      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well, here goes. I've got my postal order, printed my S.A.R - (Subject Access Request) letter and I'm off to the post office in about 5 minutes...

 

So I guess the 40 day countdown begins when they get the letter and it'll be interesting to see what they do - from reading some of the other threads on here they seem to be masters of the delaying tactics.

 

I'm really looking forward to having something to donate to the site when I get my money back!

WON at LBA with compound contractual interest £607

 

RBS BF Account S.A.R - (Subject Access Request) sent 4/11, part response rec'd 28/11, further info sent 3/12 awaiting statements at 20/12, Sent LBA 19/01/07. Received all statements resulting in 3 claims, £1,278, £4,279 and £7,250(!) all with contractual interest.

Well, I got my copy statements for both the RBS Mastercard and the Tesco Visa card. The charges actually don't add up to anything like as much as I thought they might (seems I wasn't such a bad girl with these cards after all - it's going to be Nationwide who've charged me most!) but it's still a total of £205 on the two cards so intend to see this through...

Right, I've been through the statements and listed the charges on my spreadsheet (thanks Vamp) and I'm going to senf off my Prelim Letter asking for repayment of £240 tomorrow. It's not big money but it'll be interesting to see what their reaction will be...

I got standard bog off letters from both RBS Mastercard and Tesco Visa which said something like 'we do not accept the findings of the OFT in respect of credit card fees' and that it was 'your non-compliance with our rules that ended up in the charges being made'

 

Do I now hit them with an LBA? If so, do I submit one claim for both cards as they're both issued by RBS or treat them individually as I got separate responses from the two card companies albeit at the same address!

Hi I would put both card claims together providing they don't go over the top of what the court allows on one suit. But on your spread sheet put each card figures seperately showing a grand total at the bottom.; I have done this on several occasions and it worked out fine and saved time. Best of luck

My LBA is going off to them tomorrow, it's not a huge claim but it's MY money and I want it back!

In response to my LBA, RBS have made me an offer of approximately 25% of the amount I am claiming. They have said that they will repay this to the account (which is closed so that would be pointless anyway) and if I accept it will be full and final settlement.

 

Of course, I have no intention of accepting but do I need to write to them and decline or do I simply go ahead and start my MCOL claim?

I would write them and tell them what is what and if you do not receive full payment by (the day you set) you will be happy to meet their representative in court and it will increase their costs considerably. Good luck
