    • In terms of "why didn't I make a claim" - well, that has to be understood in the context of the long-standing legal battle and all its permuations with the shark. In essence there was a repo and probable fire sale of the leasehold property - which would have led to me initiating the complaint/ claim v SPF in summer 19. But there was no quick sale. And battle commenced and it ain't done yet 5y later. A potential sale morphed into trying to do a debt deal and then into a full blown battle heading to trial - based on the shark deliberately racking up costs just so the ceo can keep the property for himself.  Along the way they have launched claims in 4 different counties -v- me - trying to get a backdoor B. (Haven't yet succeeded) Simultaneously I got dragged into a contentious forfeiture claim and then into a lease extension debacle - both of which lasted 3y. (I have an association with the freeholders and handled all that legal stuff too) I had some (friend paid for) legal support to begin with.  But mostly I have handled every thing alone.  The sheer weight of all the different cases has been pretty overwhelming. And tedious.  I'm battling an aggressive financial shark that has investors giving them 00s of millions. They've employed teams of expensive lawyers and barristers. And also got juniors doing the boring menial tasks. And, of course, in text book style they've delayed issues on purpose and then sent 000's of docs to read at the 11th hour. Which I not only boringly did read,  but also simultaneously filed for ease of reference later - which has come in very handy in speeding up collating legal bundles and being able to find evidence quickly.  It's also how I found out the damning stuff I could use -v- them.  Bottom line - I haven't really had a moment to breath for 5y. I've had to write a statement recently. And asked a clinic for advice. One of the volunteers asked how I got into this situation.  Which prompted me to say it all started when I got bad advice from a broker. Which kick-started me in to thinking I really should look into making some kind of formal complaint -v- the broker.  Which is where I am now.  Extenuating circumstances as to why I'm complaining so late.  But hopefully still in time ??

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I think we are all in agreement that running it for the profit of others is not the way forward. As said I am sure there are bad employees but yo make a measured assesment you would need the full history. It is never right tobtreat someone with a lack of respect but we are all human. Who has never lost their temper or become frustrated with uncooperative officials

The biggest problem with the Providers is simply that imost of their staff are unfit for the role - they have no experience in or background of acting as a recruitment advisor. Nor do most have the skillset and experience to properly identify educational and training needs.

 

One Advisor threatened to sanction me when I was on JSA because I turned down a work trial as a Chef.

 

The gentleman I dealth with was such an expert in recruitment/training that he. Believed my Food Hygiene certificat meant I was a qualified Chef!!!! Back in reality however what that certificate actually means is I can work in a food preperation factory or in kitchens washing dishes.

 

I am on ESA at the moment and still attend the local provider. They keep trying to get me agree to let them tamper with my CV of which they have only seen a hard copy (I refused to sign either data protection waiver)

 

I used to be a graphic designer and regularly typeset CV's for customers so my CV is looks Professional and also reads professionally thanks to the recruitment specialist at a company I worked for.

 

I have seen the cv's the staff at my provider produce and they are awful and totally unprofessional.

 

I believe they keep badgering me for an electronic copy and to sign the cv data waiver because they have seen how professional mine is and also know (as I told them)) that my my CV exists as a heavily formatted/typeset MS Word document/template including customised "styles". I believe they want the digital copy so they can copy my document to use for other clients as They do not have the skills to reproduce my CV as the ones they produce clearly show.

 

The document is my personal copyright/intellectual property and I have absolutely no intention of letting it be ripped off.

Good for you. While I was with BTCV many moons ago, they latched on to my graphic design experience and tried to get me to re-design their brochures, under the guise of it 'being part of my course' and would keep my skills up to date. God loves a tryer!

 

They even said they'd pay me to do it but they'd have to see the finished thing first then decide if they wanted it. Yeah, right - could see that one coming; I do the work, they love it but tell me it's no good then when I'm safely off the course they use it. I told them to put the offer in a written formal contract of work so I could show the DWP that I had a few weeks work. Not surprisingly they didn't - and they got nothing out of me either.

 

Trust nobody.

