      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

I went into my local branch this morning to ask for a refund of £30 that I was charged when a DD of £1.50 put me overdrawn.

 

Now just so you know the full picture since September last year I have paid approx £900 in charges because I keep going overdrawn on two personal accounts. I have been trying to sort my finances out and I have been earning extra money to try and keep up but to little avail at the moment. But this charge above was the last straw.

 

The £30 was refunded but a note was put on my account that no more charges were to be refunded.

 

If I go ahead and ask for statements for the last six years and then follow up with the letter asking for a refund because of this note now on my account will they just laugh me away ?

 

I have asked the bank for help in the past to put the two accounts together but they said they wouldn't. If those charges hadn't come off them I could have been paying my overdraft back.

 

If anyone could answer my question I would appreciate it.

You don't say if you're with BOS or RBS?

RBS don't usually put a note about charges on accounts (I've never seen it done in branch) but we can look back 12 months and see a list of how much (if any) was refunded each month. If the manager sees you've had charges refunded before then they're less likely to agree a refund, that's pretty standard.

 

Also you'd benefit from reading the faqs on this site, but to answer your question yes, they are still unlawful and you can still claim them back. Follow the help on this site and you will get your charges back.

Thanks for replying. I'm BOS and this is the first time that I've had charges refunded. The teller I dealt with said that they only refunded charges if there had been a bank error of some sort. She went away to speak to the manager to see if the charge could be refunded.

 

I've had a look through the site and using your advice and the information on the Govan Law site I'll be applying for my bank statements and then asking for the charges to be refunded.

 

Nice avatar by the way V for Vendetta is one of my favourites pity the film looks as if it will stink.

depends what its for...

RBS has at least 4 different "unlawful" charges:

Maintenace Charge (being overlimit) £28

Referal Charge (paying a DD etc when there isn't enough money for it) £30

Card Misuse Charge £35

Unpaid Item Charge £38

 

HBOS will be similar I'd imagine

It's been a while.

 

I've done my calculations on what charges have been levied against my accounts and I just need clarification on a couple of things.

 

1) What address do the letters to the Bank of Scotland go to ? I've looked at the contacts thread and am not sure if I send the letter to customer relations or not or to the Head office either in Edinburgh or Halifax.

 

2) Should I include interest as well as all the charges and list everything in an itemised Excel spreadsheet listing
