Hi

I have submitted the N1 form to the court, and RBS have until tomorrow to say if they are defending or not. However they have today made an offer of refund of charges minus the contractual interest that I am claiming for.

Should I refuse this offer, or will court think I am being greedy?

Only you can answer that.

 

Ask yourself how badly do you want that money and is it worth it?

 

Me... contractual on mine over the last 6 years could be worth a good part of a holiday due to bank greed and my woefull mismanagement. But my prelim not even in yet as not got all statements yet so maybe in a couple of weeks I might be the one asking that question too.

The court might refuse to give you contractual but as long as you have calculations for 8% handy, the courts will probably agree to that instead (if they do refuse contractual that is). They could however agree to you having contractual. All in all it is possibly worth it however as sosii said, it is a personal decision.

What is it they say? Aim high?

 

Go for contractual, the worst that can happen is you'll get 8% judicial.

 

I won (by default) with contractual and have instructed bailiffs to go in.

Hi Red1, we are in a similar position with my sisters claim with BOS,

they have refunded all of her charges and the interest on them, but are disputing the 8% contractual interest. We are continuing to persue.

Hi Red 1,

 

Refuse the offer! The interest is yours by right...your money would have earned that amount had the bank not taken the charge. MBNA owed me £550 in charges...the interest came to £590...they paid £1160 in the end. Good luck!
