Hi

Firstly thanks for reading and all replies are gratefully received.

 

I have been on two special arrangements with my catalogue Very and littlewoods for 5 years.

Today they tell me that I pay everything off in full or they will issue a statuary default notice.

 

The special arrangement has already had an impact on my credit file so surely they then can’t do it again for another 6 years.

I asked them 5 years ago to do the default notice!

They have also told me today that I shouldn’t of had the arrangement for that long anyway.

 

Is there anything I can do to avoid the default being placed today.

I want to downsize my house but if they give me two defaults it will a further 6 years when realistically it should only be 1.

so the debts were not defaulted at the start of all this and are still on your credit file?

what does the monthly calendar say NOT AP I hope!!

oh god they never go away can harm you for upto 12yrs.

 

the quickest way to get it defaulted and thus removed in 6yrs is to stop paying now.

the defaults should have been issue after the third missed / short payment

please don't hit Quote...just type we know what we said earlier..

i have an update on this. I went to the financial ombudsman and they agreed shop direct should of applied a default 5 1/2 years ago. This was in October. The issue I have know is getting shop direct to update my file. FO are in contact but just wondered if anyone has any advice. I have the actions in writing from both FO and shop direct.

You tell them to change your file, or you tell the FSA/FO to tell them, or you sue to make them.

give them 14 days else you'll start a serious complaint with the ICO and seek financial compo...esp if you've been turned down for credit or had to take out more expensive credit or been refused a mortgage, if their NON default was causing you harm by itself only on your credit file.

 

its for the creditor to update your file, nowt to do with CRF providers

Which is a waste of time and elongates things 3 fold

 

Prove the OC wrong

write with ....Give them 14 days

Then off to the ICO

If you report the incorrect entries to the credit reference agencies, they will contact the creditors to confirm your information and then correct it when verified.

 

Very VERY rarely happens as the creditor will simply say " the entry is correct".

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

How do you know that it very rarely happens, do you have access to statistics on the number of failed requests, and if so, how many of those requests have confirmation from the FOS that its incorrect?

 

You can't just assume it rarely happens because that's what you think.

I've been in contact with FOS and he has been telling them since early November to change it.

I have rung them also.

 

The woman told me do what you want we have already been fined so go ahead back to FOS.

The guy at the FOS wasn't impressed.

I just want it sorting

I'm looking to move and they just put my account from query to arrears.

Had I have know they would of taken so long I wouldn't of accepted their token gesture of £50 and I have expressed this to the FOS who said I should accept!

 

I think the 14 days letter by recorded delivery and a conversation with the ICO may be the way to go.

 

Thanks for everyones input.

I will also contact Experian with my letters from both shop direct and FOS stating what should happen.

I guess if I take it from every direction one might work!

let the ICO sort it.

they will

the credit ref people will only refer you to them and the FOS and back to the OC's anyway.

 

ICO is always the way to go with Credit file issues.

Because its shop direct and they ALWAYS do this. I suggest you stop posting as you are giving out bad advice relating to creditors like this.
