Hi all - my claim with RBoS is continuing (took a while to get the court fee). I've received their defence, which seems pretty standard. Does anyone know whether it is essential or advisable to reply to the defence?

 

Haven't been sent the AQ yet by the court.

Their standard defence is usually very predictable.

I presume they are saying you have not properly particularised your claim bla bla bla.

 

If you have followed guidelines on your N1 Pocs and included all account details as well as supplied the defence (or their clients) with a schedule of charges that clearly show what you are claiming,then this should be adequate.

You can send a further copy of your schedule to both the Court and defence upon allocation.Also note the draft order for inclusion.You can read more about this in the allocation notes in the bank temps library.

I suggest also reading up on other current threads in this forum.

Keep an eye out for any new information that may be relevant for your own submissions.

Hi Guys - thanks for your help with my threads.

 

This thread is probably outdated now, since I rang the court who told me the AQ is the reply to the defence. I submitted that, then got the offer including 8%. My other thread regarding that covers my questions about this.

Perhaps a mod can merge them for you - I'm sure if you want that to be done then they will do it if you ask nice enough! :)
