Hi

 

Does anyone know the cost for summary judgement application.

 

It's over 10k. The fee quoted says the amount if up to 5k. But I can't see one for the amount I will be claiming.

 

Can anyone advise? If not I will ring the court and ask.

Yes, please let us know when you find out although maybe somebody else will come along with the answer for you.

 

Can you tell us a bit more about it because summary judgement is very rare and you have to be very sure of your ground.

In the past, summary judgement procedures under order 14 RSC only occurred in High Court proceedings. Although it was always available in the County Court, it was very rarely used. Now that the limits for the County Court action is are so much greater and actions in the High Court are actively discouraged when County Court procedure is available, I imagine that the same culture has carried over.

 

As you say, you should call the court.

 

However I'm sure that you have done enough research to know that a very basic requirement is that there is no arguable defence to the claim. You can be sure that for a court to give a judgement without having heard anything from the other side, there will be a very high bar. Also, a summary judgement would normally be accompanied by all sorts of provisos involving costs to be awarded against the claimant if the summary judgement is subsequently overturned et cetera et cetera.

 

You are potentially treading on dangerous ground.

Standard N244 application fee with hearing......no connection to the value of the claim.

Thanks for the advice.

The fee has been confirmed by the court as £255.

 

 

Be careful as this will be a fast track claim so if you lose your summary judgment application you could be hit with a hefty costs bill from the other side.
