    • Hi All, I don't want to keep asking unnecessary and daft questions but as I read up on on stuff to prepare my defence and tthink about my witness statement, I am perusing the following: The BPA Code of practice states under 13. Consideration and Grace Periods: 13.1 The driver must have the chance to consider the Terms and Conditions before entering into the ‘parking contract’ with you. If, having had that opportunity, the driver decides not to park but chooses to leave the car park, you must provide them with a reasonable consideration period to leave, before the driver can be bound by your parking contract. The amount of time in these instances will vary dependant on site size and type but it must be a minimum of 5 minutes. 13.2 The reference to a consideration period in 13.1 shall not apply where a parking event takes place.   Let's say a motorist spends a minimum of 5 minutes to decide, then decides to park, that 5 minutes now doesn't apply? That doesn't make sense to me. So now that a motorist has parked after consideration, thus commencing the parking period, the decision time doesn't apply and parking time commenced when? .... on entry to the car park? This, as far as I can see is not stated in the [Withdrawn] Government document which says: The Code also makes clear that the consideration period ends at the point when the driver has parked and is therefore considered to have accepted the terms and conditions, which could be within the five-minute allowance. Doesn't say anything about it not applying if a parking event takes place.   [Withdrawn] Private Parking Code of Practice: explanatory document – how was it developed and what will it change? - GOV.UK WWW.GOV.UK So, according to the BPA, if a motorist inadvertently overstayed by 12 minutes for example, they have the 10 minute grace period but because they decided to park, they don't have the 5 minute consideration period because they decided to park and have overstayed by 2 minutes? Sorry if there's something I'm missing here.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

I am a newbie to this site and find it fantastic, there is light at the end of the tunnel!!!

I have requested my bank statements which I went through with a fine tooth comb and a highlighter today and one of my accounts has had £1033 worth of charges between 2002 and now!!! I am still waiting on bank statements for my joint account!

 

I have been reading quite a lot of threads and it seems that very few people from Edinburgh, or who write to Edinburgh for their money back don't seem to get it? Has anyone received settlement in full from an Edinburgh based RBOS??

 

Also the terminology seems to throw me, I hope I get guidance from all you experts as to the legal side of it if the bank does not respond to my first few letters, the first is ready to go, I just need to add on the other bank accounts charges.

 

Another question, is it reasonable to ask for overdraft charges back even although I had signed an extended overdraft application form informing me there would be a charge for this??

I live in Edinburgh and sued through Edinburgh Sheriff Court.

I'm with the BOS. They settled but waited until the day before my court return date. Just to get my goat up! Starting another claim shortly.

I have just filed 2 claims in the sheriffs court in Aberdeen, 1 for Barclaycard and 1 for Marbles. Return date is 16th November so will just have to wait and see what happens. However, i am also claiming from RBS visa, mastercard, my account and a joint account and have sent LBA's to all 4 but so far no response (14 given was 2 days ago) so will be filing in court again for all 4.

I am logding 2 prelim letters to RBOS, one is my own account and the other a joing account, but both have my name on them.

Do I claim for 2 seperate accounts or can I claim these together?

Any help will be appreciated!!

It looks really complicated but it was actually quite easy. I am hoping to file 4 claims tomorrow in sheriff court in Aberdeen, RBS Visa, Mastercard, My account and my joint account about 4000.00 in total.

Got my statements for all 4 RBS, then sent a preliminary letter off to each(template taken from here) . Got a reply basically saying 'sod off'. Sent off LBA's for all 4 (template taken from here again). Got no reply (14 days were up on Mon). Have given them a few extra days, but now am ready to go to court. Will put the RBS visa and mastercard on one claim and my account and my joint as 2 separate claims as they are over 750.00. Best advice i can give is to read all the FAQ's and potter through the RBS threads before you do anything. The more info you have under your belt the better. I found it a little confusing at first but it def gets eaiser the more you do it. And dont be afraid to ask questions even if you think they are daft lol. Anything you need to know just ask, i will try and help, although i'm quite new to this myself. Only started at begining of Sept. But it does work. Have had offers from Barclaycard and Goldfish, although i have not accepted Barclaycard as they will only give me half of what i'm cliaming for, so have filed in court against them and am in negociations with Goldfish at the mo. Good luck.

hopefully waiting on a full settlement, coming through the post, and my lba, is only 7 days in, already been offered more than half, of what i'm claiming for.

 

Have a look at a thread by andrew1, you can search for it. there is a couple of interesting letters on there, and keep me posted of your progress, maybe i can help you through this without the need for court.

Hi Alison, kevin again, don't send any letters, till you have, received something back from rbs, you can maybe follow the route i took, just keep me in the loop with whats happening.

 

ps. I sent my letters, to my local branch, all recorded delivery, kept the receipts, and could trace, when they received them, then i got the fob off letter, from a tommy mclean, thats when i sent a couple of e-mails to him, and i'll send them to you, when the time comes.

Thats brilliant Kevin, thanks for all your help, it definately keeps me positive, I can't believe my charges have mounted to £3343!!! How can they take that much money from people, it is horrendous!!!

I take it you mean no more letters after the prelim letters?
