Hi All

I need help re clarification of the above

I have started a civil court action against my housing association landlord

I did send a LBA

They did not response

They have now responded that I breached the Pre Protocol procedure re disrepair

Does anyone know what this means

I have already sent my N1 form plus documentations to the court

DIY Personal Injury

 

 

I was injured at home by the operativ of my landlord in September 2015

 

 

I got a solicitor involved but poorly handled my case and did not progress it

I want to start this claim myself

I am not sure if my preliminary letter before actionlink3.gif should go to

My Landlord

or

My landlord, The Operatives contractors

For neglect

 

 

My Injury is on public record i.e my GP and Hospital

 

 

Can anyone help, please.

I think we probably need more detail on how the injury actually occurred.

 

E.g. did the contractor/operative specifically do something (like drop a ladder on you), or did he not repair something properly which later caused you injury.

 

 

 

Kicked my door

hand was on the other side of the door

force was strong enough to damage my door

Called me an abusive name on his way out

shoulder injury as I has my hand on the door of my home

Saw my GP quickly

had treatment in hospital

You have 3 years under the statute of limitations to bring a claim....the date of knowledge is the date that the Claimant knew, or should have known, that their injury was the result of another party's negligence.

We could do with some help from you.

Where did you Solicitors get up to with your claim?

 

I assume that a Claims Notification Form (CNF) has already been submitted to the Defendants?

I want to take on my landlord and their operatives myself

Sadly the solicitor messed up my case and concluded that I had no case but that I can go after my landlord for negligence

Do I need to send a Pre Action Protocol letter to them?

Do you have a template I can use?

Solicitor messed up my casse and dumped it but asked that I sue for negligene

CNF was sent to operatives not landlord

Now I want to take on Landlord and Operatives myself

Can you help with a template Pre Protocol letter for PI?

Do you know where I can fine a template?

Should I send to landlord and operatives at same time?

In order to give you the most appropriate help and advice, it would be useful if you could post more details relating the injury and how you came about it. Provide some context, too.

 

Your posts thus far haven’t included much detail, and detail is needed when offering advice.

 

The experts will be along soon and the more info they have to look at the quicker you will get the help you need.

Operative sent by my landlord;s repair agent

I did complaint when he first came to my about his aggressive conduct and

They sent him back without prior warning

I did not let him in

He then kicked my door

my hand was on the other side of the door

for used was so strong caused injury on my right hand

ame on his way out

shoulder injury as I has my hand on the door of my home

Saw my GP quickly

had treatment in hospital
