Hi all ,

I left Australia almost 5 yrs ago very quickly due to a family emergency .

I had a car loan a credit card and possibily personal loan .

I thought at the time I cleared them all .

Now this week the I received a letter from a UK based solicitor acting on behalf of an Australian debt collector asking g me to pay 10 k back .

 

I do not think I even owe this money . I probably do owe something but I can't imagine it's that much .

Citizens advice have told me I can send a letter requesting more information on the debt without actually acknowledging it .

Any advice would be very useful on this matter .

I have a mortgage on my property now and will all this affect my credit rating in the future ?

Plenty of threads on here that are the same as yours. Have a read. And relax.

 

You certainly don't want to be sending any letters. They'll mark you as gullible.

 

Who is the creditor. Who are the sols. How much are they chasing.

Thanks for your reply I have read some and I can never actually see the outcome .

The creditor is complete credit solutions Pty in Australia and the solicitor here in the UK is Steven drake .

The figure is 10k in auz dollar .

 

That's for the advice I will try find the other threads and have a read

you don't see resulted threads as nothing happens and people never bother to comeback and update us so.

What happened with 1 case reported on CAG, was that Stevensdrake issued a UK court claim and then backed out at mediation stage, when they realised it was not that straightforward. Even if they won in court, if the debtor does not have the means to make payments enough to cover costs, it is never worth it.

 

Safe to ignore for now. Always read letters posted to you. If you actually receive a court claim from the courts ( which is doubtful), then make sure you acknowledge to defend the claim. Obtain advice about best way to deal with it. You don't need a Solicitors, who will want to charge you a silly amount, if you can find any interested in foreign debt issues.

Rent a sols like that, only ever chase debts they think they can gain a judgement by default on. It would cost a fortune and be very complex to chase. Then theres the whole jurisiction issue and you cna pretty much guarantee no rent a sol is experienced and confident in all that

Thanks for the replys . Steven drakes have now sent a second letter asking me to make payment or complete and income and expenditure form .

Should I acknowledge or just ignore ?

for want of side info.

 

its VERY easy to go BK in AUS for almost if not TOTALLY free all from the UK

 

several have done it here with success..blows them all straight out the water.

. Do I need to acknowledge this or what is by best course of action .

I have had my first letter in months from Drake's telling me what my outstanding balance is in British pounds. .

Is there a reason  they would send this ?

The reason is that they want you to give them money. . .  You know what to do!
