I recently opened a contract with T Mobile, and I decided that I wanted the direct debit to come out of another account, so i filled in the details and sent the form of to T Movile. My billing date was on 31/3/06 and i sent the form of a few days before that but t mobile did not recieve it until 3/4/06 and on the same date they decided to charge me for non payment.

 

They have charged 24.50+vat, are they allowed to do this, seeing as the banks are not? do i have a case

 

Any help is always appreciated

The basic principle making bank and credit card charges unlawful should apply to anything like this.

 

I don't see why it should be any different, although the wording on a mobile phone contract may require a slightly different approach to claiming back the money.

 

I'd be interested in the outcome because I've had a few charges from T-Mobile recently.

Hi - normally companies will ask for a minimim of 2 weeks notice of change to payment details (especially if correspondance is by post) mainly because the company has to inform the bank on your behalf which can take up to a week and once that has been changed the BACS payment must be ready to go 3 days before its due in the bank - if you only gave the company a couple of days to organise the change then I think the charge will stand as they have probably been charge by the banks themselves (although I doubt it would make a dent in their profits).
