      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I've been stupid. Until now, I never knew what the words overdraft truly meant, I'm genuinely disabled btw.

 

The RBS have been charging me £28 + interest from about August last year and I need advice.

 

They said in my statements that I didn't need to pay money into my account and now I got told at the weekend that I have until friday to get it clear or they'll take action against me.

 

i owe them £252.31......I just transfered £260 online from my Clydesdale Bank on Saturday and the money was taken off my Clydesdale Bank account today, I emailed Clydesdale Bank to see how long it'd take on Sunday, to get a rough idea when it would clear and they said today that because yesterday was a bank holiday, it is due to enter my RBS account on Thursday.

 

I told the RBS this today over the phone and they said ok, and i told them i have solid proof that i have attempted to pay it off and from next month on i'm in a position to pay £100 a month into my account.

 

In case it's not and action is taken, what should I do? I don't want to worry ma parent they have enough on their plates without their thick daughter getting into trouble with the bank.

 

As a precaution, I have printed off my statement today and also proof that the funds cleared from my clydesdale account.

 

Do I have a right to ask for these charges back once they clear? I definately can't afford to pay it off tomorrow as I don't have enough money in my account to do that without overdrawing on that too.

 

I'm 24, never been in trouble with anyone

 

Help!

thanks for the reply. i have contacted the financial obsman by email and i am going to send their form 1st class recorded delivery and hand in a letter to the bank today. hopefully they will reply asap cos i didn't like the way i was fobbed of on the phone at their 0845 phone number.

robbing swines!! I just found out that they have added in another £28 + £5.68 in Interest!

 

Looks like it was added on after I got off the phone to them yesterday as no-one said that it was added in :mad:

Lonely, don't be so hard on yourself!

 

There are plenty of people in far worse financial states than you - it is very easy to do and is not a measure of how thick you are. I myself ended up with a £1500+ overdraft TWICE that I couldn't pay.

 

It sounds as though you have sorted things by paying the money into your account so fear not. Even if the money isn't in by Friday, I doubt very much that RBS would be so quick to react. I am confident that this letter is a demand which is intended to stir a response, but can't imagine that they would immediately do anything on Friday.

You should be able to go through this process yourself using these guides.

 

 

Be aware, that at some point over the next few weeks, the RBS will charge you again because you are currently overdrawn. Ensure you have enough money in your account at that time so that it doesn't go overdrawn again otherwise you will be in a vicious circle of clearing your overdraft, charge sends you over overdraft, clear overdraft etc etc. You are well within your rights to ring the bank and ask what date the next charge is coming out so you know when to put the money in by.

My complaint about bank charges

 

I would like to register my complaint about the charges that have been applied to my account from August 2006 to 8th May 2007.

You’ve been charging me unlawfully I believe since August 2006, and as of today, Wednesday 9th May, I owe you £282.31, it was £272.31 but I paid off £20 last week and I have attached proof that I am making an effort to pay it off. As you will see, my Clydesdale Bank statement clearly shows that between fund transfers and standing orders there was money taken off my account on the 26th April (£10), 1st May (£10) and finally the 8th May (£260 + £10), 9th May (£25.00), all of which are destined for my RBOS account.

 

I have attached copies of the Fund Transfer for £260 along with emails

that proved when the money was to be paid into my RBOS account.

 

When I opened this account, I never agreed to an overdraft and neither of

your staff discussed one with me when I opened this account with you.

 

As I stated over the phone on Saturday 5th May and then again on Tuesday 8th May, I’m now in a position to pay back in £100 month until the end of June and I'll do this via Standing Orders of £25 a week. From July, I’ll be paying back in around £200 a month.

 

What I would like you to do to settle my complaint is give me back my

money which I am more than entitled to ask for.

 

If you need more information from me, you can let me know when you contact me to confirm you have received my complaint.

 

I understand that under the FSA rules you should send me a final response within eight weeks of the date you first received my complaint.

I can see what you are trying to do and I commend the letter but I am sure you will not get anywhere with this as they will simply tell you that their charges are acceptable and they will not refund you anything.

 

If you wish to confirm the money that is going in, then do that in the above letter, but as for claiming back charges, I don't think sending them a letter like the above will carry enough weight for it to be successful.

 

I would suggest you have a look at the guide I gave you a link to as this offers instructions on how to claim ALL your charges back and also provides template letters that you simply print off and send.

 

 

 

 

As for your overdraft.....If you are £281 overdrawn and are sending in £260 this week, that will leave you £21 overdrawn, so why do you need to send them £100 a month for the next two months? Are you expecting any more money coming out?

Lonelygirl....they're getting the response from you they want....to intimidate and frighten you so they can make bigger profits.

 

In a school playground this would be seen as bullying!!!

CONFIRMATION OF PAYING BANK CHARGES I OWE YOU

 

I would like to confirm that I am paying back charges I owe you. My account number is xxxxxxxx and sort code is xxxxxxx.

 

I owe you £282.31 in interest and charges, it was £272.31 but I paid off £20 which made it £252.31 last week and I now see you added on another £28.00 charge + £5.68 interest yesterday!

 

I have attached proof that I am making an effort to pay it off. I think Can was referring to you saving money with them when they've been taking money off you!

 

 

Just to clear things up, the letter is great - send it off and you shouldn't hear any more from them.

 

Once your account is back above zero, you can start the process of getting your charges back.

i won't. i plan to contest it after it gets clear and then that way i know i'm ok!

 

surely they can't take action now they have written confirmation + bank statement to confirm i have paid it off

 

just now upto the RBOS to accept the money i guess!

Everything will be fine don't worry.

 

There are a lot bigger fish for RBS to fry than you.

 

The letter is a bog-standard letter they send to promote a reaction - which they've got. Can't imagine you will hear any more from them.

lol, yup some "customer service" they have!

 

Letter was sent at 4pm 1st class recorded delivery so here's hoping that is the end of the matter and i can now look forward to focusing on getting my money back cos technically speaking they overdrew by their money and not mine but i still had to pay!

hi folks

 

just a wee quick update - £260 that I sent on the 5th is now clear today, as well as a Standing Order of £10 that came off on Tuesday the 8th. A £25 standing order that came off yesterday morning as well as an extra £15 that I sent last night is still to clear.

 

Not heard back from the bank regarding my letter but my status is now I "owe" them just £15.98!

 

You bet I'll be looking to get all of my money back when this clears within the next few days so surely to god I'm ok now! :D

As of now, my account is in credit, RBOS can do absolutely nothing now as I officially paid it off. Bring on £25 a week back into my account plus the challenge of getting my money back, wohoo!

 

Will need people's help and will be asking loads of questions over the next few weeks. I will start by sending a letter on Wednesday asking for all my statements between June last year and upto this month.

still no letter back from the Bank, been 4 days since I sent the confirmation that I am paying it off and I hoped that was proof enough blah blah. I'm assuming that they can't be bothered to reply as they can't do anything to

me now!

 

Still enraged they charged a further £28.00 + £5.68 on the 8th after I got off the pone to them.

 

This will be fun trying to work out exactly what they owe me, it's definately over £300 now anyway!

Just to reiterate something from a previous post, because you have been overdrawn recently, you will be charged soon for it. Because you are now in credit, ensure you have enough to cover this charge, else you will go overdrawn again, leading to another charge.
