The defendant seeks to exclude their liability in breach of section 57 Consumer Rights Act. The secondary insurance contract is in breach of section 72. The claimant seeks reimbursement of £265, plus P2G fees of £9.10, plus postage costs for two first class letters to P2G of £2.70, plus court fees, plus interest.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

On a couple of posts I've made two people in particular have taken personal stances on questions I've asked, and instead of answering, simply slag me off.

Please could you post a link to the posts which you are complaining. You can link to those specific posts by clicking the #number at the top right of the post. For instance, the post I am making now will display as #4.

 

However, especially people who are quite new to a forum and often are asking for help on quite personal or stressful problems, can sometimes feel exposed when the responses they receive are given in public – of course this is a public forum. Therefore it is possible to become rather too sensitive to comments made by people who in reality are only seeking to help.

 

It is also easy to misconstrue people's intentions because of course all you can do is read their comments without seeing any of the body language or the nuances which are normally extremely important in face-to-face communications.

 

I'm afraid that it is the nature of Internet forums everywhere, but sometimes one must be a little more resilient – and most of the time people respond to posts have no ill intention whatsoever

The internet makes everyone sharp and cocky, same characters in real life would be running away just if you looked at them.

Nothing you can really do apart from reporting to admin, but as in every other internet platform there are the ones who can say whatever they want and the others who get a beating at first unconventional post.

I suppose that I might have taken a softer line but I have to say that I wouldn't call this trolling by any means. Also, I can see that there have been at least a couple of people on your thread who have been trying hard to advise you in a particular way and am sorry to say that you seem to be caught up on some personal issue which unfortunately is not really relevant even though it might seem to be hugely important to you – and from your own personal perspective, I'm sure it is.

 

As I say, although I might have taken a softer line, I can tell you that the quality of the advice that you are receiving on the subject is a thousand times better than I could ever give. I think it would probably help you generally if you tried to look at the matter less emotionally and deal with it in a pragmatic way – which is I think what is being recommended to you.

 

I'm sure that you are extremely anxious about the situation and I'm certain that that is not helping the way that you perceive things either at work or on this forum. However, I can assure you that we are absolutely on your side in terms of giving you the best advice. Being on your side doesn't necessarily mean that we are saying you are right. It only means that the advice we are giving you is really calculated to provide the best possible solution for you.

 

There is certainly no trolling here and if you were ever trolled you would understand what it really is and how bitter an experience it can be. Being followed around by someone and constantly attacked and denigrated for no particular reason other than to satisfy some malicious intention. It's very nasty.

 

None of that is happening here. I should listen carefully to what is being said to you and in particular try to clear away some of the emotional haze that is probably distorting your view of what is happening at work and here. I'm sure it is easier said than done.