I think the trust nobody is a good motto. Sad that it has to be that way but hey. I think , especially for people on ESA they try to get you to do a bit more and a bit more all the time. Now if I wasn't so cynical I would say it was just trying to help you by pushing your limits but I am cynical

Indeed it was Antone. Vengeance was mine however, as part of the course - laughingly named 'Media & Design' - involved creating a portfolio of work based on the rubbish tasks they thought up. Anyway, my friend and I easily did the portfolio and all we had to do was sign it off.

 

Just before we signed however, the tutor let slip that this portfolio wasn't technically part of our course and the only DWP requirement was the work-search part. On hearing that we both promptly refused to sign the portfolios off. 'But we can't submit them if you don't sign them off' said the tutor, meaning 'We can't get paid'. They spent the last 2 weeks of the course trying to persuade us to sign them to no avail :)

 

Part of this 'design' course involved creating a birthday card..and you were allowed to use the Wizards in MS Publisher. That was 12 seconds of solid work experience.

 

I used to print out leaflets called 'Spot The One Working Printer Contest', where you had to place an X next to the printer you thought was the working one this week. As fast as I posted them, the tutors took them down. My mate also printed out 'Cheap Tobacco & Alcohol' leaflets, directing people to the company on the top floor of the building and quite a few actually went and enquired. The company on the top floor was HM Customs & Excise :)

I have a cunning plan but not sure if it will work

 

When you are getting ESA you also get N.I credits right?

 

My ESA was stopped in May 2015 because I am a full time student and not in receipt of DLA or PIP. It was income based ESA

 

If I were too reclaim ESA as a new claim for a substantially different reason than my original claim will the NI contributions count towards getting contribution based ESA? As a student I can get Cont based ESA

 

Any thoughts?

I'm not so sure. According to the gov website you get Class 1 credits when on ESA. Class one credits count towards USA and ESA as well as your pension.

Maybe it is worth exploring

The credits you get whilst on ESA count towards the second contribution condition for ESA©. However, you also have to satisfy the first contribution condition, which states in one of the last two completed tax years (for a claim made today, that would be 2014/15 and 2013/14) you must have actually paid NI contributions on an income that is at least 25 times the weekly Lower Earnings Limit of around £110 per week.

Are you saying you need to have earnt and paid NI on 27500 or you must have paid NI for 25 weeks?

 

Either way it doesn't cover me

Well, the Lower Earnings Limit is the weekly amount at which you start to be liable for NI (roughly speaking). So in the course of one of those tax years, you need to have earned at least 25 times the LEL and paid NI on it. So I suppose that means you would have to have earned around £2800 or so. There are other complications, but that's the general idea.

 

So the basic idea is, as you said, that you have to have paid NI for 25 weeks.

I have just finished my degree course and am therefore able to claim the dreaded UC- the year end date for the course was 30th June 2018.

 

As part of the questions they ask is what do I want to do to increase my employability. I have included further study as an option

 

Do I tell the work coach I have been offered a place to study for an MA starting 1st Oct so in reality i am looking for benefit for 3 months - if I am honest I would be happy with just my rent being paid as I have some part time work ( a few hours a week) that along with what I have left in the bank would just about get me through the summer - I do mean just about, no frills , no drink and luxuries

 

So do people think its a good idea to to say i am in the market for a full time job or that i have something lined up from 1st Oct and will be signing off then.

 

I don't want to give them any excuse not to pay

You claim based on your circumstances now.

Don't complicate matters, as you cannot report a change in circumstances in advance to UC, as their system does not accept advance change notification.

 

Just follow the process advised to you.

Once you have submitted your claim, you will have a to-do list of what information you need to supply.

 

Once you have verified the claim by going to a Job Centre, you will be asked to attend a commitment review meeting.

If you earn less than about £400 a month, you will be required to look for more work hours and regular reviews (about once a month).

 

If you earn between about £400 and £1100 a month, you will be in their light touch regime, where they encourage you to increase work pay and you might be asked to attend the Job Centre a couple of times a year.

 

So once you have the claim up and runnng, you should get paid first payment after 5 weeks and then on the same date a month later.

