Can someone clear this up please, I have an RBS account in England , sent DPA letter etc, and heard nothing, when I called the branch I was referred to the head office in Scotland, is this ok? my branch did nothing with the letter and I seem to be getting somewhere with Head Office,

Can someone please tell me what the liabilities are if my claim is being delt with over the border ? When I submit Court Proceedings, I will be doing so in England because that is where my account is based and I live. Is there any difference please ?

Scottish born and bread stay here ......so trust me on this keep in England ......don't think of trying in Scotland these are the limits and exclude interest.... the limits are small claim up to £750.....Summary Cause £750 to £1500 Ordinary Cause over £1500 and you need a solicitor and guess what ? You WILL NOT get any ......the banks have a contract with the solicitors ........along the lines of

do work against us you don't work ever for us again

I'm a bit further along the trail but this thread has started to get me worried.

Basically I have an account in England however all my paperwork has been forwarded to Scotland. The deadline on my LBA has expired so I am just about to file a court claim. I entered the address (which is in Scotland), from the letter they had sent me letter confirming they had recieved my correspondance, into MCOL and it said it could not deal with claims over the border?

Please tell me I haven't dropped a clanger!?!

If any of you have found anything more out I'd be interested to know.

stivis, you've dragged up a post from April last year and caused a bit of alarm with some slightly off the mark info....

It doesn't matter what the rules are in Scotland as the OP and jonat are in England, it doesn't matter a hoot who has been writing to them.

Tommy MacLean & Customer Relations are based in Scotland and they are the bunch dealing with all of this.

IT HAS NO IMPACT WHATSOEVER ON YOUR ACTION!

They will merely attempt to delay you somewhat and perhaps, if you're lucky, make you an offer that may or may not resemble your actual claim.

When it comes to claiming you should use your branch address if that's in England or this one if you prefer

What I'm telling you is that the fact that TMcL is corresponding with you from Scotland does not impact your case. If your own address is in England and you have an address in England for the bank (which you do - either your branch or the Litigation address above) then your claim is under English Law in the English County Court - be it MCOL or your local court.

My branch is in Scotland, but I live in England (and have never actually been to my branch as my old branch closed). Will I be able to issue proceedings in England?

you have to issue against your branch, however if that branch is now closed you could probably issue proceedings against the Princess St address in London.

I understand that I will be issuing against my branch but the question for me is in which jurisdiction? As I live in the deep sarfff I don't want to have to trek up to a court in Scotland because my branch/account is up there.

First off, best place to start is just by sending all letters to Customer Relations in Edinburgh, attention either Sandy Watt or Tommy McLean.

Start with the SARS, add up the charges, then the Prelim, then the LBA. (If you have all your statements just jump into the prelim)

IMHO, if your claim is for under approx. £1500 they will probably settle before you issue a court claim anyway....seems to be the trend however I probably just jinxed my second claim there!

When I claimed, I didnt even bother with my branch, just went straight to Customer Relations. (Branch is in Essex)

Settled first claim within a month and half.

Just read thru all the threads, read the step by step and start your own thread. loads of RBOS claimers here to help you out. AND GOOD LUCK!

Your address is in England and that is the important part. Use the Litigation address in London for MCOL.

By all means correspond with Customer Relations but I wouldn't bother with Sandy Watt as apparently he is a temp and has no actual decision making authority (his own words - from another thread)
