My lender has a suspended possession order that through my own stupidity I have allowed to default and they have sent me a notice of eviction. The eviction date is the 27th September.

My arrears are not for a massive amount

I would like to know if just paying the arrears would stop the eviction

. If so would I need to pay the amount that the suspended possession order is in arrears or the total amount of the arrears.

The suspended possession order is £600 in arrears and the total amount of the arrears is around £2000.

If anyone is able to let me know I would be incredibly grateful

Regards noel

The lender is Natwest. Not sure how much are for fees. Never knew they were unlawful.

If I was able to pay the total amount would that force them to stop the eviction or would I still have to go to court. I suffer with anxiety and the last time I went to court I was sick in the courtroom

Hi, you would need to pay the total amount and then if there are no arrears at all there can be no eviction. However, you may still need to make an application to the court to stop the eviction if you can't persuade Natwest to cancel the eviction when you pay all the arrears.

Are you able to pay the whole amount well before the eviction date?

I can probably by the whole amount before the eviction date but it will be close. I could pay the amount that the suspended possession order is in arrears on Thursday. If it's very close how old would an arrears have yo be to count. My next payment is due on the 23rd so would that be added as Well?

You would need to pay everything that falls due before the eviction date - if you can, pay something straight away then write to them by recorded delivery stating you intend to clear the arrears in full by such and such a date. If you need help with the letter let me know. You might be lucky and they cancel the eviction, but don't hold your breath - I think you will end up applying to the court for a hearing to stop it. This is why it's important to make a payment and follow with a letter - that way you can show the judge you tried to stop further action, proof of payment and letter means you can ask the judge not to allow Ascent to apply legal charges to your account as the action was unnecessary.
