    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

It says on the form in Section 1 it says the following: If you want to pay for a 48-page passport, put a (X) in this box, what does this mean? Is this normal / standard passport? and should I put an X?

https://www.gov.uk/passport-fees

do you want to pay for the standard number of pages, or do you expect to travel so much that the standard number of pages will get filled up with visas / entry stamps before the passport's validity runs out and it'd be worth you paying the extra to get a passport with the extra number of pages?.

If you are asking lots of basic questions and not using e.g. google to help yourself as well, I'd suggest you would likely benefit from the 'check & send' service, to make sure you haven't made an admin error on your application.

Looking at their website, a standard passport is 34 pages and a jumbo one is 50 and costs a bit more. I imagine the larger one is for people who travel a lot, maybe on business and expect to have lots of stamps and/or visas in them. I've had my passport for three years and have travelled within Europe, but I don't have a single stamp in it. I guess that could change once we're out of Europe, but even so I's think a normal passport should be OK.

Is the person in section 2 you? Certificate of naturalisation is generally for people who weren't born in Britain, I think you said that you were?

Here's a link to the Passport Office website, or I would think the Post Office would be able to advise you.

it is not rocket science that FRAUD in this world is all around us, important checks to see if the application is genuine (entitlement) and not abuse, birth certificates, parents entitlement (UK Citizen) etc etc the number of false applications and fraudulent cases in the past has brought this about, you think this country ask for too much = try many Asian countries applications??? just calm down and take a breath, otherwise one would wonder why are they panicking - that will throw suspicion up???? FACT?? just read the news every week and see the Immigration fraudsters, 28 caught in my small area in the last week (all steemed by non UK original citezens), and most weeks more in the news>

Your actions could cause concern? but take a step back and just do the best you can, - supply what you can to clear any doubt.

I am panicking because I am worried my holiday will be delayed, maybe I am been a bit paranoid. I should just calm down as people keep saying that I will get my passport way before January arrives.

Update: I have rang the registration to check the status of my parents birth certificate and marriage certificate and the lady who I spoken to, she said that they will arrive at the beginning of September because she also said that they is a bank holiday coming up, do you think I got plenty of time before January? as soon as I get them, I can send my passport foam off ASAP.

Yes. It usually takes around 6 weeks. I very much doubt it will take 3 months. If youre still unsure, just pay for the express one and go to a passport centre and wait for them to do it there and then

I don't know where you heard that.

In your case, given that you're applying for a first adult passport, have to provide extra documents and are struggling with the paper form, I would stick with a paper form and help from the Post Office.

I have been told it's way much easy ordering a passport online instead of a foam, is this true?

Dont know where you heard that. You still have to provide the same information and attend an interview.

You didn't tell MSE you were having trouble with the questions on the form though, did you? That's why we suggested using the Post Office as it seemed less stressful for you. It's entirely up to you which way you go.

It's a shame that you didn't do some research before you booked for Benidorm, as the Passport Office specifically says not to book to travel until you have a passport.

Hi, I thought I would post here instead of creating a new topic.

What happens before a few weeks of my flight?

will Thomas Cook post my boarding pass for the airport to check in when I arrive at the airport?

or do I need to print it out?

I don't have a printer, but got a new PC.

And when do I get my boarding pass?

Any advice would be great, thanks :)

if they have the automated terminals

I think you can simply show the QRcode or the barcode of your booking in the email you get from TC on your phone screen to their reader and off you go

if not the desk will or some offer printing for you depends on the airline

or use a friends printer or a local library to print

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi Silverfox1961

- Thanks for that and sorry to hear about your mum.

Can I ask, did you have to sign for your passport when the courier arrived?

I am just worried as I am starting back in work next Wednesday and I just hope I don't have to sign for it.

Last time I renewed my passport I didn't need to sign for it. They sent it by special courier, he put it through the letterbox, then took a photo of the front of the house showing front door and door number. I guess they use that as evidence it was delivered to your address. I'm sure that somewhere on Passport office website you can find if that's still how they do it.

This is covered by the passport fee. If a signature is required, and you're not at home when the courier tries to deliver your passport, they will leave a calling card for you to arrange delivery at a convenient date. ... If your passport is being delivered by Royal Mail, you will need to sign for i

Anyone can work this out for me?

I returned back to my job one of the policies is that we have to do a security search (this is to check if we have stolen any clothes / items)

- Now, this is where I am confused,

today we they a search and one of the security men searched me and he scanned me down with one of them long things but when he went down to my jeans it started going off when he got to my leg, now I don't know how this can happen?

he even said that's weird unless the scanner he was holding is faulty? and before anyone says this, no, I got no metal plates in my leg and never had an operation,

I am getting worried / paranoid now, will this be an issue when I arrive at Manchester Airport in January for my holiday to Benidorm?

will security not let me on the plane?

Its starting to bug me now and I am worried :(
