      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

i sent my S.A.R - (Subject Access Request) off to RBoS, cheques cashed and statements recieved today, however i have a loan with them and none of this information has been included, i also know this loan is default (now with DCA) should they have sent my default notices?

 

Should i write to them requesting all the information that they hold on me?

 

i also notice on my statements that they have charged me 2 x £30 for default notice fee??? i have added this to my spreadsheet to claim back and charges come to just short of £1200.

 

The fight for my money back begins.

Unless you implied on the DPA that it was specifically for your bank account it should have been ALL the information that they hold on you.

 

If your DPA suggested that you only wanted information on a specific account then I suspect you will have to send them a new DPA requesting everything they have.

i have a quick question, my balance on this account is £1850ish, and i am claiming £1200 back, the account is default, as the majority of the debt is charges could i ask for the default to be removed in my prelim letter?

Yep, thats right, 16th April they signed for the prelim so i'm working on the 30th being the deadline.

 

Thanks to everyone for their help so far and not just with the RBoS.

Checking back on everything i realise that in my SAR i asked for details of my bank account and also Loan, they provided the info on my b/a but not on my Loan, do i need to send them another SAR? My first one was sent and signed for on the 21st March and the cheque has been cashed, or should i send them a letter reminding them that the SAR is incomplete and that thier 40 days is nearly up?

Deadline was yesterday for both S.A.R compliance and also Prelim, so i now send my LBA for claiming my charges back but what about the non compliance for the S.A.R? i did send a reminder to them last week as what they have sent me so far is also incomplete!!........

 

Any advice is greatly appreciated.

no reply to either my SAR non compliance or my LBA :-x next step court, but what about the non compliance?

 

i have a feeling that they haven't sent me the info relating to my loan because they dont have it anymore (if they even had it in the 1st place), can i get round this by sending them a CCA if so which address should i send this to?

ok i CCA'd RBoS for my loan agreement as they didnt send it me with from the S.A.R request, but something is not right with the paperwork they have sent me, lots of info on it is wrong, like my employer and the date i started work this them, my phone number, the date i moved in to my current address etc. also i am going to claim back my PPI as i believe this was mis sold.

 

Can any advise on CCA?

emailed Sandy Watt yesterday who replied to say that an offer should be with me in the next couple of days. i replied requesting that my refund (once settled) be in the form of a cheque as the account i had with them is in dispute due to the agreement not being signed by either party.

 

will report back on what their offer letter contains.

letter recieved this morning offering me the full amount in full and final settlement :D . Stumbling block being they want to pay it into my account which is closed so they want to credit it to my loan account, as this is in dispute following CCA request should i write back accepting the offer but stipulate that the payment must be in the form of a cheque due to the dispute?
