    Default Court Bankruptcy Question?

Can anyone offer any advice on a court claim please. Bank of Scotland, court date set, court letter sent to us and it is saying have we sought permission from the previous bankruptcyicon people in order to make this claim. I am making the claim on behalf of my mother and stepfather (he was made business bankrupticon one year ago). BofS have already settled on the actual business bankrupt account! and we are now claiming on a seperate personal joint account - what is going on?

Who is actually asking the question - the court or the bank?

How did the previous BR come to the attention of the court?

The Banks solicitors put it into the defence, personally I think they have paid out on the bankrupticon business account (which they settled on) by mistake (got the paper work mixed up perhaps) thinking it was the personal joint current account (which is at court at the moment), perhaps they still think that?

I think the sticking point here wil lbe that they never actaully paid the charges as they were written off in BR.
AFAIK if the bankrupticon is discharged then they have no obligation whatsover to tell the trustee, but it may worth a call to getthis clarified.
