Ey-ho

 

Been away from the PC for a while and I mean a while but I have some challenging news from RBS.

27th November I recived the following letter from a Mr Waseem Raja:

 

Thank you for your recent letter dated XXXXXX, your concern has been passed to me in my capacity as Senior Concerns Officer of the Debt Recovery Office.......

.........

We believe that our charges are fair, reasonable and transparent. We consider that the amounts debited to your account have been applied strictly in accordance with your agreement with us and our published tariff which we are satisfied complies with all applicable laws and regulations (T & Cs enclosed)........

...It is not our policy to refund late payment/overlimit fees that were charged previously at a higher level at the time that the fee was incurred.

Consequently, against the background we must differ with the views expresed in your letter an will not be refunding any of the charges applied to your bank account.

 

...... and I trust this clarifies matters.:confused:

 

Taken aback, well, i actually coward back into my shell and have continued making payments to the debt recovery plan as normal (never did stop).

 

But I had a look at the balance again and these fees add 8 months of payments to the balance and I'm really aggrieved by this.

 

So help is needed as to the direction one must take.

My aim is to reduce/remove all my debt with my creditors but they are not polaying ball with the charges here:mad:

Barclaycard:S.A.R -17/10/06:Statemenst rcvd 28/10/06. Prem request sent for £380 31/10/06: Offer to credit £128 to clsd A/C: Offer rejected and claim continued 07/11/06:x Settled Nov 2006 :D

CitiVisa:S.A.R -17/10/06.Rqst for ID rcvd. 23/10/06 ID sent with cheque 31/10/06:Statments Rcvd 20/11/06. Prem letter sent 20/11/06 Settled Nov 2006:D

Hi

 

Which letter did you send them to illicit that response?

 

If it was the LBA then now you need to issue a claim against them for the return of your charges. If it was the preliminary letter, then now you may send your LBA and then, if you do not receive a full refund, you need to issue a claim.

 

Finally, this letter is in fact perfectly standard, do not be put off by it.

iGroup (GE Money) - AoS Filed late, defence late, amended defence also late despite extra time requested and granted.

Vanquis - Claim issued, no AoS or Defence received

I don't think it really matters what their 'policy' is...RBoS told me in November it was now their 'policy' only to examine claims for charges if they were 'marked on statements and not just listed' (as per our spreadsheets).

 

Needless to say it's being ignored.

Hi All

 

I've found a very good web site with lots of good info on it, it's called penaltycharges.co.uk abd is run by among others a guy called Stephen Horne who took the Abby for £5000. He's been on BBC Radio 2 business slot at about 5.30pm and he has got quotes and reports from the BBC's Money Program that should prove interesting. Hope this helps.

Well I have sent the LBA this very afternoon for Mr Raja and will see what direction the case takes over the coming weeks.

Prior to this the Prelim Letter had been all that i had sent which drew that response.

You should also explain your policy to RBS which is to wait a aximum of 4 weeks only after which time you begin a court claim and there are no execptions.
