The car was stopped for two minutes on an area of the car park marked as no parking. The driver didn’t switch off the engine or get out of the car

Surely in these circumstances, the driver didn’t even have the opportunity to read and accept the T&Cs, so cannot be deemed to have accepted them. Therefore, in law, surely no contract can be deemed to exist?

Also, it appears that the NTK was not issue within 14 days

As youve said, if the NTK wasnt recieved in 14 days, theyre stuffed. Of course, you dont tell them this. You ignore and let them dig a big hole for themselves if theyre stupid enough to try court. Then you can claim for costs and make THEM suffer.

You can safely ignore for now. Theyre stuffed. The NTK fails on a few things.

For now, relax, go take some photos of the signage if possible as well. Just to have more things to throw at them when theyre at the bottom of that hole theyre digging.

2 things, if it says no parking then that isnt an offer of a contract to park. Seciondly, if they thin it is an offer to park then the 10 minute grace period applies.

Would be good to see piccies of the sigange at the site as I bet there are further problems for the parking co. Anyone stupid enough to make such a demand will be too dim to get anything elese right.

WHEN it is time to formulate a response I would be recommending that you tell them they are too too dim to go anywhere with this.
