Notice being issued, our client maintains that all correspondence received has been actioned accordingly and that the correct procedure has been followed. The balance of £160.00 remains payable on our systems, please refer to the back of our letter for the payment options available to you. In the absence of payment this matter will be referred to solicitors to resolve and further fees may be incurred." What do I do? If none of the appeals agencies even agree that the reference number matches any ticket, has a ticket even been issued against me? The collectors are refusing to provide evidence. I am not exactly inclined to pay this "debt" until the relevant parties prove their claim. Any advice would be appreciated as I feel like I'm about to get strong armed out of £160 Attached are the letters received, along with the website response when I search the reference. Personal info along with refs blacked out for obvious reasons.

Hi there, I realize there are a lot of threads regarding cancelling gym memberships to Xercise4Less floating around on these forums, but I am not looking to cancel my membership, rather, I'm trying to find out if there is any point in me challenging a bounced payment. I have been out of the country since today (7th), and received an email dated from the 6th, saying a payment was bounced due to there being insufficient funds in the account. Now I'm being charged a £25 administration fee, which seems absolutely ridiculous. Should I chalk this down as me being stupid or can I challenge it? I'm out of the country again on Sunday for 14 days, which is past their September 16th date where they want to charge me. Kind regards, Andreas
  21. Hello I live in a cul-de-sac and my house is the last house on the road and I have my own drive at end. Today, I received a PCN code 62 while parked on my own Drive. It states 'Parked with one or more wheels on or over a footpath or any part of a road other than a carriageway'. My car was parked with the back wheels just on the edge of the footpath, something I have been doing since 1988 but for some reason I have received a parking ticket today. The footpath ends at my house, although a neighbour whose garden backs onto my drive has put a small gate in his fence so he can leave his house from the back. What can I do in this instance as I will have problems parking on my drive in future? With the back wheels close to footpath, the back of the car stands over the footpath by a foot or more depending on the car that is parked. I would appreciate any help or suggestions
  22. About a week ago my sister of 24 years of age and my under aged self arrived in London for holiday visiting our cousin,who is currently a university student. Neither of us has any source of income other than their parents and not having a lot of time to save up for this trip made it very hard for us to get by with the money we were given.Yesterday was our 7th day and we thought it would be a good idea to take some presents for back home but without much money it would be hard to acquire them. We finally decided to steal some but of course it was a STUPID idea.We were taken to the room downstairs by a really kind lady.She asked us for our info name,date of birth ,Addres.We contacted our mother with her help and she confirmed everything we told her. She told us a letter would come demanding we pay an unfairly high amount of money which could be 300-400 pound,around 10-15 times the amount of money we attempted to steal.After that she took copies of our ids and we returned home. I was mainly concerned about my mother as she would have to pay the "fine",so I started doing some intensive research and came across this site.Almost in every single case you guys provided amazing support to other members and always advised against paying the money. I know there are a lot of people like me out there but I wanted to know if the fact that I am a resident of a different country would change things.My personal opinion is that it would be even harder for them to do something that would affect me negatively. The security Guard constantly tried to remind me to pay that money and if I wouldn't they could inform the local authorities.I find it really unlikely but I would also love to have some feedback from you about my situation.   23. Hello, I am posting here to see if I can get some advice regarding employment and support allowance. My history is that I currently recieve ESA in the support group and have been on this benefit for four years now with 3 reassessments including my first in 2012. Twice I was placed in the support group after a WCA but after my second assessment I was initially told over the phone I would not get any benefit. I asked the DWP on that call to reconsider and about an hour later they called back telling me I was again in the support group. I am now waiting to find out about my next assessment for ESA and I have some questions. Firstly does anyone know how likely it is that after 4 years in the support group it will be that they can remove the benefit from me? My condition can in some cases improve but in my case it has not and I still attend the hospital regularly 2 or 3 times a year and I am awaiting a further referral. Surely it would be very difficult for the dwp to remove me from a benefit they previously agreed I was entitled to? Also if I am called to a face to face assessment I will not be able to take anyone with me I don't think which I have done in the past, I will be able to get a lift to and from the centre but nobody is free in the day anymore to come in with me. Will not having a companion at the wca be bad for my claim? My last question is on the new esa50 the say not to send any appointment letters. I feel I should send them copies of my appointment letters as it lets them see that I am still being seen regularly by the hospital and have been for some time. I don't have any reports to send and feel it is important to send something. What should I do?
