Hi All

 

I just wanted some advice please if anyone has dealt with these before.

 

Long and short of it is,

I underpaid my installment (arrangement) for two months last year unknowingly.

The moment I realised I paid the £180 immediately.

 

It was a typo and despite calls and letters to the above they are taking us to court for (so they say) the arrangement to be made by a judge.

 

I have paperwork to complete on line and I can take all letters/exchanges with me.

 

Unfortunately Whistletree apparently didn't have my mobile number to contact me and were calling the landline, which I no longer use but is connected only for broadband.

 

My arrears some 8 years ago were £24,000 and now are £6,000.

what do you mean by:

what letter have you received..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi

 

I cannot scan the documents up sadly

- I have one at work but it means the whole world will see the document.

 

Whistletree have said by telephone that they are taking us to court to obtain a repayment of arrears order by the Judge

- this was obtained 6 years ago and adhered to.

 

Looking at the paperwork they are taking us to court for possession.

The arrears total £6,500

the original arrears were over £20k without the unsecured loan part.

The house is approximately 50% LTV at present and rising.

 

I am also going to ask the Judge to look at the interest rate charged as I have asked them to reduce it in line with what they would charge an existing customer (without arrears) and they refused point blank.

Apparently there has been a case proven in court that they should be looking at this.

 

I am worried obviously as it is stressful, but I made a genuine typo and rectified it the minute I knew about it.

Surely a Judge will see this?

 

Hopefully we won't have to pay the £360 court charges either

- the Judge made Northern Rock (original lender) pay them last time.
