This is the second case from the OFCOM bulletin and starts at page 78

This case is (in my opinion) more serious than case 1 in that NO consent was obtained. Also it has disclosed that the Body Worn Cameras transmitted live audio/video to the film crew. The BWC were supplied by the production company so all copyright material belonged to Channel 5 rather than DCBL.

Read that one after the first case. Channel 5 are on very shaky ground and are still falling back on a tired and discredited Public Interest defence. I am of an opinion that by going in with cameras rolling theymight well breach GDPR if there is NO Signed Written Consent obtained from the victim, as they are filming in a private residence with no prior warning. There is also a serious data Protection issue with the BWC worn by the DCBL Muppets as Ch 5 own them and therefore the copyright of the footage.

 

This was definitely worse as there was NO Consent obtained.
