    • Thank-you dx for your feedback. That is the reason I posted my opinion, because I am trying to learn more and this is one of the ways to learn, by posting my opinions and if I am incorrect then being advised of the reasons I am incorrect. I am not sure if you have educated me on the points in my post that would be incorrect. However, you are correct on one point, I shall refrain from posting on any other thread other than my own going forward and if you think my post here is unhelpful, misleading or in any other way inappropriate, then please do feel obliged to delete it but educate me on the reason why. To help my learning process, it would be helpful to know what I got wrong other than it goes against established advice considering the outcome of a recent court case on this topic that seemed to suggest it was dismissed due to an appeal not being made at the first stage. Thank-you.   EDIT:  Just to be clear, I am not intending to go against established advice by suggesting that appeals should ALWAYS be made, just my thoughts on the particular case of paying for parking and entering an incorrect VRN. Also, I continue to be grateful for any advice you give on my own particular case.

    • Yeah, sorry, that's what I meant .... I said DCBL because I was reading a few threads about them discontinuing claims and getting spanked in court! Meant  YOU  Highview !!!  🖕 The more I read this forum and the more I engage with it's incredible users, the more I learn and the more my knowledge expands. If my case gets to court, the Judge will dismiss it after I utter my first sentence, and you DCBL and Highview don't even know why .... OMG! .... So excited to get to court!
    • Yep, I read that and thought about trying to find out what the consideration and grace period is at Riverside but not sure I can. I know they say "You must tell us the specific consideration/grace period at a site if our compliance team or our agents ask what it is"  but I doubt they would disclose it to the public, maybe I should have asked in my CPR 31.14 letter? Yes, I think I can get rid of 5 minutes. I am also going to include a point about BPA CoP: 13.2 The reference to a consideration period in 13.1 shall not apply where a parking event takes place. I think that is Deception .... They giveth with one hand and taketh away with the other! One other point to note, the more I read, the more I study, the more proficient I feel I am becoming in this area. Make no mistake DBCL if you are reading this, when I win in court, if I have the grounds to make any claims against you, such as breach of GDPR, I shall be doing so.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Nationwide are not liking this claim for excessive unfair bank charges are they??

 

My husbands very short story goes like this :-

 

Wrote prelim to Nationwide on 19th April (downloaded it from the BBC financial website)

 

Got a letter from the monkeys dated 20th April reading :-

 

At the time you opened your account you agreed to abide by the terms and conditions clearly setting out how accounts should be operated.

 

Charges are applied to a members account when the account exceeds its agreed overdraft limit or a payment is retuned due to insufficient funds. We notify you of the charges incurred, on your monthly statements and charges are debited from the account 28days after the statement is produced. We'll try wherever possible to help you manage your account but it is ultimately your resbonsibility to ensure funds are available to cover these charges and any further payments that are due.

 

After careful consideration of your request. We're sorry that we cant agree to your charges being refunded. Only in exceptional circumstances do we refund charges and on this we feel it would be unfair to other members who find themselves in a similar situation and whose charges still remain, We realise that our answer will disappoint you however we trust we have clarified the society's position.

Also, have you used the spreadsheets to calculate the interest you will be claiming (applicible from when you file at court)? I would advise doing this sooner rather than later, becuase it can take a while to work out, especially depending on how much experience you have with spreadsheets etc.

Today (30/04/07) we posted off the LBA to Nationwide, Recorded delivery to assure they can't deny getting it of course. 13 days, 21 hours and 15 minutes for them to reply lol. ;) I'll be very impressed if I even get a reply to be honest so we're keeping up the effort and planning the next step already. The N1 awaits eager vengance now. Will keep you informed if anything happens in the mean time.

Makes sense to start planning the next stage Lisa because it is very unlikely that NW will reply to your LBA,and even if they do, it will some pre formattted letter that will probably say more or the less the same things as their original fob off job.

As per our expectations really. I had no thoughts of mugging the postman in the morning anticipating a letter with something nice written upon it!Anyhow, this is a pretty much redundant account these days as we have opened a joint account elsewhere so if they get on their high horses and close the account, it's no real loss. We'll keep fighting until the death though, nothing ventured...nothing gained eh?

Right well today we have checked the Royal Mail recorded delivery thingy mabobby and it showes that the LBA has been recieved by Nationwide. We shall sit tightly for a reply :-D

Agreed Lisa but I doubt if they will send anything back.

