Hi,

 

I'm just looking for some general advice on how I should tackle some defaulted debts I currently possess.

 

I left the United Kingdom (British National) in January 2017 and relocated to Sweden where I now intend to live long-term. As part of this move, I brought along with me a personal loan with Tesco Bank and a credit card with Barclaycard.

 

Both of these accounts have since defaulted and I am currently in a repayment plan of 25 pounds per month - this is for both accounts. The outstanding balances on these accounts are:

 

Barclaycard - 1,825

 

Tesco Bank - 8,525

 

As I am no longer a resident of the United Kingdom, and it is highly unlikely I will be for the forseeable future, what powers do these two companies still possess in potential debt collection?

 

I have also recently spoke to Barclaycard regarding a potential settlement deal - they returned with a partial settlement offer of 50% (912.50). I am awaiting the written confirmation of this settlement offer before I pay, yet I still have doubts if I should actually agree to this.... what do people here think? It did not take much effort (a ten minute call) to be offered this settlement figure.

 

I apologise if what I am asking for is a little muddy... I just need to make sure I am tackling these debts in the best way!

We are very happy to talk to you about the enforceability of these debts, but if all you are asking is whether or not you can avoid paying because you are out of the jurisdiction and you don't think they can reach you, then I don't think that this is a discussion we would be prepared to get involved in.

I can assure you it is not my intention to avoid paying these debts. I actually found Barclaycard's offer to be quite reasonable, particularly as a first attempt, but I wanted to check out their enforceability and if this is the right move to make...

 

I have already reserved 912.50 pounds to clear this debt.

First. Make sure you update them with your current address. Then close the account with them and offer a repayment plan or a settlement offer. You may have to speak to a manager about the latter.

 

They're obliged to help. And usually do if you're making payments to clear the account at a decent rate.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

if you took the credit out after apr 2007, odds on it will be enforceable, as they can use reconstructed agreements.

though ofcourse there is in all reality little they can do to you where you are.

 

are these both with the original creditors still, or have DCA's got their mits on them?

who are you currently paying.?

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
