Motorbike manufacturer refuses to make key. 3k damage?

I have a problem which involves 4 parties.

The police, my motorcycle manufacturer, an airline and me.

 

My motorcycle broke down in Europe.

I had to take a flight back to the UK, paid and organized for by the AA.

 

On the flight I took with me one of my motorcycle cases.

In it was my photography gear.

Worth around 2-3k.

The case was locked for security.

The key I had to leave at the garage in Europe where my bike got fixed in the mean time.

 

I had asked the airline for the option to have the luggage sent as a fragile item the day before the flight.

The lady on the phone assured me that that this would not be a problem and I just needed to tell the flight attendant at the check-in and it would be safely delivered, and separately from the other luggage.

 

I did that. The flight attendant confirmed this and sent me with my luggage to this special check-in.

 

All good.

 

At the airport in the UK I had to realize my luggage came with the other luggage and not on the special conveyor belt for the fragile luggage as I was told it would.

 

I reported this to the airline luggage issue desk...

Where they told me that they won't even take my claim because I can't open it.

Nothing was done at all.

 

They then gave me a phone number where they told me that they won't do anything because the airport personal is responsible for that....

 

After literally several hours on the phone the result was that I didn't get any help what so ever.

 

I then went home and made an online claim at the airline website.

To which I never got a response.

 

I then contacted my motorcycle manufacturer to have a spare key made.

This is where there all trouble Beginns.

 

My motorcycle had been stolen last year.

And since been recovered in February.

 

The manufacturer claims that in their database it is marked as stolen.

Still. After all these months.

 

They told me I needed to call the police and have them update their records and have a liaison officer tell the manufacturer that the bike isn't stolen anymore.

 

I called the police where they told me they had updated their records in February and that's all they do.

And that the manufacturer is utterly wrong and the police absolutely does not contact anybody and it is completely preposterous to claim they would go chase after private manufacturers and tell them what vehicle was stolen.

 

I have since spent literally 10 hours on the phone being sent back and forth from the police to the manufacturer, both claiming they aren't responsible.

 

One person, the first guy i dealt with on the phone from the manufacturer, told me that there is a certain "retain group" which keeps these records for the manufacturer and their records show it is still stolen.

 

I have also called the DVLA where they gave me a bit more information, saying that there are indeed companies which collect this kind of information.

These companies update their records every once in a while.

And apparently the one my manufacturer is using has not updated theirs.

 

The police said they aren't giving this information to anybody but the DVLA.

 

The DVLA said these private companies get their information from them.

 

They also said they checked in two different databases of other private companies where the record was updated.

Only this one company seems to not have updated theirs.

 

Meanwhile there was a deadline for claiming damage to my luggage.

This deadline was 7 days.

I have been in limbo for 3 weeks since my trip.

 

The deadline has passed.

 

There may potentially be 2-3k in damages in that case. Which I still can't open.

 

I have already paid for that key too, yet I still haven't received anything, and the manufacturer doesn't give a flying...

 

Not a single attempt of them was undetaken to resolve this situation.

I have threatened them with my lawyer several times.

They don't care.

 

Every single time I call them they tell me I need to update the police that my vehicle isn't stolen anymore.

Which is absolutely infuriating as you can imagine.

I am close to going mental.

 

What can I do?

 

And who will pay for my potential damages?

 

I will eventually get my motorbike back from Europe and then get the key.

 

But this may still take two weeks.

And then there still is the question, who will pay for those potential damages?

 

In my opinion the manufacturer is responsible.

They very obviously have an issue in their database which they are not willing to correct.

Because of them that deadline has passed.

 

I would very much appreciate any quick help.

I'm really desperate.

There is absolutely nothing I can do.
