I wonder if they have planning permission for those signs? Also in an earlier post it was mentioned about GDPR and shop assistant passing on photo. I would suspect that shop assistant may have been paid to pass on the photo and they are not registered to do this so maybe the extra income has not been declared to Inland revenue? Mentioning this to shop assistant may put them off taking any further photos and also maybe mentioning that person who took photo will be called into court to verify that they took the picture. :-)

Could tell the shop assistant that makes them a Data Controller and are they or their employer registered with the ICO, if the assistant is doing it not as part of their contracted duties they could be regarded as a data Controllere and will be reported to ICO. Might scare them a bit.

We could do with some help from you.

Now, this may or may not put them off wanting to waste more money but you can use it in evidence that you have communicated with them over the matter and eventually if enough people make complaints to the SRA about Gladstones abuses they may get ordered to stop or lose the right to practise.

NowI would go a bit further thanbrassnecked and say that the shop assistant doing the snapping is actually self employed in this role as it is nowt to do with petrol station and not employed by parking co so needs own registration with ICO for data handling. Knowing who actually owns the garage would be useful if you do want to go down this path

I was thinking on just those lines EB, is assistant being paid anything by Parking Co, if so they as you say would be self employed and HMRC might be interested in such emoluments.

  • 5 months later...

i'd resend the same letter

thanking them for the Letter of claim.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

let them know that you have already told them to go wind their necks in so they should dig out the last letter to read your response rather than wasting paper on another threatogram.

I would also phrase it just like that, being nice wont stop them from losing their client money in the vain hope you will suddenly wet yourself and pay up
