      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

At the beginning of this year i was shocked to see 2 companies that i didn't recognise taking money out of my TSB bank account via my debit card.

Add's up to approx £15k

 

i was oversea's at the time

 

i called and informed that these were not my charges [ one charge after the other].

 

They would tell me the correct person was not there or that i had to speak with someone in fraud department

but could not have the number.

 

They had to call me.

I waited and got no calls.

 

I was shocked that despite informing the bank of these fraudulent charges that new charges from same company kept being debited.

 

When i finally got a chance to talk with fraud dept

i was told they would not put these charges back and that i had to call the companies directly.

 

The companies have been no help to assist me.

What kind of step should i take next?

Hi Sun and welcome to CAG

 

You need to send the bank a SAR so you have proof of calls made to report the suspect transactions. Tell the bank, in addition to other data, you require recordings of the calls you made to them on xx dates (when you reported the losses).

 

You also need to complain in writing and not by phone, so you have proof of all you've said and their replies.

I would suspect that these payments are being taken by continuous payment authority

because your debit card has either been cloned or used by a dodgy trader at say a trade stand or restaurant abroad with a bogus additional terminal

[as that fits your situation].

 

they must and should act and shouldn't be referring you to any fraud dept.

 

you need to cancel the CPA and they should then refund ALL of the money.

 

comeback to me if all this sounds correct...

Who are the companies and whats the payment for ?

 

15K is a lot of money ...what amounts did they take in each transaction ?

The companies are freelancer.com and amazon and the third is a credit card i never applied for called AQUA.

 

The card company have told me that they are holding me liable for the debt .

 

The biggest chunk of money went to freelancer.com and they took approx 50 payments ranging from 2 to 980 pounds

which points to more than just debit card issues

 

looks like you've suffered identity theft or alike

certainly for an aqua card they'd need pers details and a differing mailing address as you would of gotten all manner of letters by now otherwise.

 

freelancer.com is a very common method of attaining money from people

they register as you wanting to fund...

 

then use a business name that gains funding from you [them] by selecting them in your funding profile

but again they'd need more than a debit card number.

 

amazon orders can be done simple by using the skimmed card number

 

it might pay you to get onto actionfraud

 

sar to freelancer.com is a must there should be details there of the account number your money went too
