I have spent thousands on damp proofing over many years, I let my premise in 2013 and in 2014 had the whole ground floor damp proofed, replastered and decorated, I also had the roof sorted. I have had to request my builder to treat my walls for patches which are caused from one of my neighbours, I have asked him if he plans to tackle it and he says no, affordability, my property is being badly affected as a result, what can I do?

So if damp is penetrating a party wall between the two properties, it must be extemely bad next door.

 

Is it possible the neighbour has a drainage issue ?

 

Not sure you can force the neighbour to do anything. If the wall was likely to fall down or there was a safety issue, then you might have a basis to litigate against the neighbour. But damp, might not be a good enough reason.

 

If you have legal insurance cover on Buildings Insurance, might be worth talking to them about it

try and get some sort of agreement to let a surveyor look at it (at your expense if necessary). This will show that the work is necessarya nd also gives a professional opinion that can be relied on shoudl the neighbor still not agree to do the remedail work. You then have a much stronger case to take to court as you can show what exactly is wrong and that you have tried to sort the matter out amicably. Judges hate neighbour disputes so the more you try for yourself the happier they are that they have made the right decision if one is forced to be made.

If it is a relatively small job it may be worth just paying to get it doen yourself as long as the neighbour agrees that your builders can do so.
