Hi,

I've searched and searched for an answer to this and can't find it. I'm hoping someone will be able to help.

Under JSA if you won an employment tribunal you had to pay back any JSA received from the award. But if you settled 'out of court' you didn't have to pay back the JSA from the settlement amount.

Does the same apply to UC? Or would a settlement 'out of court' be classed as earnings?

Thank you.

Back pay is deffo classed as earnings and can screw up other entitlements, not sure on compensation from a Tribunal, but if it was substantial it might take someone over the savings limits. They are so tight bet if someone won £20 at the bingo or a scratch card and were to tell DWP they might class that as income and deduct from UC.

We could do with some help from you.

Couldn't agree with you more re the scratch card!

I've already found out the hard way about back pay, ssp, tax rebates and others being classed as 'earnings' because of the date they were paid to you. Not the date you earned the money.

I suspect due to how draconian UC is, it will be classed as earnings. UC is 1% of the welfare budget (ONS figures 2017.) The savings in comparison to the total welfare budget are so miniscule it's a joke.
