Much is written here about the Consumer Protection Act. (Formerly SOGA)

 

What action can one take against a company who refuses to honour their obligations under this act??

 

As I understand it,

under CPA regulations,

a retailer must act within these Regs when things go wrong.

 

The seller has the choice to

1. Repair the item.

2. Replace the item with a similar item. or

3. Refund all monies paid for the item.

 

But can you force them to act ????

Yes you issue a court claim on the basis of failure to comply with the CPA...once you have judgment...you can enforce it in the normal ways.

We could do with some help from you.

Have discovered today, that Trading Standards, in this area at least, don't speak to the public and can't now help.

Referred to UK Citizens Advice, who can only advise.

 

They have no powers to force traders to conform to the laws of this country.

 

It appears there is no public body operating who has fiscal powers over rogue traders

----and they say crime doesn't pay !!!!

 

So, what is the point of having the consumer protection act ????

So you can refer to it and rely on the legislation to use it in your claim against them...as per my previous post....along with Consumer Protection from Unfair Trading Regulations 2008 and the Consumer Credit Act 1974 as amended

 

The Consumer enforces it by way of judgment.....
