Hi all,

 

I was clearing out some paperwork today and found some old statements from an HSBC Credit card from 2004 - 2005.

 

I was shocked to see some pretty massive payment protection payments every month, up to £70 in some months.

I know that I had this credit card for many years, before and after this period, so I could have paid thousands in insurance.

 

I genuinely don't remember if I paid this card off or not,

I can't find any DCA letters chasing it up.

 

Even if I didn't the debt would be long since statute barred.

Last payment would have been made around 2007 ish.

 

With a card this old,

how would I go about kicking a PPI claim off?

 

Also if I still owe the balance would HSBC simply be able to take the balance and pay it off against the loan?

not if they don't own the loan no

and it would have to be directly linked to the card.

 

might be best to sar them.

 

the issue here might be that as its an agreement from before 2005 regulation came in.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi,

 

Doesn't an SAR only go back 6 years? Will HSBC have stuff going back to 2004 on record still?

 

Also on the statement it is listed as 'Cardholder Repayment Protector', and was a variable amount every month. Is this the same thing as PPI, and is it reclaimable?

we find banks have data going right back

 

yes its PPI

Also does anyone happen to have the data controller details for HSBC/ HSBC Mastercard?. I can't seem to find a relevant address to send the SAR to.

Hi All,

 

I received my SAR

 

Just to give a resolution on this, HSBC will owe me around about £2000 in PPI and late fees combined.

 

However they still own the remaining balance of around £1900, so the whole thing would be swallowed up anyway. Considering this defaulted in 2008 with no payments since, it has been statue barred for nearly 4 years, and long gone from my CRA.

 

I'm just going to leave it alone .
