Hi there, I got a "new" student loan in the year 2000 for my undergrad in UK.

 

I paid some of it off when i worked in London 2006-2008.

 

I moved to Paris in 2008.

 

I think I contacted SLC in writing in 2012 but didn't pay anything back.

 

I just received a nasty letter from SLC saying that a Third Party Debt collection agency is going to be contacting me to get £6,000.

 

My friend says that if after 6 six years if haven't

(1) contacted the lenders in writing acknowledging the debt or

(2) made any payments to the lenders then the debt is wiped as it's past the limitations.

 

Is this correct?

It will be 6 years in one year.

Ignore them. DCA's cannot do ANYTHING unless they own the debt. And even then they have tomeet a lot of specific criteria to collect and enforce.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Hopefully someone who knows more about the law on statute barred debts than I do can comment, but in the meantime I found this advice on National Debtline website

Student loans

 

There are ‘old style’ and ‘new style’ student loans. Old-style student loans are for students who started their university course before September 1998. New-style student loans apply to students starting their course from September 1998 onwards.

 

The Limitation Act says that the limitation period for student loans is six years.

 

The cause of action (when the limitation period starts running) for old-style student loans, is usually when the loan became due for repayment in the April following the conclusion of your course. However, if you asked for it to be deferred within the six year limitation period, this would have restarted the limitation period.

 

For new-style student loans, the cause of action is likely to be when your earnings reach the set level at which deductions from your wages can begin. Because the Student Loan Company can take money directly from your wages, it might be more difficult to use the Limitation Act.

yours is not the old style mortgage loan so cannot ever be statute barred sadly

 

but if you are never to return.......

 

are SLC aware of your correct paris address

I gave them a wrong address.

My friend with a loan like mine says that his was wiped legally as he went away to Australia for 10 years, and 6 years without payment and contact.

 

Why did SLC give 2/3rds of my debt to a Third Party Debt Collector?

 

My friend said it's because they realised that they couldn't enforce it any more. thanks

what debt agency erudio?

 

only the old style mortgage loans become SB'd

new style contingency loans are take from wages if you earn more then the yearly wages threadshold.

 

yous are all new style

SLC still own the debt

they've just asked those fleecers to try and chase the debt.

 

I would assume TWW stated client is SLC I bet....
