      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well the battle has started.

After taking a week or so to read through the site I now feel ready and willing to take on HBOS,my Consumer Action Group stickers arrived this morning so they were promptly fired onto the waiting letter to the bank which I handed in person to the branch.When the girl saw the letter with the stickers she smiled and said "another one of these" I look for to seeing how quickly they will reply to me

Just off the phone to HBOS the girl has told me that NO bank charge is unfair and the Bank will never refund any of my money as the Bank has done nothing wrong.

WHO DO THEY THINK THEY ARE ???

If I wasn't determined before I am now to get all of my money back no deals no way

Start yourself a NEW THREAD on the HBOS forum.

Have you had a thorough read of the FAQs so you'll know what it is you are undertaking? And read a few of the threads on the HBOS forum it'll give you an insight into what to expect as your claim progresses.

Today is now day 40 for Hbos to give me the information that I have asked for,they have however cashed the £10 check on the 4th of October!!

What should I do next ?

Any advice would be gratefully received

I waited the 40 days for my statements to arrive from HBOS and nothing,phoned the branch told someone would call me back that day heard NOTHING,went into branch next day told they had no record of me asking for the statements,when I asked "then why did you cash my £10 cheque on the 4th of October if you never received my letter,which I handed in person" reply "If you want we can order them now for you but it will take up to 40 days,but don't worry you don't have to pay the £10 fee we'll wave it on this occassion"

At this point I was ready to explode and only just managed to keep it together

 

Has anybody else been treated like this??

Hi Mark

 

First of all did you do a DPA SAR and also did you get a receipt for it and the £10 fee?.

 

If you did then its time you sent a LBA for non-compliance and report them to the ICO and see if that gets them moving.

 

Also can you now start your own thread in the HBOS forum and use this from now on for any questions you may have.

 

This is the welcome forum and for first posts only and you will get more help from others with your bank.

Have finaly been given bank statements from hbos,they owe me £2800 without any interest being added.My question is as I live in Scotland do I have to split this amount into several smaller claims with no one claim being more than £750 or do I just send them the standard letter asking them for my money back.

imo i would send prelim and lba for the full amount, and when claiming split the claim.

HBOS seem to be taking me serious now.

I did have to wait 48 days for them to send me my bank statements going back 5 years,when I informed them that I had just reported them for failing to meet the 40 day limit things really started to move.I received a phone call from the Branch Manager saying he would look into what happened and 2 days later I received 3 identical sets of statements.

Next day I gave them the request for payment letter and the next day I have received a standard letter saying sorry for your complaint etc will forward your letter to Customer Relations.

Hope this pace will be maintained but somehow i really doubt it.

Together we will do it!!!!!!!!!!

You've defianately taken the first step into claiming back what's rightfully yours.

 

Spend time reading the FAQ's and the Step by Step guide as this will stop you making mistakes along the way. Use the letters and spreadsheets in the Templates Library as these have all been tried and tested in successful claims. Read as many threads as you can especially ones that relate to your bank. This is a SELF HELP site and won’t do the work involved for you. However, everything you need is on here somewhere.

 

Don't be afraid to ask any questions, no matter how stupid they may seem, but please remember that any advice that you receive is normally based on experience only and that you should seek expert advice if required.

Just off the phone from my branch trying to get a £35 charge back as one of my direct debits wasn't paid on the 21st as I didn't put the money into my account untill 4pm on the 21st,30 mins after the cut off time!!I was £7.47 short.

Was told they would would refund the charge but only after I signed a form saying that this would be a FINAL refund and I would be unable to claim in the future OR for any that may have been applied in the past to my account.

It is my intention to pay the £35 charge and maintain my right to claim at a later date,I just wanted to draw this to the attention of our members,has anybody else been asked to sign this form?

This saga is going from bad to worse with hbos,it took them 51 days to produce my bank statements,now 16 days have passed since I gave them the preliminary letter.

Phoned them today to ask what was happening,also asked if they were taking me seriously as I am deadly serious about the whole thing.Was told someone would be in touch soon but no definate date or time scale given.

I have already reported them to the info. commisioner for time it took them to produce my statements,is there anyone I can report them to for this latest failure on thier part.

I had to wait 51 days for my bank statements to be sent(yes I did report them) and now I have been waiting 17 days for them to reply to my perlim. request letter,I have phoned the branch to be told that the department that is dealing with me will be in touch in time.

Yep, i have and it is absolutely appalling - i even got a snooty letter!

 

Just report and follow all advice here with regards to reporting them, maybe send them one more letter with say 7 days to furnish you with the details - i did that and magically they all appeared within a couple of days special delivery!

Me too. Phoned head office only to be asked why i thought they were acting illegally. Well, how about stealing my money for a start! Was also told that if i had managed my finances better i wouldn`t be in this situation.

Hi thereSorry to hear about the treatment you are getting from HBOS. I personally do not deal with people over the telephone now; I always write a letter because I then have a copy for my file. I sent my SAR at the beginning of November and hadnt received anything by this week; no confirmation of receipt etc., I sent another letter reminding them that they had 40 days within which to reply and that time was running out. I received a letter saying I would have all my information by 16th December. Yesterday, I received my statements for 2 accounts from 200-2004. I've calculated already that they owe me £2650 and that's without including maintenance charges!!!Dont let these people speak to you the way they have been doing. When somebody speaks to you like that, ask for a name and send a letter reporting them. Its not up to them to pass judgement; they have no right whatsoever to ask why you think they are acting unlawfully. You are only asking for your details which you are allowed to do in law. If they dont provide them they are acting unlawfully. I used to take this type of behaviour but the worm has turned!!!! Hope this helps and good luckAnnie

It is important to set the timetable, and stick to it. Deal with everything by letter, and send everything by recorded delivery. Once a deadline expires, then move to the next stage.

 

Banks try and delay paying out as long as they can - it is only by keeping the pressure on them that will eventually force them to accept that you mean business.

here is a brief summary of where I am now with hbos

1. requested 5 years statements fri 22nd september

2. 50 days later finaly got them (yes I reported them)

3. fri 10th november sent perlim.letter

4. no word from bank until 7th december after 4 calls to bank

5. bank phoned me at home saying that they have just ordered my bank statements so that they can check my figures and this will take a further 14 days,after which they will make a decision on my claim.

My question is should I allow them the 14 days as a gesture of goodwill or should I just move onto the next stage of my claim ie the letter before action.
