Hello.

I am 2 and a half years into a 4 year finance deal on my vehicle.

It is all up to date at the moment.

 

However I am changing job this month, but am going from self employed to full time employed and paid monthly. As I have no savings I will be going a whole month with no income so I am going to struggle to pay all my bills for this month.

 

Before I start talking to the finance company about this to try and come up with an agreement (which I don't think they will be keen to do) what are the legalities of me missing one payment?

I'm assuming they can't start repossession proceedings yet?

 

I'm hoping they will agree to take just a small token payment this month then make up the shortfall over the next two or three but if they try to play hardball where do I stand?

Can you ask your new employer for a salary advance (not the whole months payment but what you need for essentials?)

 

They might agree to (for example) 1/4 of the month’s money after you have worked 1/2 the month .....

You won’t be the first employee to be moving from weekly pay to monthly, and won’t be the last, so they may well have been asked for / done this previously.

They can't repo unless you miss 3 payments, issue a default notice and take you to court..you've paid more than 1/3rd..go READ your agreement...

well they'd have to go to court and get a return of goods order

as the car is protected goods.

 

if they've levied any penalty fees you can get those back.

i'd just pay what you can when you can.

Ok thanks. I think I'll write to them and enclose a small payment for this month and tell them they can have the rest over the next couple of payments.

With regard to penalty charges are you saying i can claim those back, even though it will say what they are somewhere in the agreement?

no in the T&C's

and as we know with bank charges & PPI

doesn't matter the FCA has deemed them unfair.

HI, I've recently paid off my car finance which was with Close Brothers Motor finance.

 

Over the period of the loan there were a few late payment administration charges charges added.

 

I remember someone saying its possible to claim these back?

Is that correct, and if so how should I go about it?
