I called up the payment line to claim back my surety fee today after my vehicle had b


een clamped by the NSL on behalf of the DVLA for no tax.

 

I was told I had until yesterday to claim it back.

It was stated in the leaflet i was given that i had 15 days to claim. Today is the 15th day, but the payment centre said yesterday was the 15th day.

 

I had my car clamped on Tuesday 29 January.

Today is Wednesday 13 February which is exactly 15 days after my vehicle was clamped.

 

I am awfully distressed about this as i desperately need the refund. What can i do? Where can i take this?

Please could you explain what this surety is. How does it work? How much is it?

 

Maybe you could point us to the leaflet or posted up here in PDF format

From that leaflet:

“How to claim a refund of the surety fee

Produce a valid tax disc to either the vehicle pound or a DVLA local office, within 14 days of the vehicle’s release. After this period, you will lose the surety fee.”

 

It says 14 days, not 15.

it also says “from vehicle’s release”:

when was it released?.

Yes, that's my reading as well. But also I'd like to know about the surety. The leaflet you've given this is a DVLA leaflet – so this may be a DVLA rule and not an NSL rule.

 

Who does the money go to? Who decides the figure?

Here is what the surety means: "You can pay a 'surety' (deposit) if you don't tax the vehicle before you get it released. It costs £160 for cars or motorcycles, and up to £700 for other vehicles." Then it says: " You must get your vehicle tax within 15 days and contact the vehicle pound. After this period you will lose your surety fee"

Sorry, but we need attachments but up in PDF format – and certainly if any files at all should be presented the right way up so that it is reasonably easy to read.

 

It's very hard work trying to help people on this forum and we do expect people to help themselves a bit.

 

Please will you post up the document in the way that you would like to have it presented to you if somebody asked you for help.

Also, I gather the basics of the surety but you haven't really said anything about where the money goes, who decides the figure, is it a DVLA requirement or is that an NSL requirement.

I think the surety is set by DVLA. I expect that it goes to DVLA although maybe NSL get a cut. https://www.gov.uk/get-a-clamped-or-impounded-vehicle-released

 

However, as far as I can see that if there is some misunderstanding as to the 14/15 days, then you have to take it up with DVLA.

 

If we could see the up-to-date document then we might have a better understanding

Thank you. I am still searching. The DVLA do not have it on their website and nor do the gov. website - they have everything but. I have found a few people linking to a download of it on the gov. site but the page is not found. Very suspicious. All i have is my hard copy! Still searching

A) By the fact the surety has been paid, the OP will also have paid for the clamp to be released. The OP was asking about getting their surety back.

 

B) Even if the clamp was still on, if the OP uses force to remove it, causing damage, and gets seen to do so : how does getting a conviction for criminal damage help the OP?
