For anyone facing court action regarding this car park, be advised that Excel parking is deemed to be the Creditor .. the legal entity entitled to enforce parking charges and legal action. Excel have a contract with the landowner. Any legal action launched by VCS is not relevant in law as they have no contract with landowner and are not the Creditor. They are a separate legal entity. If you are facing court action from VCS use this as your defence.

I have had a look at the car park earlier and all the signs use Excel with no mention of VCS though I am fortunate never to have had a ticket form there recently to see if

VCS are still trying to use up some of their old stock.

NOT sister companies, merely companies that are controlled by the same person, there is no legal tie between them and that is why they lose claims of this nature. If VCS was a subsidiary of Excel for example they can assign the agency within the group.

They are kept separate because that way simple Simon Renshaw-Smith can remove large amounts of cash out of one of the companies and not threaten the liquidity of his whole empire. If there was a tie between them as they often say there is in court then they would be in breach of Companies Law and that would place simple Simon in the same bracket as the "parking gurus" of north London.

 

 

This is something everyone should watch out for with certain companies though, VCS/excel, CEL/Starpark and a dozen similar named others to name the 2 sets that cause the most trouble

Thanks for pointing that out .. very important to know, especially if you're facing court action by VCS when Excel are the Creditor and operator for the car park. They will maintain that VCS are the operator and Creditor but will have no contract to back this up. Be sure to request a copy of the contract with the landowner if you're facing court action.
