Hi,

 

My Mum sold her car but didn't send the green slip to the DVLA for 3-4 weeks.

 

In the meantime the guy that bought the car racked up two parking fines.

The fines were sent to my Mum as the car was registered to her still.

 

He paid one fine but is stalling on paying the second one.

 

It has now with bailiffs.

How should we proceed?

 

There is photographic evidence that he was the driver.

Do we have any chance of making him pay the fine?

Over £220 now.

 

Any help would be very gratefully recieved.

Why didn't she Appeal both PCNs at the time on basis she had sold the vehicle and provide buyer name & address?

 

Quite. In not contesting liability with the Council from the outset, she has allowed herself to become the debtor. Notices will have been sent to her and received and now bailiffs are on the case. It's a bit late now to deny responsibility.

So your mum did give a receipt or bill of sale that you both signed and dated I presume.

Remember its what you can prove, not what's true.

 

Send a copy of the bill of sale to the council explaining your mum was not the owner at the time of the offence
