bought my house 2014

got it taken out of banding as not liveable

they sent someone out to look at it

 

took me a year to repair it

moved in and rang council on 23 /12/15 said they would send paperwork

 

then rang them again 25/1/16 told them i had no paperwork

told me they would email banding people and could not send me a bill till back in banding

 

well its now 20/3/18 and still no paperwork

do i ring them or leave it

 

i also dont want to pay

can you with letters and a solicitor get out of paying

im also self employed if that makes a difference

 

i didnt record calls or get any names from people on phone from council

Hi

 

I think you need to get back in contact with the Council referring to your previous contact to try and sort out your Council Tax Banding and that you will also be contacting the VOA for advice as well. (the longer you leave this the higher a Council Tax Bill you will end up with once the banding is sorted as they will back date to 2015/16 as a start date).

 

Do not phone the Council unless you can record the call put it in writing.

The Council have nothing to do with Banding. This is all done via the VOA and they inform the Council which Band you are in, only then can the Council send you a CT Bill but as others have warned it will probably be back dated and you will be expected to pay it. If you have improved your property then there is also a good chance it will be put into a higher Band than any other neighbouring properties.

As above, there is a legal requirement that a property is entered in to a valuation list before the council can issue a council tax demand notice. The council can try and push the valuation officer along but ultimately it is the Valuation Office / Scottish Assessor who make the entry and until they do so everyone else is tied.

 

It's very unusual these days for a property to be entirely removed from the valuation list but I'd expect that the new entry will be banded from scratch and so any improvements would be taken in to account.
