    • Hello, Following the submission of my defense, last night I received an email from DCBL indicating that the claimant intends to proceed with the claim (I've attached a screenshot of the email for reference) along with the N180 directions questionnaire. I'm unsure how they obtained my email, but I suspect it was through the courts' form when I completed the Acknowledgment of Service. This email almost slipped my attention. I have also today received a letter from court to state they have received my defense.  It appears they are requesting an online telephone hearing with the court.     • Default Amount £9237.88, all this started in 2006 Admitted debt £9075.65 Weightmans added £1515.01 immediately they became involved, no explanation The Statement shows when Marlin bought debt in May 2011 £10439.25 Their statements, not received until the SAR, are based on this. Cabot deducted £1515.01on their statements in January 2019, again did not find this out until SAR. Weightmans added in  2007 after the CH1 etc was confirmed by the court £741.50, made up of Process server fees, Court Fee (they tried for bankruptcy), Solicitors fee and Land Registry fee. Unspecfied Legal costs were added by Marlin in March 2015, again I did not know this until statements received with SAR I had been paying monthly, without exception until December 2018. I am minded to take the property charge, CH1 amount ,deduct all my payments and the subsequent fees, and request/demand a refund on the final payment made? I consistently disputed Weightmans balances, but they never responded. I also told Mortimer Clarke/Cabot that I disputed their amounts.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Going back to submarines, if you have women on board, during the course of a patrol that person could become ill, say with women’s problems for instants.

 

Now submarines only carry one medic and that is a leading hand

 

A friend is a doctor, and joined the Royal Navy while at medical school. As a qualified doctor one of his posting was aboard a submarine (I assume a boomer, although he never gave details of the boat he was assigned to. He did say "the circumstances in which we would surface while on patrol were VERY limited......).

So, it wasn't accurate to say "they only carry one medic, and that is a leading hand", unless this is a new policy....

 

How very dare you change the subject away from warships and submarines...what was the title of this thread ? :-)

AFIA, Boomers do indeed carry an MO as part of the crew. If any other boat has an MO on board he would generally be there as a ride-along... Subs do indeed normally only carry one medic, albeit one who has undergone extra training to allow him to perform additional tasks whilst at sea...

 

Any such crew member MO must be submarine qualified. Your friend was either a ride-along Doctor on a posting or he submarine qualified and was embedded on something beginning with V.

The Royal Navy rank equivalent to an army corporal is "Leading rate" or "Leading hand", (NATO rank code OR-4).

Mind you, if they are (enlisted, not officer) medics, they'll probably be MA's (Medical Assistant), or even MASM if they are MA's who have specialised as submariners ........ although their rank insignia (if not promoted to Petty Officer) will be the same as a leading hand ....... the insignia being a 'fouled anchor'.

that is why everything is done on CCTV as well. There are a number of people in this world who would say anything to get someone sacked from that sort of job. Arrest and search of women by Pc's rather than WPc's is another case in point, it use to be a no-no but now common whne the women are kicking off.

 

That's fine as the woman has consented to the search, but what would be your reaction if on completion of

the search the woman complained that you touched her inappropriately, even if you had not, you know what they

say were there's smoke there's fire.

 

You would be in the soup whether you are guilty or not, because that's how things

work today. It would be just your word against hers, who do you think they would believe, you or her, I know the answer

to that one, and so do you. It would defiantly not be you.

This was my first post in this thread.

In a country where you cannot say anything in case somebody find it objectionable, or offensive.

I think this piece of humour really sum’s up how the crazy PC brigade is destroying this country.!

It’s been snowing all night. So the morning goes like this;

 

8:00 I made a snowman.

 

8:10 A feminist passed by and asked me why I didn’t make a snow woman.

 

8:15 So, I made a snow woman.

 

8:17 The nanny of the neighbours complained about the snow woman's voluptuous chest.

 

8:20 The gay couple living nearby grumbled that it could have been two snowmen instead.

 

8:25 The vegans at No. 12 complained about the carrot nose, as veggies are food and not to

decorate snow figures with.

 

8:28 I am being called a racist because the snow couple is white.

 

8:31 The Muslim gent across the road wants the snow woman to wear a headscarf.

 

8:40 Someone calls plod who show up to see what’s going on.

 

8:42 I am told that the broomstick of the snowman needs to be removed because it could be

used as a deadly weapon. Things get worse after I mutter : "Yeah, if it's up your ****

 

8:45 Local TV news crew shows up. I am asked if I know the difference between snowmen

and snow-women? I reply, "Snowballs" and am called a sexist.

 

8:52 My phone is seized and thoroughly checked while I am being blindfolded and flown to

the police station in a helicopter.

 

9:00 I'm on the news as a suspected terrorist bent on stirring up trouble during this difficult weather.

 

9:10 I am asked if I have any accomplices.

 

9:29 A little known jihadist group has claimed it was their plot.

 

Moral: There is no moral to this story. It’s just the crazy mixed up Britain we live in today!

Says it all really, officials wanted to integrate women into a combat unit (RAF Regiment)

(the word integrate = political correctness= diversity) what a way to run the military, it is

not as I have pointed out in my other posts, to make the service more efficient (what a

waste of money and time).

 

She quit after two weeks when she admitted she underestimated the physical requirements

need in the 18 week course, still I expect the top brass will get around that by making the

course easier so that they can pass.

 

She also says she felt left out because she had to use female only accommodation, so what is

she saying she should have been allowed to bunk down with the boys? If that had been allowed

that, how long would it have been sexual harassment or some thing equivalent. I would not

have wished to share a billet with her, not in today’s PC country/world.

 

I can just imagine one of the lads going for a shower with a towel around has waist, the next

thing you know he would be had for indecent exposer, what a joke, no wonder the military is

thousand short of recruits.

Strange that as we enter festival season I enter a world of shared tents, loos, showers and not a problem seen. I understand that my age means I wouldn't suffer being viewed as a sexual object but I do observe the young and they're perfectly capable of living side by side without issue. The equivalent of hot bunking, close proximity, all those things can carry on with individuals respecting each other anywhere but in the military. Really?