 

So it might not be a bad idea,if not done already, to read up on the the MCOL process as this is where you may well end up.

yeah...we will end up at N1 stage, i'm filing this manually as I am on benefits and understand that I may be able to an expemtion. we are off to the local court on Tuesday to pick up the necessary paperwork and obviously reading as much as we possibly can on this site. Its been such a great help to us!:D

Hi Lisa...

 

Ive filed my claim via the N1 route.. if you go to the bank templates library then particulars of claim - N1 - hard copy version the form to fill in is there with help in how to fill it in.

 

Also I am in receipt of benefits and filled in form EX160 which you can find on the HM courts service website.. you can fill all these forms in online then print them off.. saves having to go to the court just to pick the forms up.

 

Please make sure when you do file your claim that you have a letter dated within the last 30 days confirming which benefits you are on.. I made the mistake of going to the court to file my claim but taking a letter dated January this year and they wouldnt accept it.

Hi there julien35 I will certainly take your advice on your post!!! Much easier to dowload and send off application then to go there fill in and send back.

 

I shall dig out some letters to confirm that I am in reciept of benefits. im not sure if I have any dated in the last 30days tho.

Its 14 days straight! including the bank holiday HoooooRaaaaaaaaaaaay! Its the same as the bank....when they say they are taking the money in 14days they mean 14 days. Give them not an inch to spare as they will waste as much time as possible. Race you to the next stage hahahahah! :cool:

This is my husbands account we are doing at the moment, then i may do mine and we had a joint account which is now closed but i wonder if we can do that too?

My other half hasnt used his account for 6 months and the nationwide took him into an unauthorised overdraft and have been charging him the pleasure ever since. I am looking forward to getting my own back.:D

Glad I found this forum though as it can be a little daunting at first

I shall watch your thread with anticipation of what will happen to me a few days after each stage!!!

This nationwide account is my husbands too, same scenario not used for 6months and is overdrawn because of their charges! Yes u can claim on the closed account as they have to keep records of it all but when you win your claim you will be paid by cheque! Nationwide claims can be paid out within a month of the prelim letter but that depends on how lucky you are. We have started to look for 4leaf clovers and lucky rabbits feet LOL :p

Hi again Lisa..

 

If you cant find a letter dated in last 30 days you can ring up the benefits office.. tell them you just need a letter confirming you are on benefits as you are filing a claim in court and they will send you one out.. thats what I did..

I'm just about to do N'wide for a smallish amount. I got £2,000 from HSBC last summer. Just keep going and you'll get it. I've opened another account in case N'wide close mine. I opened it because of the HSBC claim and just because a new DD claimed on the wrong day they rejected it and charged me £30. I wrote (recorded) to claim it back saying I was very tight for cash and badly needed a sight test and specs which that £30 would go toward. They told me to f off. Utter t...ts.

We tried to arrange to pay back the unauthorised overdraft Nationwide created!! They didnt want to know at all said that 'they were sorry we were experiencing financial difficulties' and basically f off like you said. This was before we discovered you can reclaim your bank fees.

I just find it mad that we offered to sort out a problem THEY created and they still said no!:-x

So now I feel very justified in claiming back our money THEY took

well I have heard from NW and I have came to the conclusion that they are having a laugh....why do I say this? Because the story goes like this.

 

Your complaint has been sent to us by the Branch Services Centre. We've just recieved the papers and will be reviewing them as soon as possible. Once we've finished, we will write to you with our findings.

 

The Financial Services Authority (FSA) allows us 8weeks to investigate before you have the right to ask the Financial Ombudsman to review your case. This ends on 18 june 2007, and we expect to be able to reply to you by then if not sooner.

So, by this time I am well P!55ed off. Another fob off letter and delaying tactic so on Monday the 14th May I am filing the N1 claim, see how they like that. Not alot most probably but it has to be done. Rant over. Back to being a nice person. Wonder how the halifax claim is going on? hmmmm. Will have a look.

I have read about this reply from Nationwide in another thread. Someone quite rightly replied that you havent asked them to investigate your case!!! It is yet another stalling tactic they use ( I suppose they are needing new ones all the time) in the hope that someone perhaps less informed than ourselves would wait the 8 weeks.

You get that N1 in on Monday! I will let you know if I recieve the same letter as soon as i hear something

Well Lisa we recieved exactly the same letter this morning from Mr Daniel Gay! All about FSA investigating etc and 8 weeks finishes on 21st June.

Unfortunatly for NW I will still file on 21st May as planned although i have decided to talk to the FSA about my own bank account and charges as I now have their number thanks to the letter!!!
