‪Hi Guys. ‬

I received a letter from county Court which say “notice of warrant of control”.

 

Creditor : Lowell portfolio Ltd Re: Lowell financial limited

 

To the debtor :

“ You have not made payments under the judgement as you were ordered.

The creditor has therefore asked for a warrant to be issued to the bailiff to seize your goods.

Unless you pay the amount due in county Court by 24th November.

Total to pay (including fees) on this warrant £ 170.25

Balance outstanding (after payment on this warrant) £ 572.57”

 

The problem is I haven’t received any letters from court or Lowell.

I have no idea what this debt was for?

I am not always on this address as well.

 

How can I stop this warrant,obtain further details about this debt and defend this claim ?

 

Any advice will be welcomed.

go get your credit file

you should see a CCJ registered note the number

go ring northants bulk court

and ask for a copy of the claimform & the CCJ by email PDF

Ok. I will check it in my credit file. the warrant letter had brentford county court address on it. (It should also have the claim judgment number on it ?)

Do I still have to ring Northampton County Court?

 

Yes to get the details of the claim so you know what the debt is....and to be able to suspend the warrant/set a side the CCJ.

That’s what I found on my credit file. The reference number is same as on the recent letter I received. However the amount is different.

Hi guys.

I rang the court this morning and requested the details to be sent to me via email.

That’s what I received.

 

1.this claim is for 646.42 the amount due under an agreement between the original creditor and the defendant to provide finance and / or services and / or goods.

 

this debt was assigned to / purchased by lowell portfolio i ltd on 03/10/2012 and notice served pursuant to the law of property act 1925

 

particulars

re:o2 (uk) ltd

a/c no xxxxxxxxx

 

and the claimant claims 646.42

the claimant also claims interest pursuant to s69 county court act 1984 from 03/10/2012 to date at 8% per annum amounting to 86.15.

 

On warrant the last day for payment is 24th November.

 

Which is after 4 days

What should I do ?

So you must decide what you want to do.....?

 

Agree an affordable monthly payment ?.......N245

 

Suspend the warrant and set a side the judgment and defend from the beginning ? ....N245 and N244

that wont matter

you simple ring or tell the bailiff you have done so

its a county court bailiff

not like what you might be thinking like you've seen on TV.

they are not commission based.

 

if you aren't aware. theres not right of entry on civil debts anyway.

go read other warrant of control threads here and you'll know.

you should have been reading up...

theres no agreement pursuant to the consumer credit act for mobile phone unless its very recent and your is not.

Cool. I will do N245 and N244 today.

Should I do CCA aswell ?

 

So you now know what the debt is and you have a valid defence ?

 

The fee to set a side is £255 (N244) and the fee to suspend the warrant is £50 (N245)

 

...so nearly half of the debt value.

Should I send those forms to CCBC in nothampton or in brentford (where I received the warrant from ) ?

I just started new job and haven’t got paid yet. Can’t borrow £305 either. Time is not on my side So I think only option left is to agree with monthly installments.

:thumb: Sound the sensible approach...as this is the Courts Bailiffs you may be able to agree it through them without need of the N245 or fee.

Finally got hold of ballifs. They only seems to be interested in their warrant money of £179. So I paid £100 and balance to be paid next month. They send me contact details of Lowell but advised to clear the balance on warrant first b4 I arrange monthly payments with Lowell.

Is this right ? Or I still need to file N245 ?

Its a fixed fee for the use of Court Bailiffs which is added to the judgment debt amount....contact Lowell try to negotiate a longer repayment period.
