      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have just decided to repost this - have put it under my original posting but no assistance as yet.

 

I received all statements from Halifax and then a separate letter which relates to my initial first letter regarding the manual intervention - which reads

 

 

"Turning to your request for a list of all the members of staff that have manually intervened on your account. Unfortunately, an investigation of this kind would involve a disproportionate effort and HBoS plc is not legally obliged to supply this information"

 

Can anyone help???

According to YourRights.org.uk ...........

 

If a bank (or similar organisation) responds to a request for details of manual intervention as part of your DPA request by stating that it does not have to supply this - possibly due to a disproportionate effort - then we have a right to view the information ourselves, at the bank's premises....

which has this line of text near the end...

"The data controller can refuse to supply a permanent copy of the data if this is not possible or would involve disproportionate effort. You are still entitled to inspect the information at the data controller’s premises."

 

If this is the case, perhaps you would like to see those files yourself?

 

Quote it to them and ask for an appointment to see them, and see what response you get!! Then let us all know....

Posted 2nd prelim letter for repayment of monies with spreadsheet - on 5th April - received a reply today from Halifax - 7th April - QUICK

 

My letter has gone to Customer Relations and will be dealt with as quickly as possible. Signed personally by Branch Manager!!!!

Called Halifax yesterday to see if anything has been done - the 14 days deadline is today. Took me over 20 minutes to get to the right department - even though I had called the correct number. Spoke to a lady called Eileen - who said the deadline was 27th April. Said no, the deadline is the 19th April - my timescale not theirs but then she started saying they can take up to 8 weeks - advised by the Ombudsman?????

 

Does anyone know if she is correct????

Did I say the right thing and stick to my guns????

 

Before I ended the call i asked her to make a note on my file of todays conversation and I will be sending my Letter Before Action today giving them another 14 days to reply. She said she would!

Asked what i would accept, i said i would knock off the interest so £1,000. She will get back to me. She then offered me £700 which is all she can do!!!

 

Cannot believe it. Lloydsd have made me go to Court - Good on Halifax.

Just to keep you informed, been very busy and thanks for your replies.

Recieved letter - said the amount they offered, then go on to say that it was a good offer and i have refused it. Will not be offering any more.

 

 

 

I am now stuck - where to go now - is it moneyclaim????

Or should I reply to their letter and say

 

 

"Dear sir/madam,

further to your offer of £650-£700 in respect of charges made on my account, I would like to confirm I do NOT intend to except your offer.

Please be aware that if a full refund of all charges is not made by "CANNOT REMEMBER BUT WILLPUT IN" then court action will proceed."

 

Does this sound reasonable.

If the time limit has been reached fo your next action, then yes - move on.

 

Don't forget to add 8% interest to each charge (spreadsheet) andcourt costs to your claim now it has reached court.

Thanks for your notes - I have sent a recorded delivery letter today, reminding of deadline - 5th May - await their response.

Moneyclaim will be done on Friday - 5th May in the evening!!! Deadline over after 5pm!!!!!:)

 

I do agree that i was being a bit generous with taking off the interest but I was hoping to get her to agree to my figure - never hurts to try thats my moto!!:D
