    • I've been on this site for eight years and I haven't seen one PPC case where a DCA turned up at the motorist's door. Even if they did they couldn't do anything, but in any case it's never happened.     • thanks I’ve not used this website before haha is the DCA the furthest they’d take this case? didn’t know if there’s a step up as they are affiliated with the FA. im clueless with this sorts of stuff so as expected it concerns me and would your simple advice be to simply ignore even though we’ve had a physical lettter through from soccersixes themselves 
    • a DCA is NOT A BAILIFF and have  ZERO legal powers on ANY debt - no matter what it's type. moved to the gyms/Health clubs forum. not sure where you get the idea that any ole debt passed to a DCA gives them some magically power to make it appear on credit files..

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have just realised that the initial DPA letter I sent to Abbey, re the Abbey credit card, has now exceeded the 40 day limit, with no response. This hasn't happened to me with any of the others. I will phone and report them to the information officer tomorrow, but just wondered if anyone else has come across this?

They replied to all my letters but i sent the normal letters not a DPA request and was for normal banking accounts and not credit card. The more they do wrong though the better your claim (once you know how much they owe you)

I am worried that I have sent to the wrong address. I have sent to the Abbey card to the normal billing address, but I notice that it is actually owned by MBNA.

I'll see what the data commissioner guys say tomorrow. Thanks.

I really hope you havent sent it to the wrong address. This would cost you a further 40 days. Any normal company would have forwarded it on. Abbey obviously dont need an excuse cus there s..t!

No, I didn't! Five other banks just sent me the info anyway, and Alliance and Leicester asked for the £10, which I then sent. Can they just ignore me, then? Shall I start again, sending the £10?

Sorry to tell you this, but yes they can!

 

Same happened to me! The 40 day clock does not start ticking until they get their £10 fee!

 

Suggest you send the DPA again, to your branch, recorded delivery and enclose a cheque or ask them to take the money direct from your account, stating the fee is £10.

 

I think it will cost you about £2.50 to send first class recorded if the cheque is enclosed or about £1 if no money enclosed.

Damn! Thanks then. It's not an Abbey account, it's the credit card. I'm not even sure I have the right address, but will look into it, and let you know. Thanks again.

I would send all paperwork to the registered office address off on of your credit card statements.

I too have an abbey credit card which is run by MBNA - if you look in the 'other institutions' section, there is a section called MBNA and all the details are in there, my thread is in there too, so you can have a look if you like,