 

When you get to 1st October or relevant date where student financing takes over, you advise UC of your change in circumstances and because of the change, you will have to close the claim as you are then not eligible for help.

 

Your problem is going to be the possibility of the time gap, where UC stops paying and you receive alternative payment from student finance.

 

If you start your UC claim today 1st July, your normal payment date will be the 8th of the month I think.

First payment 8th of August, second payment 8th of September, third payment 8th of October.

If you informed UC on 1st October that student finance was going to take over, you might not receive October payment.

 

you need to think about this.

As long as you inform UC within reasonable time of the change happening, you will have done nothing wrong.

They will calculate whether there has been any overpayment and you can negotiate repayment over a peeiod.

 

UC is a fairly easy process, IF claimants do everything asked of them, at the time it is asked. If people delay providing any information and/or seek to complicate matters, then that it where it goes wrong.

My earnings will be below £400 a month but I may well be able to up them, one of the issues is many of the shifts are 2-3 hours long. Once I take out travel costs and the clawback UC take it means I work for about 50p and hour - I can discuss this with the work coach.

 

I have submitted my application- the online identity check wouldn't work but it says it has so that is odd. My next job is to make an appointment with the work coach so I will call them tomorrow.

 

The point about payment dates is really worth knowing - clearly i don't want to do anything wrong but it would be much easier to pay back than chase them for money

 

Although term starts officially 1st Oct. that week is registration etc and lectures don't start until the 8th which will be crunch time for me.

Although UC is paid in arrears and whatever the situation at the end of an assessment period is paid out, any reported change near to the assessment end period can cause problems. For a payment due around 7th or 8th, would be processed about 3 working days beforehand. So if money is going to be tight, you need to remember this.

 

Just make sure you advise of the change to student finance within reasonable time.

 

You may be asked to supply a copy of the student finance document so they can see when the finance starts.

 

This can be taken to a Job Centre close to University or ask UC helpline for a document upload to-do to be created, so you can scan and upload.

Thanks again. It should help as I am a mature student and live in my own home.

 

To be fair, money will be tight but not impossible if the Oct payment is late but it will be much less stressful for me not to have to chase it.

I will be able to do a rough calculation of any overpayment and set that aside.

 

I am lucky in that July's rent is paid so if it all works out my August and Sept rents will each be a week late and my LL should be OK with that.

 

As you may realise I don't deal with unknowns very well so your words are really helpful

My son just finished college, he tried to claim JSA and was told he couldn't because officially he is still enrolled in college until September,

i have read about a few people saying the same thing but because he is going to uni in September housing benefit still consider him a student and I still get my housing benefit.

I probably fall in slightly different rules because I am a mature student

 

Anyway had my first real job search review today - I was told to keep doing what I am doing and update my journal. Might have helped I got paid just over £400 at the end of July but after UC take their 63% and the council their 20% it was hardly worth it.

 

I did tell him I had been offered a place on the MA but was deciding if I could afford to go - I will have minimum work paid at the end of August and again very little at the end of Sept. I do have a fair bit of work the last two weeks of Sept but that will get paid in Oct after I have 'signed off'

Just thought I would update

 

My job coach has been an absolute delight, this month I was with him for about 10 minutes

 

he knows I am (in all probability) starting my MA in Oct and also knows I do look at Unitemps everyday or so for new casual and part time work. Non of my hours had been picked up by the system this month and he was fine with that (no doubt they will be picked up next month- I get paid on 31st).

 

We have arranged one last meeting for the last week in September . I asked if they would need proof I had closed my claim and said no, they would just be glad to get another person off the books. As for closing the claim the advice matched what has already been suggested although I am sure that was unofficial.

 

I would however say the whole concept of making work pay is a total fallacy.

 

UC take 63% of earnings and my local council take a further 20% off council tax relief meaning on an £8 PH job I clear £1.36 per hour. Once you deduct travel costs , unless the shift is at least 5 hours , I would actually be out of pocket.

 

While my travel pass was active up until 23rd July and since I bought the new one in late August I think I did one days work
